These criteria assess whether visa applicants are likely to be a significant cost to Australia's health system or community services.\n- **Lists 16 temporary visa subclasses** including partner visas (subclasses 300, 309, 820), skilled regional visas (subclasses 489, 491, 494), business investment visas (subclass 188), and parent visas (subclasses 173, 884).\n- **Repeals and replaces** an earlier 2022 instrument (LIN 22/007) that performed the same function.\n\n**Who it affects:**\n- People applying for the listed temporary visas\n- Migration agents and lawyers lodging applications\n- Department of Home Affairs staff assessing health requirements\n\n**Why it matters:**\nIf you're applying for one of these 16 visa types, you must meet Australia's health requirements. The instrument ensures the list of affected visas stays current. It also includes **transitional provisions** (rules for handling existing applications) — the old rules continue to apply for applications already in the system before this instrument takes effect.\n\n**Key takeaway:** This is essentially a housekeeping update to keep the health requirement rules aligned with current visa subclasses, with protections for people who applied before the change."}},"importantCases":[],"_links":{"self":"/api/acts/migration-temporary-visa-subclasses-for-pic-4005-and-4007-instrument-2026","history":"/api/acts/migration-temporary-visa-subclasses-for-pic-4005-and-4007-instrument-2026/history","analysis":"/api/acts/migration-temporary-visa-subclasses-for-pic-4005-and-4007-instrument-2026/analysis","conflicts":"/api/acts/migration-temporary-visa-subclasses-for-pic-4005-and-4007-instrument-2026/conflicts","importantCases":"/api/acts/migration-temporary-visa-subclasses-for-pic-4005-and-4007-instrument-2026/important-cases","documents":"/api/acts/migration-temporary-visa-subclasses-for-pic-4005-and-4007-instrument-2026/documents"}}
