It formalises Council power to make determinations about specific uses (cl.2.1–2.2), converts certain existing signs into determinations (cl.2.9), tightens permit regimes and fees (Part 3; cl.3.2) and restates enforcement and penalty arrangements (Part 11; Schedule 1). It also removes automatic effect of prior policies unless Council resolves otherwise (cl.1.6(2)–(3)), so practical scope and administrative burden on users and applicants have been altered."},"complexity_factors":["Extensive defined terms and cross‑references to the Local Government Act 1995 and Regulations (cl.1.3; general structure)","Two‑stage control: Council makes non‑delegable determinations (cl.2.2(8)) and issues permits with many discretionary conditions (Part 3)","Wide scope of regulated activities and property types (cl.1.5; cl.2.7–2.8; Parts 5–8) increasing application permutations","Multiple administrative routes: public notice, submissions, register of determinations (cl.2.2; cl.2.5) and transitional treatment of existing signs (cl.2.9)","Numerous discretionary enforcement powers vested in authorised persons and the CEO (cl.3.11; cl.10.1–10.2; Part 11)","Fee and cost recovery provisions linking to the Act (cl.3.2; cl.7.2; cl.8.11; sections 6.16–6.19 referenced)","Detailed infringement schedule and maximum penalties with continuing offence provisions (cl.11.3; cl.11.4; Schedule 1)","Interaction with other written laws (e.g. Liquor Control Act, Misuse of Drugs Act, Caravan Parks Act) creating conditional exceptions (cl.1.5; cl.3.15)"],"plain_english_summary":"This local law sets out who may use, control and manage Shire of Dardanup property. It lets Council make formal “determinations” about permitted or prohibited activities, requires permits for many uses, authorises fees and prescribes enforcement (infringements and court penalties). It applies to land, jetties, pools, saleyards and the aerodrome and affects anyone who hires, trades on, or otherwise uses that property. Council and authorised officers decide, users pay permit fees or face fines, and authorised officers enforce compliance."},"kimi_summary":{"content_quality":"ok","complexity_score":6,"scope_assessment":{"changed":false,"description":"This appears to be a consolidated remake of the 2007 Local Government Property Local Law. The scope remains consistent with typical local government property management legislation — regulating use of council land through permits, determinations, and behavioural rules. While it covers diverse specific facilities (jetties, saleyards, aerodromes, golf courses), these appear to reflect the actual assets owned by the Shire of Dardanup rather than scope creep. The structure follows the standard Western Australian local law template."},"complexity_factors":["Length: 11 Parts, 8 Divisions, and a Schedule, spanning approximately 21 pages in the Gazette","Cross-references: Heavy reliance on external statutes including the Local Government Act 1995 (WA), Local Government (Functions and General) Regulations 1996, Liquor Control Act 1988, Firearms Act 1973, Dog Act 1976, Caravan Parks and Camping Grounds Act 1995, Civil Aviation Act 1988 (Cth), Disability Discrimination Act 1992 (Cth), and Auction Sales Act 1973","Defined terms: 25+ defined terms in clause 1.3, with additional definitions scattered throughout Parts (e.g., 'function', 'premises', 'fauna', 'flora', 'stock', 'controller')","Nested conditional logic: Multiple exceptions and qualifications, such as clause 3.13(1) which lists 17 prohibited activities each with their own sub-exceptions (e.g., 3.13(1)(f)(i)-(ii), 3.13(1)(g) exceptions for employees)","Dual regimes: Separate processes for 'determinations' (Part 2) and 'permits' (Part 3), with different procedural requirements and appeal mechanisms","Transitional provisions: Clause 2.9 creates deemed determinations from pre-existing signs, creating potential conflicts with new determinations","Variable penalties: Three-tier penalty structure with general penalties ($5,000 + $500/day), modified penalties for prescribed offences ($125-$350), and specific evidentiary presumptions in clause 11.6"],"plain_english_summary":"This local law sets how the Shire of Dardanup manages and regulates use of council-owned land and facilities (parks, jetties, pools, saleyards, aerodrome, etc.), requiring permits for many activities, allowing the council to make site-specific rules after consultation, and prohibiting conduct that damages property or endangers others. It empowers authorised officers to enforce rules, issue fines and removal orders. It affects residents, visitors, event organisers, boat owners, farmers and businesses by balancing public access, safety and property protection."}},"importantCases":[],"_links":{"self":"/api/acts/local-government-property-local-law-2021","history":"/api/acts/local-government-property-local-law-2021/history","analysis":"/api/acts/local-government-property-local-law-2021/analysis","conflicts":"/api/acts/local-government-property-local-law-2021/conflicts","importantCases":"/api/acts/local-government-property-local-law-2021/important-cases","documents":"/api/acts/local-government-property-local-law-2021/documents"}}
