The information includes commencement details for amending laws and details of any application, saving or transitional provisions that are not included in this compilation.\n\nThe amendment history in endnote 4 provides information about amendments at the provision (generally section or equivalent) level. It also includes information about any provision of the compiled law that has been repealed in accordance with a provision of the law.\n\nMisdescribed amendments\n\nA misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under section 15V of the Legislation Act 2003.\n\nIf a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.\n\nEndnote 2—Abbreviation key\n\n| ad = added or inserted                         | orig = original                          |\n| ---------------------------------------------- | ---------------------------------------- |\n| am = amended                                   | p = page(s)                              |\n| amdt = amendment                               | para = paragraph(s)/subparagraph(s)      |\n| C[x] = Compilation No. x                       | /sub‑subparagraph(s)                     |\n| ch = Chapter(s)                                | pres = present                           |\n| cl = clause(s)                                 | prev = previous                          |\n| cont. = continued                              | (prev…) = previously                     |\n| def = definition(s)                            | pt = Part(s)                             |\n| Dict = Dictionary                              | r = regulation(s)/Court rule(s)          |\n| disallowed = disallowed by Parliament          | reloc = relocated                        |\n| div = Division(s)                              | renum = renumbered                       |\n| exp = expires/expired or ceases/ceased to have | rep = repealed                           |\n| effect                                         | rs = repealed and substituted            |\n| gaz = gazette                                  | s = section(s)/subsection(s)             |\n| LA = Legislation Act 2003                      | /rule(s)/subrule(s)/order(s)/suborder(s) |\n| LIA = Legislative Instruments Act 2003         | sch = Schedule(s)                        |\n| (md not incorp) = misdescribed amendment       | SLI = Select Legislative Instrument      |\n| cannot be given effect                         | SR = Statutory Rules                     |\n| mod = modified/modification                    | sub ch = Sub‑Chapter(s)                  |\n| No. = Number(s)                                | sub div = Subdivision(s)                 |\n| Ord = Ordinance                                | sub pt = Subpart(s)                      |\n|                                                | underlining = whole or part not          |\n|                                                | commenced or to be commenced             |\n\nEndnote 3—Legislation history\n\n```html\n<table cellspacing=\"0\" cellpadding=\"0\" style=\"width:93.86%; It lists which types of radio services (national, commercial, community and open narrowcasting) are to be available in defined licence areas and specifies the transmitters planned to provide those services.\n\n- The Plan does not set programming content or commercial terms. Instead it allocates frequencies and records technical specifications for each planned transmitter: the site (nominal coordinates), carrier frequency, frequency band and mode (AM or FM), polarisation, maximum antenna height, maximum output (ERP or CMF), radiation pattern by azimuth/sector, and any special operating conditions. (See Determination clauses (2)–(9) and the Attachments.)\n\n- Where a transmitter may be used only after a particular event (for example another service ceasing, or the start of transmission by a replacement transmitter), the Plan records those availability conditions and any required delay (for example, “ceases to be available 8 weeks after the first day on which…”). (See Attachments such as 1.3, 1.4, 1.8, 1.8A, 1.8B, 1.29 and 4.2–4.3.)\n\n- The Plan allows operation from an alternative site (other than the nominal coordinates) only if that operation meets any requirements set for the transmitter and the Broadcasting Services (Technical Planning) Guidelines made under section 33 of the Act. (See clause (10).)\n\n**Who is affected\n\n- Broadcasters and prospective broadcasters: national, commercial, community and open narrowcasting licences and applicants. The Plan identifies which service licences (by number) are associated with which transmitters and frequencies (Schedules One–Six and Attachments).\n\n- Radiocommunications transmitters/operators and site owners (for example Broadcast Australia and other tower/site operators) because the Plan fixes where and how transmitters may operate.\n\n- The regulator (ACMA) uses this Plan to administer licensing, technical planning and to resolve spectrum/coverage conflicts.\n\n- Indirectly, equipment suppliers, tower contractors and local governments may be affected where changes in transmitter siting or power require works or approvals.\n\n**Why it matters (practical effects and the mechanisms that produce them)\n\n- Frequency and interference control: by fixing frequencies, power limits and antenna patterns the Plan prevents or reduces harmful interference between services. (Attachments specify ERP/CMF and azimuthal patterns.)\n\n- Market access and coverage: the Plan determines where radio operators can reach audiences. A licensee’s commercial or community reach depends on the transmitter characteristics recorded here (site, power, antenna height, coverage circle definitions). For example, several community and commercial services are specified at the Bickley transmitter site with differing ERP limits and sectors (Attachments 1.5–1.8, 1.13–1.16 and others).\n\n- Entry sequencing and incumbency effects: some transmitter specifications are conditional — a new transmitter is only \"available\" once an existing service ceases or after a specified delay. Mechanically, that means new services cannot lawfully start on the replacement frequency until the trigger event occurs; incumbents therefore control the timing of that change unless other regulatory action occurs. (See Availability notes in Attachments 1.3, 1.4, 1.8, 1.8A, 1.8B, 1.29, 4.2 and 4.3.)\n\n- Administrative compliance and coordination: operators must comply with detailed, technical limits (coordinates, power, antenna height and polarisation). Where an operator wishes to use an alternative site, they must meet the Plan requirements and the section 33 Guidelines — introducing a procedural dependency on guidelines and ACMA oversight. (Clause (10) and the note referencing the Broadcasting Services (Technical Planning) Guidelines.)\n\n**Costs, incentives and trade‑offs (mechanisms rather than policy judgments)\n\n- Who pays: broadcasters or licence-holders bear the capital and operating costs of transmitters, site access, antenna works and any changes needed to meet the technical specifications. ACMA incurs regulatory costs to maintain and enforce the Plan.\n\n- Incentives created by conditional availability: when a replacement transmitter is made available only after an incumbent’s service stops, incumbents have an operational lever over the timing of change. That can create an incentive to delay cessation or require coordination (the Plan records the condition but enforcement or dispute resolution would typically involve ACMA and other statutory mechanisms). (See Attachments with \"Availability\" notes.)\n\n- Substitution effects: the Plan distinguishes service categories (national, commercial, community, open narrowcasting) and allocates frequencies accordingly. That structuring mechanically channels potential entrants into particular service types and frequencies; an operator seeking coverage may choose to pursue a community licence on an allocated frequency, a commercial licence where listed, or operate under narrowcasting constraints where frequencies are assigned for low‑power, limited audiences.\n\n- Implementation risk/compliance burden: operators must ensure transmitter installations match the precise technical limits (ERP/CMF, polarisation, antenna height and radiation pattern). Departures risk interference complaints, regulatory action, and possible refusal to register transmissions as conforming to the Plan. Alternative site operation is permitted but conditional on compliance with guidelines, adding procedural steps.\n\n**Cross‑references and external dependencies\n\n- The Plan cross-references other Licence Area Plans (for example, some availability clauses refer to provisions in the Licence Area Plan – Remote Western Australia Radio). (See Attachment 1.8(c) and 1.8B.)\n\n- It depends on the Broadcasting Services (Technical Planning) Guidelines made under section 33 of the Act for rules about operating from alternative sites. (Clause (10) and the note.)\n\n**Concrete behavioural changes required\n\n- Licence-holders must operate transmitters only at the specified frequencies and within the stated power/height/pattern limits, and must observe any special conditions. (Clause (9) and each Attachment.)\n\n- Where a transmitter’s availability is conditional, potential operators must plan for the trigger event (e.g. cessation of an incumbent) and cannot lawfully commence transmissions from the replacement transmitter before that condition is met. (Availability notes in Attachments.)\n\n**Key textual locations to check when you need operational detail\n\n- Determination clauses (1)–(12): sets the plan’s legal basis, scope and key definitions (including the link to Radiocommunications Act meaning of \"radiocommunications transmitter\" and rules for references).  \n- Schedules One–Six: summary tables that map services, frequencies, licence numbers and transmitter specification numbers to coverage areas.  \n- Attachments 1.2–1.35, 2.2, 3.2–3.4, 4.2–4.3, 5.2, 6.2: contain the full technical specifications (site coordinates, ERP/CMF, antenna heights, radiation patterns and availability conditions).\n\n(If you are a broadcaster or applicant, consult the specific Attachment(s) for the transmitter and frequency you plan to use, and the Broadcasting Services (Technical Planning) Guidelines for alternative‑site rules.)"}},"importantCases":[],"_links":{"self":"/api/acts/licence-area-plan-perth-radio","history":"/api/acts/licence-area-plan-perth-radio/history","analysis":"/api/acts/licence-area-plan-perth-radio/analysis","conflicts":"/api/acts/licence-area-plan-perth-radio/conflicts","importantCases":"/api/acts/licence-area-plan-perth-radio/important-cases","documents":"/api/acts/licence-area-plan-perth-radio/documents"}}
