This is a formal allocation of radio spectrum and technical parameters for one community FM radio service in that geographic area (see Determination, para (2)).\n- The plan specifies the service category (community radio), the channel/frequency (97.1 MHz), the service licence number (SL1150834) and the transmitter technical specification number (TS10014649) (Schedule One).\n- The geographic licence area is defined by a list of Australian Bureau of Statistics Collection Districts (seven CDs) — these are the boundaries within which the service is intended to operate (Attachment 1.1).\n- The technical parameters in Attachment 1.2 set the transmitter site (nominally a mast on the Midland Highway 2 km NE of Oatlands, with Australian Map Grid co‑ordinates), frequency band/mode (VHF-FM), carrier frequency (97.1 MHz), mixed polarisation, maximum antenna height (30 m), and maximum effective radiated power (ERP) of 2 kW at all azimuth angles. The attachment also refers to “Site Tolerance” as defined in the Technical Planning Guidelines.\n- The Determination allows for schedules and attachments to be amended over time (Determination, para (3)).\n\n**Who this affects**\n\n- The primary beneficiary is the holder of the community radio service licence identified (SL1150834): that licence authorises operation on 97.1 MHz within the specified area under the technical limits set out.\n- ACMA and its technical/planning staff are affected in implementation and enforcement (monitoring frequencies, approvals, and amendments).\n- Other potential broadcasters and spectrum users: the allocation reserves the listed frequency and coverage parameters for a community service in that area, limiting the ability of competing services (commercial, national or other community services) to use that same frequency or the same technical envelope without ACMA action.\n- Local listeners and organisations in the listed ABS Collection Districts are affected in that this plan governs the available local community radio service and its intended coverage.\n\n**Why it matters (purpose claimed and mechanical effects)**\n\n- The official purpose is to make a community broadcasting service available in the Oatlands area and to set the technical limits to manage interference and coverage (Determination paras (1)–(2); Schedule One; Attachment 1.2).\n- Mechanically, the plan does three things: (1) reserves a discrete slice of spectrum (97.1 MHz) for a community radio service; (2) prescribes transmitter siting and technical limits (ERP, antenna height, polarisation) that shape the service’s coverage footprint; and (3) defines the licence area by ABS Collection Districts, which limits where the service is expected to operate and whom it primarily serves.\n\n**Costs, incentives and trade-offs (practical assessment)**\n\n- Who pays: the licence holder bears the costs of building, maintaining and operating equipment within the specified technical envelope; ACMA bears administrative costs of allocation and enforcement.\n- Concentrated benefits: the named licence holder (and its local community stakeholders) gains an exclusive right to operate on the assigned frequency within the defined area and technical limits (concentrated benefit). \n- Diffuse costs and restrictions: other potential broadcasters face constrained access to that frequency and to nearby spectrum consistent with interference management rules; the public gains a defined community service but not additional commercial or alternative services on that frequency.\n- Incentives created: the technical limits (2 kW ERP, 30 m antenna max, fixed site) incentivise the licensee to design coverage to serve the listed CDs without extending power/height to capture broader markets; compliance incentives arise from the risk of enforcement if limits are exceeded.\n- Opportunity costs and substitution: reserving the frequency for a community service removes that frequency from commercial allocation options; any demand for alternative services must find other spectrum or wait for ACMA to change allocations.\n- Implementation and compliance risk: effective coverage depends on the actual siting, local terrain and adherence to the Technical Planning Guidelines referenced; adjustments (e.g. slight relocations or technical variations) may require ACMA approval or amendment of attachments.\n\n**Practical compliance and administrative notes**\n\n- The licence holder must operate within the specified technical parameters (frequency, ERP, antenna height, polarisation, and site coordinates) and within the named licence area (Attachments 1.1 and 1.2; Schedule One).\n- The “Site Tolerance” and any planning variations are governed by ACMA’s Technical Planning Guidelines — deviation beyond those tolerances likely requires administrative approval or amendment.\n- The Determination’s amendment clause means ACMA can update the schedule/attachments over time, changing technical parameters or area definitions if justified and processed through ACMA’s procedures.\n\n**Concrete legal references inside the instrument**\n\n- The plan is made under subsection 26(1) of the Broadcasting Services Act 1992 (headnote of the Determination).\n- Key operational details are in Schedule One (service, frequency, licence and technical spec numbers) and Attachments 1.1 (licence area defined by ABS CDs) and 1.2 (technical specification TS10014649)."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
