Originally framed as amendments to governance and facility-use rules, it now also: (1) imposes price caps and location-based resale bans on secondary ticket markets (s31, s31A); (2) adds criminal-history safeguards and tighter ministerial control over board appointments (ss12, 17, 17AA); and (3) creates legal certainty for event noise compliance by deeming compliance with the Environmental Protection Act where prescribed conditions are met (s30A). Penalties set for individuals (135 penalty units) and corporations (680 penalty units). \n  - Bans resale or offering a ticket for sale inside a controlled area or major event area unless the seller has the major event organiser’s written approval (new s31A).\n- Makes who counts as an \"authorised person\" explicit: police officers and any person appointed under s56 (new s55A), and updates the dictionary accordingly.\n- Revises governance and appointments for the Major Sports Facilities Authority (Major Sports Facilities Act 2001):\n  - Directors are appointed by Governor in Council on the Minister’s recommendation, and the Minister may recommend only people with listed qualifications or relevant experience (new/relocated s12).\n  - Establishes a mandatory chairperson appointment by Governor in Council and optional deputy (new s17), sets terms, and provides resignation and vacancy rules (ss17, 17AB, 17AC).\n  - Adds criminal-history disqualification: a person with a conviction for an indictable offence that is not spent, an insolvent under administration, or disqualified under the Corporations Act, cannot be a director (s17AA).\n  - Reworks meeting rules and minor drafting/renumbering to reflect the new structure (ss21, renumbering throughout Part 3).\n- Changes the way special-event noise compliance is treated: if prescribed noise conditions are met, the use of the facility for the special event is taken to comply with the general environmental duty under the Environmental Protection Act (new s30A(2A)–(2B)). The Liquor Act and local laws remain enforceable to the extent they apply to noise (amendment to s30A).\n- Adds a drone definition and makes drones part of the \"aircraft\" definition for the relevant part of the Major Sports Facilities Act (s30D).\n- Adds transitional provisions to preserve existing chairpersons and apply the new director disqualification/vacancy rules to directors holding office after commencement (Division 9).\n- Updates the State Penalties Enforcement Regulation 2014 to align infringement notice entries with the amended offences and removes an earlier entry (Part 4).\n\n\nWho this affects\n\n- Event organisers and major sports facility operators: new rules to prescribe which special major-event provisions apply and to grant written approvals for resale within controlled areas; potential shielding from some noise duties if conditions are met (s12, s31A, s30A(2B)).\n- Ticket sellers, marketplaces and consumers: resale price cap (10%) and a ban on selling inside controlled/major event areas unless authorised (s31, s31A). Platforms will need to police price and location and may face heavy fines for breaches.\n- People selling tickets on-site (street vendors, scalpers) and secondary-market operators: these activities are specifically targeted by the ban in controlled/major event areas (s31A) and the price cap (s31).\n- Major Sports Facilities Authority board members and Minister/Governor in Council: changes to appointment process, statutory qualifications, disqualification rules, and meeting/technical rules (ss12, 17, 17AA–17AC, 21).\n- Police and other authorised persons (broader explicit list in s55A) who enforce event rules.\n- Drone operators: explicit inclusion of drones in aircraft definition affects use/restrictions during events (s30D).\n\n\nWhy it matters (stated purpose, then practical tests)\n\n- Stated purpose (as reflected in the text): the bill tightens event area controls, prevents abusive ticket resales, clarifies enforcement powers, updates governance arrangements for the Major Sports Facilities Authority, and clarifies how noise/compliance works for special events (see ss12, 31, 31A, 17, 30A).\n\n- Practical implications, trade-offs and risks:\n  - Enforcement and compliance costs: policing a 10% cap and geographic ban on resale requires monitoring of prices and the location of sellers and buyers. Marketplaces (international or domestic) will need compliance systems to check listings against original sale prices and geofencing for controlled areas (s31, s31A). That creates administrative costs for platforms and the regulator.\n  - Behavioural substitution: where resale is banned in a controlled area, sellers may move transactions off-site, use private transfer services, list tickets as \"gifts\" plus paid add-ons, or rely on digital transfers routed outside the defined area. Those circumvention routes are not addressed directly in the bill and create enforcement challenges.\n  - Concentrated beneficiaries and diffuse costs: the rules concentrate benefits on event organisers and official ticketing channels (limiting secondary-markets), while costs fall on individual sellers and secondary platforms, and on agencies that must enforce the rules. Penalties are significant (135 / 680 penalty units) and thus concentrated downside risk for offenders (s31, s31A).\n  - Ministerial discretion and capture risk: directors must be recommended by the Minister and must meet listed qualifications or \"other knowledge or experience the Minister considers relevant\" (relocated s12(3)). That clause gives the Minister scope to favour particular candidates; the Governor in Council must appoint the chairperson on the Minister’s recommendation (s17). The bill reduces some internal board appointment autonomy compared with unspecified past practice and centralises appointment power.\n  - Limits on board candidates: the disqualification rule (s17AA) bars anyone with an unspent conviction for an indictable offence, those insolvent under administration, or disqualified under the Corporations Act. This can narrow the candidate pool and increases legal vetting needs for appointees.\n  - Noise law interaction and liability shifting: if prescribed noise conditions are met, event use is \"taken to be\" in compliance with the Environmental Protection Act general environmental duty to the extent it applies to noise (s30A(2A)–(2B)). That provides a compliance pathway and partial legal certainty for organisers but may shift enforcement attention to whether the prescribed conditions were correctly set and complied with. Local laws and liquor licensing remain applicable (s30A(4)).\n  - Drone clarity: defining \"drone\" and inserting it into the aircraft definition makes it clearer that drone rules in Part 4B apply to remotely piloted or autonomous aerial devices (s30D). That simplifies enforcement but also clearly subjects drone operators to the Act’s event restrictions.\n  - Implementation risk from renumbering and relocation: the bill renumbers and relocates many provisions in the Major Sports Facilities Act (multiple clauses). Transitional provisions preserve current chairs and apply new rules to existing directors (Division 9), but practical confusion during transition is possible for administrators and counsel until all references are updated.\n\nWho pays, who decides, and what behaviour changes\n\n- Who pays: secondary sellers and ticketing platforms pay compliance and potential penalty costs; police/public authorities incur enforcement costs; organisers may face modest admin costs to provide written approvals and meet prescribed noise conditions.\n- Who decides: the Minister recommends directors and prescribes which Part 5 provisions apply and for how long (subject to the major event period cap) (s12, s17); major event organisers decide whether to give written approval for resale in controlled/major event areas (s31A); authorised persons and police exercise enforcement powers (s55A).\n- Behaviour changes expected: fewer on-site and in-area resales, more reliance on official resale channels (if organisers allow), increased compliance screening by online marketplaces, potential relocation of secondary-market activity off-site or into private transfer arrangements.\n\n\nPractical notes for stakeholders\n\n- Event organisers should prepare templates and processes for written approvals for any authorised secondary resale within controlled areas, and document compliance with any prescribed noise conditions if they want the environmental-duty protection (s31A, s30A).\n- Ticket platforms should adopt price-checking and geofencing to enforce the 10% cap and the in-area resale ban; they should also plan for significant potential fines for breaches (s31, s31A).\n- Prospective board candidates and the Minister’s office should account for the criminal history and insolvency checks and for the Minister’s broader discretion when preparing nominations (s17AA, s12).\n\n\nKey provisions cited: ss12, 15–17, 21, 22, 30A, 30C–30D, 31, 31A, 55A, Division 9 (transitional), State Penalties amendments.\n"}},"importantCases":[],"_links":{"self":"/api/acts/major-sports-facilities-and-other-legislation-amendment-bill-2025","history":"/api/acts/major-sports-facilities-and-other-legislation-amendment-bill-2025/history","analysis":"/api/acts/major-sports-facilities-and-other-legislation-amendment-bill-2025/analysis","conflicts":"/api/acts/major-sports-facilities-and-other-legislation-amendment-bill-2025/conflicts","importantCases":"/api/acts/major-sports-facilities-and-other-legislation-amendment-bill-2025/important-cases","documents":"/api/acts/major-sports-facilities-and-other-legislation-amendment-bill-2025/documents"}}
