They set out administrative rules for licensing people who practise as land valuers (people who assess the value of land and property).\n\n**Key things the regulations do (mechanics)**\n\n- Prescribe the fees a person must pay to get and renew a land valuer licence, and for a duplicate licence (Schedule 1). A late renewal fee applies if a licence is renewed after expiry (reg. 4).\n- Fix the length of a licence and the additional renewal period at 3 years (reg. 4A). That means licences are issued/renewed for three-year periods.\n- Specify what information the Commissioner must keep in the public register of licensees (for example name, business name and addresses, employer details, licence number and particulars of any suspension/cancellation) and require licensees to notify the Commissioner in writing within one month if those particulars change (regs. 6–7). A small penalty applies for failure to notify (reg. 7; Schedule 2).\n- Prescribe the university degrees, diplomas and professional memberships that qualify as acceptable education/awards for grant of a licence (Schedule 1A; reg. 8). The list names particular degrees/diplomas and some Royal Institution of Chartered Surveyors memberships.\n- Make prescribed offences eligible for infringement notices (a civil-style on-the-spot fine system) and attach modified penalties to those offences; list the relevant forms for issuing and withdrawing infringement notices (regs. 10–11; Schedules 2–3). The Commissioner may appoint authorised officers to issue infringement notices and must provide them with identity (reg. 10).\n- State that fees and costs set by these regulations can be recovered as a debt due to the Crown (reg. 9).\n\n**Who pays and who decides**\n\n- Applicants and licensees pay the statutory fees (Schedule 1; reg. 4). If a licence renewal is late there is an added late fee (reg. 4(2)).\n- Licensees bear the administrative obligation to keep the Commissioner informed of changes to their register details within one month, or risk a penalty (reg. 7).\n- The Commissioner (the consumer-protection / licensing official identified by reference to the Fair Trading Act) maintains the register, issues licences, appoints authorised officers who may issue infringement notices, and sues to recover debts due to the Crown (regs. 2, 6, 9, 10).\n\n**Concrete behaviour changes the law incentivises**\n\n- Prospective land valuers will rely on listed degrees/diplomas or listed professional memberships (Schedule 1A; reg. 8) when deciding how to qualify.\n- Licence holders are incentivised to renew on time (late fee) and to keep their register details current (one-month notification requirement and a small penalty) (regs. 4, 7).\n- The Commissioner can enforce compliance economically through infringement notices (lower-cost enforcement) rather than court prosecutions for the prescribed minor offences (reg. 10; Schedule 2).\n\n**Costs, trade-offs and administrative effects**\n\n- Direct compliance cost to practitioners: licence application and renewal fees (Schedule 1), a small administrative burden to notify changes within one month (reg. 7), and risk of fines or prosecution for specified breaches (Schedule 2).\n- Entry/qualification effect: by naming specific degrees/diplomas and select professional memberships (Schedule 1A; reg. 8) the regulations create a clear pathway to eligibility but also make eligibility dependent on the listed awards. Graduates of listed programs obtain a direct, administratively straightforward route to licence grant; applicants with other qualifications may need separate recognition or assessment under the Act.\n- Enforcement efficiency: allowing infringement notices (reg. 10) reduces the transaction cost of enforcing low-level breaches compared with court prosecution, but may shift discretion to appointed authorised officers in the Department/Commissioner’s control.\n- Revenue and collection: fees and court-ordered costs are recoverable as debts to the Crown (reg. 9), increasing the State’s ability to enforce and collect sums.\n\n**Implementation risks and discretionary points**\n\n- Discretion sits with the Commissioner to maintain the register, appoint authorised officers and manage enforcement (regs. 6, 10). How actively that discretion is used affects the practical burden on practitioners.\n- The prescribed list of degrees/diplomas is a point of administrative control: updating that list is required to reflect changes in tertiary offerings; until updated it may exclude newer programs.\n- The infringement-notice pathway concentrates routine enforcement authority with authorised officers; quality of training and procedural safeguards for those officers matter for consistent application (reg. 10).\n\n**Net effect on markets and private choice (mechanical, not normative)**\n\n- The regulations raise the predictable cost of supplying land valuation services (licence fees, compliance and risk of fines) and limit legal supply to licensed individuals (Act-based restriction implemented through these regulations).\n- By listing specific qualifications and professional memberships, the regulations shape the educational routes that aspiring valuers choose (Schedule 1A; reg. 8). That can concentrate benefits for graduates of listed programs and imposes adaptation costs on others.\n\n**Primary provisions to look at when using this instrument**\n\n- Fees and late-renewal rule: reg. 4 and Schedule 1.\n- Licence period: reg. 4A.\n- Register content and notification duty: regs. 6–7 (penalty for reg. 7 appears in Schedule 2).\n- Qualifications that automatically qualify: reg. 8 and Schedule 1A.\n- Infringement procedure and prescribed offences: reg. 10 and Schedule 2, with forms in Schedule 3.\n\n(References in parentheses are to the regulation or Schedule number quoted above.)"},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available. These rules ensure only properly qualified people can do this work, maintain public records of who is licensed, provide a simple enforcement system for minor breaches, and keep the profession accountable."}},"importantCases":[],"_links":{"self":"/api/acts/land-valuers-licensing-regulations-1979","history":"/api/acts/land-valuers-licensing-regulations-1979/history","analysis":"/api/acts/land-valuers-licensing-regulations-1979/analysis","conflicts":"/api/acts/land-valuers-licensing-regulations-1979/conflicts","importantCases":"/api/acts/land-valuers-licensing-regulations-1979/important-cases","documents":"/api/acts/land-valuers-licensing-regulations-1979/documents"}}
