The exemptions in section 7 have grown increasingly complex, incorporating modern environmental legislation (Nature Conservation Act 2002), forestry restructuring (Forest Management Act 2013), and Aboriginal heritage protections. It does this by:\n\n**What it does:**\n- **Establishes 'strategic prospectivity zones'** – specific areas of land (listed in Schedule 1 and shown on official maps) that are flagged as having very high potential for effective and efficient mining\n- **Locks up Crown land in these zones** – generally prohibits the sale or change of status of Crown land within these zones unless both Houses of Parliament approve it by resolution\n- **Protects mining rights** – ensures that mining operations under the Mineral Resources Development Act 1995 aren't blocked by changes in land use\n- **Provides compensation** – if a mining lease or exploration licence is revoked because the land use changes, the miner can claim reimbursement for exploration costs or compensation for losses\n\n**Who it affects:**\n- **Mining companies** with leases or licences in the designated zones\n- **The Tasmanian Government** (the Crown), which cannot freely sell or reclassify certain lands without parliamentary approval\n- **Land managers** such as the Forestry corporation and National Parks authorities, whose ability to change land status is restricted\n\n**Key exceptions:**\nThe law doesn't apply to:\n- Small parcels under 500 hectares (unless the Director of Mines thinks mining is viable there)\n- Land in permanent timber production zones, national parks, nature reserves, or State reserves\n- Land in specific towns listed in Schedule 3 (like Beaconsfield, Strahan, St Helens, etc.)\n- Land where changes wouldn't actually interfere with mining operations\n\n**Why it matters:**\nThis is essentially a 'mining lock-up' law. It tells the government: \"If this land might have valuable minerals, you can't sell it off or turn it into a national park without Parliament's explicit say-so.\" It balances environmental and heritage concerns against the economic value of mineral resources, with Parliament acting as the final arbiter when these interests conflict."}},"importantCases":[],"_links":{"self":"/api/acts/mining-strategic-prospectivity-zones-act-1993","history":"/api/acts/mining-strategic-prospectivity-zones-act-1993/history","analysis":"/api/acts/mining-strategic-prospectivity-zones-act-1993/analysis","conflicts":"/api/acts/mining-strategic-prospectivity-zones-act-1993/conflicts","importantCases":"/api/acts/mining-strategic-prospectivity-zones-act-1993/important-cases","documents":"/api/acts/mining-strategic-prospectivity-zones-act-1993/documents"}}
