pound\nmanagers of a pound.\n37 Notice of impounding\n(1) Where a registered dog with an identification device is delivered to\na pound, a pound manager shall notify the Registrar who shall\nserve on the registered owner a notice, in the approved form, of the\nimpounding of the dog.\n(2) Where a dog with a collar on which the address of its owner is\ndisplayed is delivered to a pound, a pound manager shall notify the\nRegistrar who may serve at that address a notice, in the approved\nform, of the impounding of the dog.\n(3) Except in accordance with clause (1) or (2), the Registrar is not\nobliged to notify the owner of a dog of the impounding of the dog.\n38 Release of dogs from pounds\n(1) A dog in a pound shall not be released from the pound:\n(a) subject to clause (2), unless it is registered;\n\nPart 4 Control of dogs\nDivision 3 Pounds\nMataranka Community Government Council (Control of Dogs) By-laws 1992 16\n(b) other than to the owner of the dog or to a person authorised to\nact as the owner's agent; and\n(c) unless there is paid to the Council the maintenance and\nrelease fees as determined by the Council.\n(2) Clause (1)(a) does not apply to a dog that has not been usually\nkept within Mataranka for 3 consecutive months immediately\npreceding the date of its release from the pound.\n(3) The burden of proof as to whether a person is the owner of the dog\nor a person authorised to act as the owner's agent lies on the\nperson.\n(4) The burden of proof in relation to a matter referred to in clause (2)\nlies on the owner of the dog or the owner's agent.\n39 Destruction of impounded dogs\nSubject to these By-laws, a pound manager may arrange for the\ndestruction of a dog delivered to a pound at the expiration of the\nnumber of days or hours as are determined, from time to time, by\nthe Council.\n40 Diseased dogs\n(1) Where a pound manager who takes custody of a dog that has been\nseized under these By-laws:\n(a) receives advice from a veterinarian that the dog is, or is\nsuspected of being, diseased; or\n(b) notices or suspects that the dog is diseased,\nthe pound manager shall:\n(c) isolate the dog from other dogs in the pound; and\n(d) notify the Council of the dog's condition.\n(2) The Council shall serve on the owner, if known, of a dog isolated\nunder clause (1) written notice that the dog is or is suspected of\nbeing diseased and that the Council:\n(a) requires the dog to be destroyed; or\n(b) requires the dog to undergo a course of treat-ment specified in\nthe notice.\n\nPart 5 Miscellaneous\nMataranka Community Government Council (Control of Dogs) By-laws 1992 17\n(3) In addition to clause (2), the Council may, in the notice served\nunder that clause, require the owner of the dog to produce to the\nCouncil, or\n(b) all other dogs usually kept at the premises at which the\ndiseased dog was kept.\n(4) A dog the subject of a notice under this by-law may be released\nfrom the pound in accordance with by–law 38 subject to such\nconditions as the Council thinks fit.\n(5) The owner of a dog who contravenes or fails to comply with a\nrequirement of a notice served on him or her under clause (2), or a\ncondition subject to which the dog is released under clause (4), is\nguilty of an offence.\n(6) Notwithstanding anything to the contrary in these By-laws, a pound\nmanager may destroy a dog in a pound if the dog is so diseased or\ninjured that it is humane to destroy it.\n(7) The cost of treatment reasonably provided by a pound manager to\na diseased animal, and to any other animal in the pound that was\ninfected or was at risk of being infected by the diseased animal\nbefore the manager could reasonably isolate it, is a debt due and\npayable by the owner of the diseased animal to the Council.\n41 Method of destruction of impounded dogs\nA dog in a pound shall not be destroyed other than:\n(a) by a veterinarian or a person who is, in the opinion of a pound\nmanager, qualified to destroy the dog; and\n(b) in a manner that is approved by the Australian Veterinary\nAssociation.\nPart 5 Miscellaneous\n42 Change of ownership of dog\n(1) A person who acquires ownership of a address under clause (2), shall amend the\nregister accordingly.\n43 Dog races, &c.\n(1) The Council may, by notice in writing, exempt a person or body\nfrom by-law 24 or 25, or both, for the purposes of a dog race, dog\ntrial, dog show or while taking part in the activities of a dog\nobedience club or while using a dog to drive cattle or stock on a\nroad or for such other purpose or event as the Council may, from\ntime to time, determine.\n(2) An exemption under clause (1) may relate to a particular event or to\na class of events and may be subject to such conditions, if any, as\nthe Council thinks fit.\n44 Penalties\nA person who contravenes or fails to comply with these By-laws is\nguilty of an offence and is liable on conviction to a penalty not\nexceeding $2,000 and, in addition, to a penalty not exceeding $100\nfor each day during which the offence continues.\n45 Fixed penalties\n(1) Notwithstanding by-law 44, a person who is alleged to have\ncontravened or failed to comply with these By-laws, and on whom a\nnotice of infringement is served, may pay to the Council, as an\nalternative to prosecution, the sum specified by this by-law in lieu of\nthe penalty which may otherwise be imposed under by-law 44.\n(2) For the purposes of this by-law:\n(a) the sum specified by this by-law is $50 or, in respect of a\nby-law specified in column 1 of Schedule 1, the sum specified\nopposite the by-law in column 2 of the Schedule;\n(b) a notice of infringement shall be in the form specified in\nSchedule 2;\n\nPart 5 Miscellaneous\nMataranka Community Government Council from time to time performing or\ncarrying out the duties of the cashier of the Council; and\n(e) in order to avoid prosecution, the sum specified by this by-law\nshall be paid not later than 14 days after the date of the\nservice of the notice of infringement on the person.\n46 Matters of evidence\n(1) An extract from, or copy of, an entry in the register purported to be\nsigned by the Registrar shall, in all courts and on all occasions, be\nprima facie evidence of the signature of the Registrar and of the\nparticulars contained in the entry without requiring the production of\nthe register.\n(2) A statement signed by the Registrar:\n(a) that a person does not appear in the register as the owner of a\ndog or that a person appears in the register as the owner of no\nmore than a specified number of dogs; or\n(b) that no licence has been issued in respect of premises,\nshall, in all courts and on all occasions, be prima facie evidence of\nthe signature of the Registrar and of (See purpose: by‑law 2; application: by‑law 4.)\n- The Council creates and keeps a dog register and appoints a Registrar and pound managers to operate the system. (by‑laws 6–8, 7.)\n- Owners must register their dogs and pay any Council fees; the Council issues identification devices (dog‑tags) unless the dog has an implanted microchip. (by‑laws 9–12, 11.)\n- Occupiers of premises that keep more than a Council‑determined number or type of dogs must hold a licence for the premises. (by‑laws 13–15, 22.)\n- The Council may declare dog exercise areas (where dogs are allowed under conditions) and dog restriction areas (where keeping certain dogs is prohibited). It must publicise proposed areas at least 21 days before declaring them. (by‑law 19.)\n- The by‑laws create a range of offences (e.g. unregistered dogs, dogs at large, nuisance, attacks, removal of ID device) with penalties, fixed‑penalty infringement notices, and procedures for seizure, impounding, treatment and humane destruction. (by‑laws 20–33, 34–41, 44–45, Schedules 1–2.)\n- There is an administrative appeal route to the Tribunal against Council decisions under the by‑laws (other than prosecution decisions). (by‑law 47.)\n\n**Who this affects**\n\n- Dog owners and occupiers of premises in the Mataranka community area (registration, licensing, fencing and control duties). (by‑laws 3(2), 9, 13, 22.)\n- People who find, seize or impound dogs: Registrar, Council officers, pound managers and authorised persons. (by‑laws 6–8, 34–36.)\n- Neighbours and members of the public affected by dogs (nuisance, attacks, restriction areas). (by‑laws 19, 27, 29.)\n- Veterinarians (sterilisation certificates, disease reporting and approved methods of destruction). (by‑laws 32, 40, 41.)\n\n**Why it matters (practical effects)**\n\n- It moves the costs of dog‑management onto dog owners through registration fees, licence fees, impoundment and release fees, and penalties for non‑compliance. (by‑laws 9(2), 13(2), 38(1)(c), 44–45.)\n- It vests substantial operational discretion in the local Council (resolutions to declare areas, to approve forms/devices/marks, to refuse registrations/licences and to set fees) and in named officials (Registrar, pound managers). That discretion determines who may keep dogs and under what conditions. (by‑laws 7, 8, 10, 14, 19, 32, 36.)\n- It creates enforcement levers: seizure, impoundment, destruction of dogs (with procedural safeguards like notice periods and veterinary involvement). (by‑laws 34–41.)\n\n**How the rules work in practice (key mechanics and timelines)**\n\n- Registration: owners apply in an approved form with fee; Council must decide within 21 days to register, conditionally register or refuse (and must give reasons if refusing or imposing conditions). Registration runs until 30 June next following registration/renewal. (by‑laws 9, 10, 12.)\n- Licences for premises: occupiers apply with fee; Council must decide within 21 days and may refuse or impose conditions based on facilities, number of dogs and local impact. Licences last up to 12 months. (by‑laws 13–15.)\n- Refusal/cancellation: Council may refuse registration/licence where the owner has recent convictions or multiple impoundments, where the dog is dangerous or premises are not suitably fenced, or where keeping would breach other by‑laws; Council must give written reasons and has show‑cause procedures with 7‑day effect periods. (by‑laws 10(2)–(5), 16–18.)\n- Offences and enforcement: penalties on conviction up to $2,000 plus up to $100 per day continuing; lower fixed penalty options for certain breaches (e.g. $50 standard, specified higher amounts in Schedule 1). Infringement notices are available as an alternative to prosecution and must be paid within 14 days to avoid court action. (by‑laws 44–45, Schedule 1–2.)\n- Seizure and pounds: authorised persons may seize at‑large, diseased, injured, dangerous or stray dogs; seized dogs go to a pound and can be released only to registered owners on payment of fees (subject to limited defences and time limits); pound managers may arrange destruction after Council‑determined holding periods, and emergency humane destruction is permitted by veterinarians or qualified persons under approved methods. (by‑laws 34–41.)\n- Records and evidence: the register and certain Council minutes are prima facie evidence in court; change of ownership and address must be notified within 14 days. (by‑laws 7, 42, 46.)\n\n**Implementation, incentives and trade‑offs**\n\n- Who pays: dog owners bear most direct costs (registration, licence, impoundment/release fees, veterinary costs where a dog is diseased, fines). (by‑laws 9(2), 13(2), 38(1)(c), 40(7), 44–45.)\n- Who decides: the Council has broad discretionary power to set fees, declare exercise/restriction areas, approve devices/marks/certificates and to refuse or impose conditions on registrations and licences (by resolution). Operational decisions are taken by the Registrar, pound managers and authorised persons within the framework set by Council. (by‑laws 7, 8, 10, 14, 19, 32, 36.)\n- Behaviour changes incentivised: owners are incentivised to register dogs, keep them under effective control (leash, vehicle, or in exercise areas), sterilise where required or marked, fence premises as required, and avoid conduct that leads to penalties or refusal of registration/licence. (by‑laws 3(4), 11, 22, 29–32.)\n- Compliance burden and administrative cost: owners must track renewal dates (registrations end 30 June next), notify transfers and address changes within 14 days, and comply with fencing, number limits, conditions of licence/registration and control obligations; Council must maintain a register, publish notices for area changes and operate a pound and infringement process. (by‑laws 7, 12, 19(3), 42, 36, 45.)\n- Discretion and enforcement risk: the Council’s decisions (e.g. refusing registrations on grounds of nuisance/danger or imposing local fencing standards) concentrate decision‑making at the local political/administrative level. That can make outcomes sensitive to local policy choices and resourcing (e.g. availability of pound facilities, staff to enforce and to process appeals). (by‑laws 10, 14, 19, 36.)\n- Opportunity costs and trade‑offs: resources spent administering registration, impounding and enforcement are diverted from other Council services; owners facing repeated fines or licence refusals may opt to remove dogs, relocate or keep dogs off‑premises, which changes private choices but is permitted by the rules. (by‑laws 10(2), 34–39.)\n\n**Concrete implementation risks and compliance traps to note**\n\n- High discretion in local decisions may generate inconsistent outcomes between similar cases (by‑laws 10, 14, 19). \n- Timelines matter: failure to renew registration before expiry or to notify ownership/address changes within 14 days can create liability or administrative hurdles (by‑laws 9(3), 42). \n- Owners of seized dogs must usually show the dog is registered to obtain release and pay fees; proof burdens rest on claimants in several places (by‑laws 37–38). \n\n**Appeals and review**\n\n- Administrative decisions of the Council under these by‑laws (except decisions commencing prosecution) can be appealed to the Tribunal in an approved form. You apply, pay a fee, and get a dog-tag or microchip. Registration lasts until the end of June each year. The Council can refuse registration if your dog is dangerous, if you've had too many offences, or if your yard isn't properly fenced.\n\n* **Licences:** If you want to keep more dogs than the Council allows (the exact number is set by the Council), you need a special licence for your premises. Dogs can be destroyed if not claimed within a set time, or immediately if diseased/injured. Owners must pay fees to get their dogs back.\n\n* **Fines:** Breaking these rules can result in fines up to $2,000, or you can pay a fixed penalty (like $50) to avoid court.\n\n**Who it affects:**\n\nAnyone who owns, keeps, or controls a dog in Mataranka.
