In short, it lists: kinds of work (fishing, pearling, tree-felling, farming, construction, tourism and hospitality, disaster recovery and certain COVID-19 health work) and the exact areas or postcodes where that work is treated as “specified” (see ss5–9, 9A and Schedule 1).\n- It creates timing cut-offs for some categories (for example, tourism and hospitality work must be carried out after 21 June 2021 (s7); bushfire recovery work after 31 July 2019 (s8); critical COVID-19 health work after 31 January 2020 (s9); flood/cyclone recovery work after 31 December 2021 (s9A)).\n- It records that later amendment instruments (LIN 24/020 and LIN 25/048) will apply to visa applications both already made but not finally determined and to applications made after those instruments commence (ss10–11).\n\nWho is affected and who decides\n\n- Primary legal effect: the instrument defines what counts as “specified Subclass 462 work” for regulatory purposes (s3). That definition determines whether particular periods of work meet regulatory criteria that depend on that label. The persons directly implicated are people performing the listed kinds of work in the listed areas and any parties (employers, sponsors, or visa applicants) who rely on those work periods for migration outcomes.\n- Decision-making is made by the instrument itself and by the Migration Regulations it amends/defines (see s3 and references to regulations 1.03 and 1.15FA). Administrative implementation (checking whether claimed work matches the kinds, areas and dates set out) will be performed by the officials who make migration determinations under those Regulations.\n\nOfficial purpose-claims and a practical test against costs, incentives and trade-offs\n\n- The instrument’s stated mechanical purpose is to specify which areas and kinds of work are “specified Subclass 462 work” for the Regulations (s3). Treated as a stated purpose, that clarifies eligibility boundaries for the relevant visa rules.\n\n- Who pays / who bears costs: workers and their employers or sponsors will carry the primary compliance burden. To rely on a period of work as “specified”, an applicant or their employer must show the work matches the kind, area and date rules in this instrument (see ss5–9, 9A and Schedule 1). That creates documentation and verification requirements for applicants and for the department assessing claims.\n\n- Incentives and behaviour effects: by designating particular postcodes, regions and kinds of activity as “specified”, the instrument makes those work periods valuable for whatever regulatory outcome depends on the “specified” label (see s3). That creates an incentive for workers who want to rely on the label to seek or record work in listed areas and for employers in those areas to hire workers whose work will qualify. The instrument also sets dates for when certain work counts (ss7–9, 9A), which creates temporal incentives (e.g., work performed after a specified date qualifies).\n\n- Trade-offs and opportunity costs: the instrument channels regulatory benefit to work done in named occupations and areas. The practical trade-off is concentration of regulatory advantage in those listed locations and activity types (Schedule 1; ss5–6, 7–9A). That may divert worker supply and hiring decisions towards qualifying work and locations, and away from unlisted work or areas — the instrument itself creates that mechanical effect by listing specific postcodes and activities.\n\n- Compliance burden and administrative discretion: the schedule contains many detailed postcode and area listings (Schedule 1). Detailed lists reduce interpretive ambiguity about geographic scope but increase administrative tasks for applicants and decision-makers: applicants must demonstrate the location and nature of the work; decision-makers must check those facts against the Schedule. The instrument also refers to future amendment instruments and says those amendments apply to pending applications (ss10–11), which preserves administrative discretion to apply changed rules to existing cases when those instruments commence.\n\n- Implementation risk and updating: the instrument’s practical effect depends on accurate and current area/postcode lists (Schedule 1). Any error or delay in updating those lists would affect determinations; the instrument anticipates later changes by referring to LIN 24/020 and LIN 25/048 and how those amendments apply (ss10–11).\n\n- Effects on private enterprise and individual choice: the instrument does not directly set wages, terms or business licensing; it changes legal categorisation that private actors will take into account when making hiring and work-location choices. In consequence, businesses located in listed areas will find that certain types of employment they offer can be relied on by workers for regulatory purposes; workers seeking to benefit from that regulatory classification will be incentivised to accept those roles (see ss5–9, 9A and Schedule 1).\n\nSpecificity and predictability\n\n- The instrument is highly specific about which activities and which geographic units qualify (see ss5–7 and Schedule 1). That specificity supports predictability for applicants and employers but requires careful record-keeping (dates, duties performed, and precise locations) to demonstrate compliance.\n\nSources within the instrument cited above: Purpose statement (s3); definitions (s4); categories and kinds of work (ss5–7, 8–9, 9A); timing rules (ss7–9, 9A); application of later amendments (ss10–11); full geographic and postcode lists (Schedule 1)."},"kimi_summary":{"content_quality":"ok","complexity_score":4,"scope_assessment":{"changed":true,"description":"Originally, this instrument likely covered only traditional regional work like fruit picking and farm labour. To get an extra year, they must do \"specified work\" in \"specified areas.\"\n\n**What it does:**\nThe law lists five types of work and matches them to specific regions of Australia:\n\n- **Fishing, pearling, and tree farming** – only in Northern Australia (far north Queensland, Western Australia, and the entire Northern Territory)\n- **Farm work and construction** – in Northern Australia OR Regional Australia (most areas outside major cities)\n- **Tourism and hospitality** – in specific postcodes, Northern Australia, or remote areas, but only for work done after 21 June 2021\n- **Bushfire recovery work** – in areas hit by the 2019-2020 bushfires, including paid or volunteer work done after 31 July 2019\n- **COVID-19 healthcare work** – anywhere in Australia, for work done after 31 January 2020 (includes medical treatment, nursing, testing, and cleaning health facilities)\n- **Flood and cyclone recovery work** – in areas affected by severe weather events, for work done after 31 December 2021\n\n**Why it matters:**\nThis is the rulebook that determines whether a fruit picker in Queensland, a nurse in Sydney, or a hospitality worker in Darwin can stay in Australia for another year.
