Schedule 2 now lists 166 specific diploma courses (with CRICOS codes) that qualify for reduced English requirements, effectively regulating individual education provider contracts and course catalogues. Subsequent amendments (referenced in sections 10-12) continue to expand this list, indicating the scope has grown to encompass detailed education market regulation beyond visa policy."},"complexity_factors":["Five different English tests with four distinct score tiers each (standard, 10-week ELICOS, 20-week ELICOS, foundation/pathway)","166 specific pathway programs listed in Schedule 2 with unique CRICOS codes, institution names, and destination universities","Cross-references to Migration Regulations 1994 and Education Services for Overseas Students (Foundation Program Standards) Instrument 2021","Dual timing rules for test validity depending on whether evidence is provided at application or decision stage","Complex defined terms including 'principal course' (requiring understanding of Australian Qualifications Framework levels) and 'eligible pathway program'","Multiple overlapping exemption categories in section 6 covering citizenship, course type, sponsorship status, and prior study history"],"plain_english_summary":"This instrument sets how student visa (subclass 500) applicants must prove English: most must sit an approved test (eg. IELTS, PTE, TOEFL) taken within two years. Required scores vary by study pathway, with lower thresholds for those undertaking preparatory English or foundation/pathway programs.\n\nIt exempts certain nationals, recent Australian-qualified students, research-only or ELICOS-only enrolments, and some government-sponsored students."},"flash_summary":{"complexity_score":7,"scope_assessment":{"changed":true,"description":"This instrument replaces the prior instrument referenced in cl.9 and restates and refines the English‑language test regime for Subclass 500 visas: it prescribes an approved test list, sets tiered minimum scores (Schedule 1), and adds a detailed schedule of eligible pathway programs (Schedule 2). Transitional provisions preserve the prior instrument for pending applications and allow later amendments to apply from their commencement dates (cls.9–12), so the instrument both narrows procedural detail and expands course‑specific rules compared with the earlier instrument."},"complexity_factors":["Multiple score tiers and conditional thresholds (different minimums for standard enrolments, enrolments with ≥10 weeks ELICOS, and enrolments with ≥20 weeks ELICOS) — cl.5(2)–(4); Schedule 1.","Prescriptive list of approved tests limited to five named tests, with component‑level requirements for OET — cl.5(1)(a); Schedule 1.","Extensive enumerated list of eligible pathway programs (many CRICOS codes, course names and institutions) creating a high verification burden — Schedule 2.","Detailed exemption categories based on nationality, course type, visa status and prior English‑medium study, requiring document checks and eligibility windows — cl.6(1).","Temporal rules about when a test must have been taken depending on whether evidence is supplied with the application or later — cl.5(1)(b).","Interdependence with definitions and standards in other instruments and the Migration Regulations (cross‑referenced definitions and external instruments) — cl.4 and notes.","Transitional, repeal and staged amendment provisions affecting which version applies to particular applications — cls.7, 9‑12.","Low administrative discretion but high procedural complexity for decision‑makers in applying the matrix of tests, scores, exemptions and course lists."],"plain_english_summary":"This instrument specifies which English tests, the minimum scores required, and the classes of applicants who are exempt when applying for a Subclass 500 (Student) visa. It creates different score tiers depending on whether the student will do accompanying ELICOS, foundation or listed pathway programs, and attaches an extensive list of eligible pathway courses. It matters to student applicants (who must pay for and supply test evidence), immigration decision‑makers (who assess timing and sufficiency of evidence), and the named education providers in Schedule 2."}},"importantCases":[],"_links":{"self":"/api/acts/migration-english-language-tests-and-evidence-exemptions-for-subclass-500-student-visa-instrument-li","history":"/api/acts/migration-english-language-tests-and-evidence-exemptions-for-subclass-500-student-visa-instrument-li/history","analysis":"/api/acts/migration-english-language-tests-and-evidence-exemptions-for-subclass-500-student-visa-instrument-li/analysis","conflicts":"/api/acts/migration-english-language-tests-and-evidence-exemptions-for-subclass-500-student-visa-instrument-li/conflicts","importantCases":"/api/acts/migration-english-language-tests-and-evidence-exemptions-for-subclass-500-student-visa-instrument-li/important-cases","documents":"/api/acts/migration-english-language-tests-and-evidence-exemptions-for-subclass-500-student-visa-instrument-li/documents"}}
