While the expiry date has been extended multiple times (2020, 2023, 2024, 2025), this is standard administrative maintenance of temporary restrictions rather than scope creep. The geographical definition was slightly refined in 2024, but this improved precision rather than expanded reach."},"complexity_factors":["Very short instrument — only 9 regulations (with one deleted)","Single defined term ('Bungardi Aboriginal Community') with clear geographical boundaries","Minimal cross-referencing — only references to sections 155 and 175 of the parent Liquor Control Act 1988","Simple conditional logic — only one penalty tier (higher penalties for licensees/managers vs general public)","Straightforward offence structure — two prohibited acts (bringing in liquor, possessing liquor) with no exceptions or defences listed","Sunset clause (automatic expiry) clearly stated in regulation 9"],"plain_english_summary":"**What this does:**\nThese regulations create a **liquor ban** for a specific Aboriginal community in Western Australia called Bungardi (near Fitzroy Crossing). They make it illegal to bring alcohol into the community or possess it there.\n\n**Who it affects:**\n- **Residents and visitors** to the Bungardi Aboriginal Community — they cannot bring in or have alcohol in the area.\n- **Police** — they get extra powers to seize and destroy any alcohol containers (opened or unopened) if they reasonably suspect an offence.\n- **Licensees and venue managers** — they face **higher penalties** ($5,000) than ordinary people ($2,000) if they break the rules.\n\n**How it works:**\n- The restricted area is clearly mapped out using creeks, roads, the Fitzroy River, and specific land lots (Crown Reserves).\n- Signs must be posted at entry points warning people about the ban and penalties (though missing signs don't cancel the ban).\n- The regulations automatically **expire on 19 August 2026** unless renewed.\n\n**Why it matters:**\nThese are \"dry area\" laws — a form of alcohol restriction commonly used in remote Western Australian communities to reduce alcohol-related harm. The regulations override normal liquor licensing rules to create a total prohibition within the defined boundaries."},"flash_summary":{"complexity_score":3,"scope_assessment":{"changed":true,"description":"The instrument’s scope has been adjusted since 2017: Regulation 3 (the geographic definition) has been amended, Regulation 4 was deleted, and Regulation 9 (the expiry/period) was inserted and subsequently amended multiple times — see amendment notes and the compilation table (Regulations 3, 4 and 9; compilation table entries SL 2020/62, SL 2023/78, SL 2024/157, SL 2025/143)."},"complexity_factors":["Geographic definition is specific and technical (Regulation 3) which requires mapping to apply on the ground.","Different penalty levels depending on the offender’s status (licensee/manager/director) (Regulation 7(1)–(2)).","Police seizure and disposal power explicitly overrides parts of the parent Act (Regulation 8, referencing s.155(4)–(5) of the Act).","Obligation to post notices at each customary access route, but failure to post does not invalidate the declaration (Regulation 6(1)–(2)) — creates an implementation/compliance nuance.","Temporal limit and multiple later amendments to expiry and definitions create ongoing review and renewal requirements (Regulation 9; compilation table and amendment notes)."],"plain_english_summary":"These regulations declare the Bungardi Aboriginal Community (a specifically defined area) a restricted area under the Liquor Control Act.
