Section 25(a)(ii) requires third party expenditure disclosures to be made 'not less than 24 hours before polling day'. These provisions apply to different entities and different disclosure types, but they reflect internally inconsistent policy logic: the regime simultaneously contemplates that disclosures can validly occur within the final 24 hours before polling (sec.18) and that disclosures must occur no later than 24 hours before polling (sec.25), creating different transparency standards for candidates versus third parties with no apparent policy justification."}]},"flash_summary":{"complexity_score":6,"scope_assessment":{"changed":true,"description":"The regulation expressly repeals the 2012 instrument (sec 28) and replaces it with updated operational prescriptions: it fixes 2024 election timing and capped‑expenditure start (secs 3–5), prescribes nomination contents and elector classes for electronic voting (secs 6–7), approves electronic procedures (secs 8, 27), sets auditor qualifications (sec 9), and adds detailed record‑keeping and disclosure rules (secs 12–26). It covers four main areas:\n\n**1. When the 2024 election happens**\n- The election is set for **16 March 2024**\n- The spending cap period (when candidates and parties must limit their campaign spending) starts on **14 August 2023**\n- The cut-off date for working out how many voters are enrolled is **1 July 2023**\n\n**2. Who can vote electronically and how to run for office**\n- **Who can use electronic voting**: Special postal voters, people who live more than 20km from a polling booth (\"distance voters\"), and people who are out of Queensland during the voting period\n- **What candidates must disclose when nominating**: Their name, address, occupation, and whether a political party endorses them\n- **Who can audit campaign finances**: Registered auditors or members of recognised accounting bodies (CPA, IPA, or Chartered Accountants)\n\n**3. Record-keeping and financial disclosure**\n- **What records campaigns must keep**: Detailed records of all gifts (donations), loans, and electoral spending (campaign expenses), including who gave money, how much, and what it was spent on\n- **When disclosures are due**: Generally within 7 business days, but if received within a week of polling day, within 24 hours\n- **Third parties** (groups or individuals campaigning for or against candidates) must also register and disclose their spending\n\n**4. Replacing old rules**\n- This regulation replaces the 2012 version\n- If something happened before this regulation started but needs to be recorded, you won't be penalised if you can't get the information—as long as you explain why\n\n**Why it matters**: This regulation ensures transparency in local council elections. Voters can see who is funding candidates and how much is being spent. It also sets practical rules for running the election, like dates and who can use electronic voting."}},"importantCases":[],"_links":{"self":"/api/acts/local-government-electoral-regulation-2023","history":"/api/acts/local-government-electoral-regulation-2023/history","analysis":"/api/acts/local-government-electoral-regulation-2023/analysis","conflicts":"/api/acts/local-government-electoral-regulation-2023/conflicts","importantCases":"/api/acts/local-government-electoral-regulation-2023/important-cases","documents":"/api/acts/local-government-electoral-regulation-2023/documents"}}
