While the 2004 variation involved a massive technical overhaul (repealing and substituting the majority of attachments), and subsequent amendments updated service numbers and technical parameters, the instrument has not expanded beyond its original purpose of managing spectrum allocation for this specific geographic region."},"complexity_factors":["23 separate schedules with over 150 referenced attachments containing technical specifications not shown in the main text","Dense amendment history with 5 variations between 1997 and 2012, including a major 2004 rewrite that repealed and substituted most attachments","Technical broadcasting terminology including 'broadcasting services bands', 'open narrowcasting', and 'community television broadcasting service'","Complex geographic zoning requiring cross-referencing between area descriptions (e.g., 'Attachment 3.1 (Western Zone)') and service allocations","Layered document structure where the determination text must be read alongside schedules, which in turn reference attachments, creating a fragmented reading experience"],"plain_english_summary":"This Licence Area Plan sets technical rules under the Broadcasting Services Act 1992 allocating TV services and spectrum across remote and regional Western Australia. It designates one commercial service per zone and capacity for national (ABC/SBS), community—including reserved Indigenous community channels—and narrowcasting services, with detailed frequencies and transmitter parameters in attached schedules.\n\nIt matters because it manages scarce spectrum to deliver TV into remote communities while preventing interference."},"flash_summary":{"complexity_score":7,"scope_assessment":{"changed":true,"description":"The plan’s scope has been altered repeatedly: the Table of Instruments lists variations (1997, 1998, 2000, 2004, 2012) and the Table of Amendments records many attachments being added, repealed or substituted. Those edits changed which services, sites and technical specifications apply in particular licence areas, so the instrument’s practical coverage differs from the original February 1997 text."},"complexity_factors":["Numerous geographic units and service types listed (commercial, national, community, open narrowcasting) across many distinct licence areas (see Determination listing of Attachments 1.1–23.1 and named communities).","Extensive technical detail outsourced to many Schedules and Attachments (Schedules One–Twenty Three; Attachments 1.2–9.34 etc.) which require cross-referencing to understand coverage and specs (‘characteristics, including technical specifications’).","Multiple statutory cross‑references and delegated authority: plan made by the Australian Broadcasting Authority under subsection 26(1) of the Broadcasting Services Act 1992 (Determination header).","High amendment churn: Table of Instruments and the Table of Amendments record repeated variations and replacements (1997, 1998, 2000, 2004, 2012), with many attachments added, repealed or amended, increasing interpretive complexity.","Granular amendment history (ad./rep./rs./am. entries in Table of Amendments) means current legal effect depends on tracking which attachments were replaced or added at which dates.","Operational and compliance consequences are technical and practical (frequency/band use, transmitter parameters), so legal reading must be combined with technical engineering detail found in the attachments."],"plain_english_summary":"This determination by the Australian Broadcasting Authority designates which television services may be available across defined licence areas in remote and regional Western Australia. It names numbers of commercial, national, community and an open narrowcasting service for specific licence areas and delegates the technical characteristics and frequency use to detailed Schedules and Attachments. Broadcasters operating in those areas must supply services in line with the plan and meet the technical specifications set out; the ABA decides allocations and may vary the plan, so broadcasters carry the compliance and operational costs."}},"importantCases":[],"_links":{"self":"/api/acts/licence-area-plan-remote-and-regional-western-australia-television-february-1997","history":"/api/acts/licence-area-plan-remote-and-regional-western-australia-television-february-1997/history","analysis":"/api/acts/licence-area-plan-remote-and-regional-western-australia-television-february-1997/analysis","conflicts":"/api/acts/licence-area-plan-remote-and-regional-western-australia-television-february-1997/conflicts","importantCases":"/api/acts/licence-area-plan-remote-and-regional-western-australia-television-february-1997/important-cases","documents":"/api/acts/licence-area-plan-remote-and-regional-western-australia-television-february-1997/documents"}}
