The infringement notice\nsystem is intended to provide an alternative to prosecution.\nNote 2 If an infringement notice is to be given to the Territory for an offence\nagainst the work health and safety legislation, the infringement notice\nmay be given to the territory agency whose acts or omissions are alleged\nto contravene the work health and safety legislation and the territory\nagency may be specified in the infringement notice (see the Act, s 248).\nNote 3 An infringement notice served on a public authority for an offence against\nthe work health and safety legislation is taken to be an infringement\nnotice served on its successor if the successor is a public authority.\nSimilarly, any penalty paid by a public authority in relation to an\ninfringement notice is taken to be a penalty paid by its successor if the\nsuccessor is a public authority (see the Act, s 253).\n6 Administering authority\nThe administering authority for an infringement notice offence\nagainst the work health and safety legislation is the regulator under\nthe Work Health and Safety Act 2011.\n7 Infringement notice offences\nThe Magistrates Court Act 1930, part 3.8 applies to an offence against\na provision of the work health and safety legislation mentioned in\nschedule 1, column 2.\n8 Infringement notice penalties\n(1) The penalty payable for an offence against the work health and safety\nlegislation, under an infringement notice for the offence, is the\namount mentioned in schedule 1, column 4 for the offence.\n\nSection 9\npage 4 Magistrates Court (Work Health and Safety Infringement\nNotices) Regulation 2011\nEffective: 01/07/23\nR8\n01/07/23\nAuthorised by the ACT Parliamentary Counsel—also accessible at www.legislation.act.gov.au\n(2) The cost of serving a reminder notice for an infringement notice\noffence against the work health and safety legislation is $34.\n9 Contents of infringement notices—identifying authorised\nperson\nAn infringement notice served on a person by an authorised person\nfor an infringement notice offence against the work health and safety\nlegislation must identify the authorised person by—\n(a) the authorised person’s full name, or surname and initials; or\n(b) any unique number given, for this regulation, to the authorised\nperson by the administering authority.\n10 Contents of infringement notices—other information\n(1) An infringement notice served on a company by an authorised person\nfor an infringement notice offence against the work health and safety\nlegislation must include the company’s ACN.\nNote The requirement under this section is additional to the requirement under\nthe Magistrates Court Act 1930, s 121 (1) (c).\n(2) In this section:\ncompany means a company registered under the Corporations Act.\n11 Contents of reminder notice—identifying authorised\nperson\nA reminder notice served on a person by an authorised person for an\ninfringement notice offence against the work health and safety\nlegislation must identify the authorised person by—\n(a) the authorised person’s full name, or surname and initials; or\n(b) any unique number given, for this regulation, to the
