This instrument creates legal permission for specific information sharing.\n- It helps agencies verify identities, investigate crimes, enforce laws, deliver services, or check eligibility for benefits.\n- For example: a state education department might need to confirm a child's visa status for school enrolment; police might need immigration data for an investigation; or the Tax Office might need to check someone's residency status.\n\n**Key point:** This is a replacement instrument—it repeals the 2015 version (IMMI 15/066) and updates the list of who can receive this sensitive information."},"flash_summary":{"complexity_score":4,"scope_assessment":{"changed":true,"description":"This instrument repeals IMMI 15/066 (Schedule 2) and sets out a new list of prescribed bodies (Schedule 1), thereby replacing the prior specification of authorised recipients under regulation 5.34D and paragraph 336F(1)(d) of the Migration Act. The source text shows a new, authoritative list of recipients but does not include the 2015 instrument text here, so specific additions or removals relative to the prior list cannot be identified from this document alone."},"complexity_factors":["Long prescribed list of recipients (107 bodies) increases administrative scope and recordkeeping (Schedule 1).","Includes domestic, state/territory and multiple foreign law‑enforcement and immigration agencies, creating cross‑jurisdictional disclosure relationships and differing legal regimes (Schedule 1, items such as 17, 29–31, 33, 45, 65, 78, 87–90).","Instrument operates by reference to other legal provisions (regulation 5.34D of the Migration Regulations 1994 and paragraph 336F(1)(d) of the Migration Act 1958), so practical effect depends on those provisions and any defined terms they use (see section 3 and section 6).","Repeal of the 2015 instrument and substitution by this list creates transition and implementation tasks for agencies to update disclosure arrangements and IT/records processes (Schedule 2).","The instrument does not itself define the scope of ‘information’ to be disclosed; that requires reading the Act/regulations, increasing interpretive complexity (sections 4 and 6 referencing the Act and Regulations).","Varied recipient functions (police, revenue, registries, health, education, courts) mean different downstream uses of disclosed data, raising coordination and compliance complexity (Schedule 1)."],"plain_english_summary":"This instrument names specific Australian, state/territory and foreign government bodies that the Department may disclose migration-related information to under regulation 5.34D and paragraph 336F(1)(d) of the Migration Act 1958 (see section 6 and Schedule 1). It repeals the 2015 disclosure instrument (Schedule 2). It affects the listed agencies (which gain authorised access) and people whose migration records may be shared, because it fixes who can lawfully receive migration information and therefore shapes disclosure pathways."}},"importantCases":[],"_links":{"self":"/api/acts/migration-disclosure-of-information-to-prescribed-bodies-instrument-2025","history":"/api/acts/migration-disclosure-of-information-to-prescribed-bodies-instrument-2025/history","analysis":"/api/acts/migration-disclosure-of-information-to-prescribed-bodies-instrument-2025/analysis","conflicts":"/api/acts/migration-disclosure-of-information-to-prescribed-bodies-instrument-2025/conflicts","importantCases":"/api/acts/migration-disclosure-of-information-to-prescribed-bodies-instrument-2025/important-cases","documents":"/api/acts/migration-disclosure-of-information-to-prescribed-bodies-instrument-2025/documents"}}
