Predictions by their very nature are subject to some degree of uncertainty given limitations of topography and other data.\n\nThe Australian Broadcasting Authority (ABA) takes reasonable care in assigning frequencies, but cannot warrant that licensed use of a broadcasting facility will be free from (or will not cause) interference. Any such interference can vary in extent and can originate within Australia or overseas.\n\nProspective applicants for licences should obtain independent technical or specialist advice concerning their applications, the operation of broadcasting equipment, and any other matters relevant to the operation of transmitters and services under the licences in question.\n\n- Existing broadcasters should take all reasonable steps to be satisfied that their frequency will operate at the prescribed levels before making changes to its existing technical operating conditions.\n\n- Aspirant broadcasters should take all reasonable steps to be satisfied that their frequency of interest will operate at the prescribed levels before competing for spectrum availability.\n\nNo liability is or will be accepted by the Minister for Communications, Information Technology and the Arts, the ABA, the Commonwealth of Australia, or its officers, servants or agents for the licensed use of a broadcasting facility which is not free from (or causes) interference.\n\n \nAttachment 1.1\n\nLICENCE AREA FOR SERVICE LICENCE NOS: SL4151; SL5087; SL5148; SL1150691\n\nCOMMERCIAL AND COMMUNITY RADIO - It records which types of radio services are to be available in two defined Geelong licence areas (GEELONG RA1 and GEELONG RA2) and sets the technical transmitter specifications for those services.\n\n- For GEELONG RA1 (Schedule One / Attachment 1.1):\n - Two commercial FM services, two community FM services and one open narrowcasting AM service are listed as the services to be available. Frequencies and the current status of each channel (Licensed, Available, Alternative) are shown in the Schedule, and detailed transmitter parameters (site, carrier frequency, antenna height, polarisation, maximum ERP by sector or omnidirectional power) are set out in Attachments 1.2–1.7.\n - One community service currently uses 100.3 MHz from a site at Matthew Flinders High School (Attachment 1.6). A special condition requires that this 100.3 MHz service be replaced by 94.7 MHz (Attachment 1.5) no later than one year after the plan’s Gazette notice.\n - The open narrowcasting service is specified on AM 1341 kHz from a nominal Portarlington site with a detailed directional field-strength table and a defined 80 km coverage area (Attachment 1.7). It allows relocation inside that coverage area subject to the ABA’s Change of Transmitter Site Procedure and not increasing field strength toward specified minima.\n\n- For GEELONG RA2 (Schedule Two / Attachment 2.1):\n - One community FM service (99.5 MHz) and one open narrowcasting FM service (89.3 MHz) are listed as available; technical specification references are given in Schedule Two (Attachments 2.2–2.3 where applicable).\n\n- Geographic extent for licence areas is defined by Australian Bureau of Statistics areas and collection districts (see Attachments 1.1 and 2.1).\n\n- The plan includes a standard disclaimer that frequency availability is based on interference predictions, that the ABA cannot guarantee absence of interference, and that applicants and operators should obtain independent technical advice. It also places limits on liability for the Minister, the ABA and the Commonwealth.\n\n**Who this affects**\n\n- Existing licensed commercial and community radio operators in the Geelong area (their licences, frequencies and transmitter requirements are documented here).\n- Prospective broadcasters (commercial, community and open narrowcasters) who may apply for the channels the plan lists as “Available.”\n- Technical contractors, broadcast engineers and equipment suppliers who must deliver transmitters and antenna systems that meet the specified site, ERP (effective radiated power), polarisation and pattern requirements.\n- Spectrum planners and regulators (the Australian Broadcasting Authority) who use the plan to administer licensing and site-change procedures.\n\n**Why it matters (practical effects and mechanics)**\n\n- The document establishes which radio channels are intentionally made available or reserved in Geelong, and it fixes the technical envelope (site, power, pattern, antenna height, polarisation) under which those services may operate. That determines radio coverage footprints and interference relationships between services.\n- By designating channels as “Available” the plan creates capacity that new entrants can compete for. By designating channels as “Licensed” or “Alternative” it records incumbents’ positions and sets future technical changes (for example the mandatory frequency change from 100.3 to 94.7 MHz for SL5087 within a year — Attachment 1.5/1.6).\n\n**Purpose claims (as stated) and brief testing of those claims**\n\n- The ABA’s stated purpose in a licence area plan is to identify and allocate broadcast capacity so licensing can proceed in an orderly way. That claim is operationally supported: the plan enumerates service types, assigns technical specifications and defines areas (Schedules 1 and 2, Attachments 1.2–1.7, 2.2–2.3).\n\n- Trade-offs and implementation risks visible from the text:\n - Uncertainty and implementation risk: the plan relies on theoretical interference predictions (Disclaimer). This shifts technical risk onto applicants and operators who must obtain independent advice and may face unanticipated interference or mitigation costs.\n - Compliance and transaction costs: applicants must meet detailed technical specifications (ERP by sector, antenna height, polarisation, site coordinates) and follow the ABA’s Technical Planning Guidelines and Change of Transmitter Site Procedure (Attachments 1.2–1.7, 1.7 special conditions). That creates upfront engineering and regulatory compliance costs.\n - Concentrated vs diffuse effects: incumbents with “Licensed” status have concrete secured capacity recorded in the plan; prospective entrants bear the cost of competing for “Available” slots and meeting the technical constraints. The special-condition frequency replacement benefits planning consistency but imposes operational change for the service listed on 100.3 MHz (Attachment 1.5/1.6).\n - Market effects on private enterprise: the plan increases the number of potential community and narrowcasting licences (more entry opportunities), while preserving existing commercial licences. The technical constraints (power sectors, site tolerances, coverage radius for narrowcasting) limit how operators can expand coverage, which affects competitive reach and potential audience size.\n - Bureaucratic discretion and scope for administrative decision-making: site changes and acceptance of alternative transmitter locations are subject to ABA procedures (Attachment 1.7, Change of Transmitter Site Procedure), giving the regulator discretion over implementation details.\n\n**Who pays and who decides (behavioural consequences)**\n\n- Who pays: prospective and existing licensees pay for engineering assessments, transmitter construction, ongoing operation, and fees associated with licensing processes. They also bear costs of any frequency or site changes required by the plan’s special conditions.\n- Who decides: the ABA sets the plan and technical envelopes; licensing allocations (for “Available” services) will be decided through the ABA’s allocation processes and applicants must comply with ABA technical guidelines.\n- Behaviour changes required: incumbents may need to alter technical operating conditions to meet new specs (notably the 100.3 → 94.7 MHz replacement). New entrants must design systems to fit the prescribed ERP/pattern limits and may limit their coverage ambition to the coverage areas the plan allows.\n\n**Concrete constraints and notable special conditions (where to look in the text)**\n\n- Frequency replacement: Attachment 1.5 (special condition) requires the 94.7 MHz specification to replace the existing 100.3 MHz operation (Attachment 1.6) within one year of Gazette notice.\n- AM open narrowcasting (Attachment 1.7) sets a precise directional CMF (carrier/mast field) table, four specified minima bearings and a defined 80 km coverage-area centre, and permits site relocation only within that 80 km area and following the ABA’s Change of Transmitter Site Procedure.\n- Geographic licence area definitions use ABS-defined municipal and collection district boundaries (Attachment 1.1 and 2.1). This determines the licensed market area and regulatory responsibilities.\n\n**Net effect summary**\n\n- The plan records incumbents, creates a set of available channels for new licences, fixes detailed technical parameters and places procedural constraints on site changes and frequency transitions. It shifts technical uncertainty and compliance costs onto operators and applicants, while giving the regulator a framework to manage interference and licensing in the Geelong market (Schedules and Attachments)."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
