It does three practical things: it names the approved application form to use, and it specifies the postal and courier addresses and the manner for lodging the application for each relevant parent visa subclass (see Part 2, cl 6–11 and Schedule 1). It comes into force on 1 July 2018 (cl 2) and is made by a delegate of the Minister under subregulation 2.07(5) of the Regulations (cl 3 and the instrument header).\n\nWho this affects\n- People applying for parent visas listed in Schedule 1 (Parent (Migrant) Class AX; Aged Parent (Residence) Class BP; Contributory Parent (Migrant) Class CA; Contributory Aged Parent (Residence) Class DG; Contributory Parent (Temporary) Class UT; Contributory Aged Parent (Temporary) Class UU) and their representatives. (See cl 6–11 and Schedule 1.)\n\nWhat the instrument does mechanically\n- It designates which approved form applicants must use (the form codes appear in Column C of Schedule 1, e.g. 47PA and 47PT) and where/how to lodge an application (Column D of Schedule 1 gives a postal address — Parent Visa Centre, Locked Bag 7 Northbridge WA 6865 — and a courier address — Wellington Central, Ground Floor, 836 Wellington Street, West Perth WA 6005). (See Schedule 1 and cl 6–11.)\n- For certain conditional cases it changes the required form or procedure: for example, holders of specific temporary contributory visas must use form 47PT instead of 47PA (Schedule 1, items 3 and 4); for contributory-parent newborn-child notifications, no approved form is specified and written notification to the addresses in Column D is used (Schedule 1, items 5 and 6).\n- It expressly repeals the earlier instrument Migration (IMMI 18/014: Addresses for Applications for Parent Visas) Instrument 2018 in full (Schedule 2).\n\nWhy the instrument exists (as claimed in the instrument)\n- The instrument is made under the Regulations to specify the \"approved form\" and the \"place and manner\" for making parent visa applications (see cl 3 and the operative provisions in cl 6–11 referencing Schedule 1). Those are administrative details required by the Migration Regulations framework.\n\nPractical compliance and implementation points (source-cited)\n- Applicants must use the approved form listed for their applicant-type (cl 6(1)(a) and equivalent provisions in cl 7–11; Schedule 1 Column C).\n- Applicants must post or courier the application to the addresses listed in Schedule 1 Column D (cl 6(1)(b) and equivalent provisions in cl 7–11; Schedule 1 Column D).\n- The instrument does not set visa eligibility criteria, processing decisions or fees; it only prescribes form, place and manner. (The definitions section points to the Act/Regulations for meanings: cl 4 defines \"approved form\" by reference to subsection 5(1) of the Migration Act and the instrument is made under the Migration Regulations 1994, cl 3 and cl 4.)\n\nWho pays, who decides, and where discretion sits (source-grounded)\n- Who pays: the instrument itself does not create or change application fees; it prescribes administrative steps (Schedule 1). Any fees remain governed by separate provisions in the Act/Regulations or fee instruments (cl 4 cross-references the Act/Regulations for defined terms).\n- Who decides: the instrument was made by a delegate of the Minister (named in the instrument header and signature block) under the authority of subregulation 2.07(5) of the Regulations (cl 3 and instrument header).\n- Administrative discretion: this instrument fixes the approved forms and addresses that applicants must use. It does not on its face delegate further decision-making about approvals or eligibility; those remain within the Migration Act/Regulations framework (see cl 3 and cl 4 for authority and definitions).\n\nCosts, incentives and likely behavioural effects (mechanisms, source-grounded)\n- Compliance burden: applicants must obtain and complete the specified approved form code (Column C, Schedule 1) and incur any postage or courier costs to send the application to the specified addresses (Schedule 1 Column D). For a small subset of cases (newborn child notifications in contributory temporary streams) the instrument allows written notice instead of using an approved form (Schedule 1, items 5 and 6).\n- Administrative concentration: the instrument routes all lodgements to the Parent Visa Centre addresses in Schedule 1 (Column D), which centralises intake of these visa types. That changes where applicants or agents send paperwork but does not itself change visa merits procedures (cl 6–11 and Schedule 1).\n- Impact on private actors: the instrument affects applicants and their agents directly (by specifying form and address) and may marginally affect postal and courier demand for these lodgements. It does not alter substantive visa requirements or market regulation.\n\nImplementation risks and trade-offs (mechanical)\n- Repeal and replacement: the instrument repeals the earlier IMMI 18/014 instrument in full (Schedule 2). Where the prior instrument contained different addresses or procedures, this instrument replaces them; any risk of misdirected lodgements arises if users rely on superseded instructions (Schedule 2).\n- Dependence on specified addresses and form codes: if the Department later changes processing locations or form numbers, applicants must follow updated instruments or notices; this instrument fixes the addresses and form codes while it is in force (cl 6–11 and Schedule 1).\n\nSource citations: commencement (cl 2); authority (cl 3); definitions (cl 4); operative arrangements for each visa subclass (cl 6–11); specific form and address details (Schedule 1 Columns C and D); repeal (Schedule 2)."},"kimi_summary":{"content_quality":"ok","complexity_score":3,"scope_assessment":{"changed":false,"description":"The instrument remains tightly scoped to its original administrative purpose: specifying forms, places, and manner of application for parent visas. This instrument doesn't change who can apply or how much it costs, but it **centralises all applications to a single processing centre in Perth**. Getting the form or address wrong can delay applications by months or years, given the capped queues for these visas. The instrument also **repeals and replaces an earlier 2018 instrument** (IMMI 18/014), consolidating the rules into one document.\n\n**Key practical points:**\n- Most applicants use **Form 47PA** sent to the Parent Visa Centre in Perth.\n- Those transitioning from a temporary to permanent contributory parent visa use **Form 47PT**.\n- Newborn children of temporary visa holders have a special notification process instead of a standard application form."}},"importantCases":[],"_links":{"self":"/api/acts/migration-immi-18-079-arrangements-for-parent-visa-applications-instrument-2018","history":"/api/acts/migration-immi-18-079-arrangements-for-parent-visa-applications-instrument-2018/history","analysis":"/api/acts/migration-immi-18-079-arrangements-for-parent-visa-applications-instrument-2018/analysis","conflicts":"/api/acts/migration-immi-18-079-arrangements-for-parent-visa-applications-instrument-2018/conflicts","importantCases":"/api/acts/migration-immi-18-079-arrangements-for-parent-visa-applications-instrument-2018/important-cases","documents":"/api/acts/migration-immi-18-079-arrangements-for-parent-visa-applications-instrument-2018/documents"}}
