current Versions of legislation and up-to-date legislative information.\n\nThe Livestock Disease Control Regulations 2017, S.R. No. 57/2017 were made on 27 June 2017 by the Governor in Council under section 139 of the **Livestock Disease Control Act 1994**, No. 115/1994 and came into operation on 1 July 2017: regulation 3.\n\nThe Livestock Disease Control Regulations 2017 will sunset 10 years after the day of making on 27 June 2027 (see section 5 of the **Subordinate Legislation Act 1994**).\n\nINTERPRETATION OF LEGISLATION ACT 1984 (ILA)\n\nStyle changes\n\nSection 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.\n\nReferences to ILA s. 39B\n\nSidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided regulation, rule or clause of a Schedule is amended by the insertion of one or more subregulations, subrules or subclauses the original regulation, rule or clause becomes subregulation, subrule or subclause (1) and is amended by the insertion of the expression \"(1)\" at the beginning of the original regulation, rule or clause.\n\nInterpretation\n\nAs from 1 January 2001, amendments to section 36 of the ILA have the following effects:\n\n• Headings\n\nAll headings included in a Statutory Rule which is made on or after \n1 January 2001 form part of that Statutory Rule. Any heading inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule. \nThis includes headings to Parts, Divisions or Subdivisions in a Schedule; Orders; Parts into which an Order is divided; clauses; regulations; rules; items; tables; columns; examples; diagrams; notes or forms. \nSee section 36(1A)(2A)(2B).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in a Statutory Rule which is made on or after 1 January 2001 form part of that Statutory Rule. Any examples, diagrams or notes inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, form part of that Statutory Rule. See section 36(3A).\n\n• Punctuation\n\nAll punctuation included in a Statutory Rule which is made on or after \n1 January 2001 forms part of that Statutory Rule. Any punctuation inserted in a Statutory Rule which was made before 1 January 2001, by a Statutory Rule made on or after 1 January 2001, forms part of that Statutory Rule. \nSee section 36(3B).\n\n• Provision numbers\n\nAll provision numbers included in a Statutory Rule form part of that Statutory Rule, whether inserted in the Statutory Rule before, on or after \n1 January 2001. Provision numbers include regulation numbers, rule numbers, subregulation numbers, subrule numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of a Statutory Rule is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of a Statutory Rule. See section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThis publication incorporates amendments made to the Livestock Disease Control Regulations 2017 by statutory rules, subordinate instruments and Acts.\n\n–––––––––––––––––––––––––––––––––––––––––––––––––––––––––––––\n\nLivestock Disease Control Amendment Regulations 2018, S.R. The amount of the penalty is to be calculated, in accordance with section 7 of the **Monetary Units Act 2004**, by multiplying the number of penalty units applicable by the value of a penalty unit.\n\nThe value of a penalty unit for the financial year commencing 1 July 2024 is $197.59. The amount of the calculated penalty may be rounded to the nearest dollar.\n\nThe value of a penalty unit for future financial years is to be fixed by the Treasurer under section 5 of the **Monetary Units Act 2004**. The value of a penalty unit for a financial year must be published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year.\n\n——\n\nThe following table of applied, adopted or incorporated matter was included in S.R. The regulations list specific diseases in three categories (A, B and C) with different reporting timeframes.\n\n- **Animal identification**: Most livestock must carry electronic or visual tags so they can be traced. Cattle need NLIS (National Livestock Identification System) devices — either electronic ear tags or rumen boluses. Pigs under 25kg need ear tags; heavier pigs need tags or shoulder tattoos. Sheep and goats need electronic tags. There are special rules for temporary tags in emergencies or unsafe situations.\n\n- **Movement tracking**: Anyone selling, buying or moving livestock must record and report details including property codes, animal numbers and where animals came from. Saleyards, abattoirs, agents and farmers all have specific reporting duties to the Secretary.\n\n- **Bringing animals into Victoria**: Strict rules apply for cattle and pigs from Queensland, WA and NT — they need health certificates and inspections. Bees and bee products face quarantine-style restrictions, including mandatory irradiation for pollen.\n\n- **Beekeeping**: Commercial beekeepers must examine hives twice yearly, test for diseases, keep detailed records, and follow strict rules about American foulbrood disease — including bans on antibiotics and requirements to notify inspectors before destroying infected equipment.\n\n- **Vaccination and disease prevention**: Commercial poultry flocks must vaccinate against Newcastle disease. There are restrictions on anthrax and exotic disease vaccines. Dairy by-products must be heat-treated before being fed to animals.\n\n- **Compensation**: Farmers can claim compensation if animals are destroyed due to disease, with specific application procedures and time limits.\n\n**Who it affects:** Farmers, livestock agents, saleyard operators, abattoir workers, beekeepers, vets, transport operators and anyone involved in the livestock supply chain.\n\n**Why it matters:** These rules protect Victoria's livestock industries from disease outbreaks, maintain market access (especially export markets that require traceability), safeguard food safety, and ensure quick response when diseases emerge."},"flash_summary":{"complexity_score":9,"scope_assessment":{"changed":true,"description":"Since first made, the Regulations have expanded in scope beyond basic livestock disease notification and identification. Amendments (notably 2018–2024) added: detailed NLIS device specifications and electronic scanning/GPS reporting (regs 17, 35, 85–86, Schedule 3); extensive movement‑reporting duties for multiple classes of intermediaries (regs 86–94, 98A); prescriptive beekeeping biosecurity and testing regimes (regs 46, 54, 74A–74P); and broader disclosure/recipient classes for identification information (reg 107). These additions move the instrument from primarily setting disease reporting and ID rules to operating a high‑resolution, electronic traceability and surveillance regime with significant administrative, data and compliance obligations on industry. That design increases the government’s ability to locate affected animals, impose quarantines, direct vaccination or destruction, and document compensation claims (see regs 17, 59, 86–94, 79–80).\n\nCosts, incentives and behaviour the rules create\n\n- Direct compliance costs fall mainly on livestock owners, selling agents, saleyard operators and abattoirs: buying and applying NLIS devices and tags, scanning equipment, keeping records for multiple years, obtaining veterinary certificates for interstate introductions, and meeting testing or irradiation requirements for bee products (see regs 32–37, 42, 46–49, 54(2), 74P). \n- Time and administrative burdens increase for small producers and beekeepers because of frequent inspection, testing and multi‑year record retention (regs 74A, 74B, 74P; regs 6(3)–(4)).\n- The Secretary and inspectors hold substantial discretion to approve movements, authorise device reuse, permit exceptions in emergencies, and impose conditions on introductions — centralising decision‑making that can be tailored to risk but creates implementation and delay risk (see regs 50(2), 35(1A), 36–37, 19, 22, 65).\n- The Regulations create incentives to maintain traceable stock: animals with permanent NLIS devices and completed vendor declarations travel more freely; animals without correct ID or certificates face movement restrictions or extra documentation (see regs 15, 38, 46–49, 94).\n- Data collection is granular (microchip unique numbers, GPS for scanning certain calves, electronic copies of vendor declarations), which improves traceability and supports outbreak response but raises transaction costs and data‑handling obligations for many private actors (see regs 85, 86(3), 93(2)(a)(i), 86(3)(a)).\n\nTrade‑offs, risk and likely implementation friction\n\n- Faster disease detection and improved market confidence are the intended benefits; the trade‑offs are higher per‑transaction costs, investment in scanners/IT, and heavier recordkeeping.\n- Smaller operators and hobbyist beekeepers may face proportionally higher burdens than large commercial operations because fixed costs (tags, scanners, veterinary certificates) don’t scale down.\n- Secretary and inspector discretion helps adapt controls to circumstances but increases the risk of inconsistent outcomes and administrative delay; much practical operation will depend on electronic systems and clear directions/notices from the Secretary (see regs 85 definitions of required manner and specified manner).\n- Enforcement relies on a mix of criminal penalties and prescribed infringement notices (Schedule 11). Compliance may be driven by market access requirements (abattoirs and exporters) and enforcement actions in outbreaks.\n\nConcentrated benefits and diffuse costs\n\n- Benefits (reduced outbreak costs, protected export markets) are relatively concentrated for large producers, processors and exporters who depend on market access and disease‑free status. Costs (tags, testing, recordkeeping) are borne across a large and heterogeneous group of owners and agents; small producers may feel these costs most acutely (see regs 17, 86–94, Schedule 11).\n\nKey implementation points to watch (sections cited)\n\n- Notification timings and required content: reg 6 (and Schedule 2 for disease lists).\n- Identification rules and exceptions (unsafe/emergency): regs 17, 20, 24, 18–19, 21–22, 25–26.\n- Movement reporting obligations: regs 86–94, 98, 98A (includes GPS/scanning requirements for certain young cattle and exporters).\n- Beekeeper obligations (inspection, testing, sterilisation, movement): regs 74A–74P and regs 46–57.\n- Secretary and inspector discretion (approvals, authorisations, specified manner notices): regs 42, 50(2), 65, 85 (definitions of specified/required manner).\n- Penalties and infringement schedules: Schedule 11.\n\nThis is a technical, prescriptive regulatory instrument that operationalises surveillance, traceability and response for livestock and bee diseases. It shifts many practical duties—identification, scanning, recordkeeping, laboratory reporting, certification and movement control—onto private parties while centralising decision‑making and enforcement with the Secretary, inspectors and the chief veterinary officer (see reg 1, Parts 5–10, Part 12)."},"issue_detection":{"absurdities":[],"contradictions":[]},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
