This Declaration may be cited as Membership Exclusion Declaration No. 2.\n\nInterpretation\n\n2. In this Declaration, unless the contrary intention appears, “the Act” means the Superannuation Act 1990.\n\nExclusion\n\n3. Section 6 of the Act does not apply to a person who is an officer or employee of, or the holder of a statutory office in, the Australian National Railways Commission other than a person who, immediately before the commencement of this Declaration:\n\n(a) was a member of the superannuation scheme constituted under the Act; and\n\n(b) was an officer or employee of, or the holder of a statutory office in, the Australian National Railways Commission.\n\n![](image.004.png)NOTE\n\n![](image.005.png)1.
