Defines how mining operations are grouped** (Section 4): Multiple mining authorities held by the same company (or related companies) using shared facilities count as one operation for royalty calculations.\n\n**2. Sets reporting and payment rules** (Sections 5–13, 16–21):\n- Companies must lodge royalty returns with the Revenue Commissioner in an approved form\n- Returns are due quarterly (for mining leases) or yearly (for other authorities), though the Commissioner can change this\n- Quarterly payers must make **three instalments**: two monthly payments based on the previous quarter's royalty, plus a final payment when lodging the return\n- Companies can elect to change their monthly payment amounts if they reasonably expect lower royalties, but face penalties if their estimate is wrong\n- Late lodgement attracts fees (currently 206.70 fee units, roughly $212)\n\n**3. Establishes royalty rates** (Schedule 1, Sections 22–23):\n- **Prescribed minerals** (cobalt, copper, gold, lead, nickel, silver, zinc): Sliding scale from 2.5% to 5% based on market prices\n- **Coal**: Tiered formula from 7% up, based on average price per tonne\n- **Iron ore**: $1.25/tonne or percentage of value, whichever is higher\n- **Bauxite, uranium, mineral sands, phosphate rock, oil shale**: Specific formulas or fixed rates\n- **Other minerals**: Generally 2.5% of value\n\n**4. Provides exemptions and discounts** (Sections 25–27):\n- Coal seam gas used for mining operations or flared is exempt\n- First $100,000 of value for certain minerals (gemstones, rare earths, etc.) is exempt\n- **Processing discount**: 20–35% reduction for minerals processed in Queensland to specified purity levels\n\n**5. Creates a complex valuation system** (Sections 28–45, Part 5):\n- **Market value minerals**: Valued using listed prices (London Metal Exchange, etc.) or arm's-length sale prices\n- **Non-market value minerals**: The Revenue Commissioner decides gross value through a formal \"gross value royalty decision\" process, considering comparable sales, processing costs, and relationship between buyer and seller\n- Companies must apply for these decisions; the Commissioner can also initiate them\n- Decisions can be amended with time limits and fraud exceptions\n\n**6. Handles coal seam gas specially** (Section 13): Returns are lodged under petroleum legislation, not this regulation.\n\n**7. Includes extensive transitional provisions** (Sections 54–74): Preserves decisions, notices, and applications made under the previous 2013 regulation.\n\n**Why it matters:** This is a detailed tax framework affecting major mining operations. The complexity reflects the need to balance revenue collection with industry competitiveness, while the valuation rules aim to prevent transfer pricing manipulation (where related companies understate mineral values)."}},"importantCases":[],"_links":{"self":"/api/acts/mineral-resources-royalty-regulation-2025","history":"/api/acts/mineral-resources-royalty-regulation-2025/history","analysis":"/api/acts/mineral-resources-royalty-regulation-2025/analysis","conflicts":"/api/acts/mineral-resources-royalty-regulation-2025/conflicts","importantCases":"/api/acts/mineral-resources-royalty-regulation-2025/important-cases","documents":"/api/acts/mineral-resources-royalty-regulation-2025/documents"}}
