and\n(b) prescribed by regulation for this definition.\nNote\nSee section 13(8) for what happens if Kenbi freehold title to prescribed land is\nsurrendered to the Territory.\ntraditional Aboriginal owners, in relation to land, has the same\nmeaning as in section 3(1) of ALRA, and includes the traditional\nAboriginal owners of part of the land.\nTrust means the Kenbi Land Trust established under section 6.\nTrust member means a person holding office as the chairperson or\na member of the Trust under an appointment under section 9(1).\n4 Act binds Crown\nThis Act binds the Crown in right of the Territory and, to the extent\nthe legislative power of the Legislative Assembly permits, the\nCrown in all its other capacities.\n5 Relationship with other laws\n(1) This Act applies despite any other law of the Territory.\n(2) This Act must be read and construed in a manner consistent with\nthe NTA and ALRA.\nPart 2 Kenbi Land Trust\n6 Establishment\n(1) The Kenbi Land Trust is established to hold title to the prescribed\nland vested in it under this Act for the benefit of Aboriginals entitled\nby Aboriginal tradition to the use or occupation of the prescribed\nland, whether or not the traditional entitlement is qualified as to\nplace, time, circumstance, purpose or permission.\n\nPart 2 Kenbi Land Trust\nKenbi Land Trust Act 2011 3\n(2) The Trust:\n(a) is a body corporate with perpetual succession; and\n(b) must have a common seal; and\n(c) is capable, in its corporate name, of suing and being sued.\n7 Common seal of Trust\n(1) The Trust must make arrangements with the NLC for the common\nseal to be kept by a staff member of the NLC authorised, in writing,\nby the NLC for that purpose.\n(2) The common seal may only be affixed to a document with the\nwritten authority of at least 3 Trust members.\n(3) All courts, judges and persons acting judicially must take judicial\nnotice of the common seal and must presume it was duly affixed.\n8 Functions\n(1) The following are the functions of the Trust:\n(a) to hold title to the prescribed land vested in it under this Act;\n(b) to exercise its powers as owner of that prescribed land for the\nbenefit of Aboriginals as mentioned in section 6(1).\n(2) The Trust:\n(a) must not perform its functions in relation to the prescribed land\nexcept in accordance with an NLC direction; and\n(b) if such an NLC direction is given – must perform its functions\nin accordance with the direction.\n(3) It is not a function of the Trust to accept moneys owing to it or to\ngive a valid discharge for such moneys, but such moneys may be\npaid to the NLC and the NLC must, within 6 months after its receipt,\npay an amount equal to the moneys to or for the benefit of the\ntraditional Aboriginal owners of the prescribed land.\n9 Membership\n(1) The Trust consists of a chairperson and at least 3 other members\nappointed in writing by the NLC from Aboriginals as mentioned in\nsection 6(1).\n(2) A Trust member is to be appointed for 5 years but is eligible for\nreappointment.\n\nPart 3 Grant of prescribed land\nKenbi Land Trust Act 2011 4\n(3) The performance of the Trust's functions is not affected merely\nbecause of one or more vacancies in the Trust membership.\nPart 3 Grant of prescribed land\n10 Grant of Kenbi freehold title\n(1) The Part 3 Minister is authorised:\n(a) to grant to the Trust, under sections 9(1) and 10(1) and (2) of\nthe Crown Lands Act as applied by subsection (2), Kenbi\nfreehold title to the prescribed land; and\n(b) to do any other thing necessary or convenient to enable that\ngrant.\n(2) Sections 9(1) and 10(1) and (2) of the Crown Lands Act apply in\nrelation to the grant of Kenbi freehold title for the prescribed land as\nif:\n(a) a reference to an estate in fee simple were a reference to\nKenbi freehold title; and\n(b) a reference to a person who has a right to be granted an\nestate in fee simple were a reference to the Trust.\n(3) However, this section does not require compliance with any other\nprovision of the Crown Lands Act before Kenbi freehold title to the\nprescribed land is granted to the Trust.\n11 Conditions for granting Kenbi freehold title\n(1) The Part 3 Minister is authorised to grant Kenbi freehold title as\nmentioned in section 10(1)(a) only if both of the following conditions\nare complied with:\n(a) for any application of the type mentioned in section 50(1)(a) of\nALRA relating to the prescribed land – the applicants have\nwithdrawn the application;\n(b) an indigenous land use agreement has been executed in\nrelation to all of the prescribed land.\n(2) In this section:\nindigenous land use agreement has the same meaning as in the\nNTA.\nNote\n\nPart 4 Dealings by Trust in relation to prescribed land\nKenbi Land Trust Act 2011 5\nSection 253 of the NTA states that indigenous land use agreement has the\nmeaning given by sections 24BA, 24CA and 24DA of that Act.\n12 Exercise of power not impeachable for informality or\nirregularity\nThe exercise of power under section 10 by the Part 3 Minister is not\nto be impeached because of an informality or irregularity in the\ncompliance with either conditions mentioned in section 11 except\non the ground the exercise of the power was not in good faith.\nPart 4 Dealings by Trust in relation to prescribed land\n13 Dealings with, or disposal of, land by the Trust\n(1) The Trust must not deal with or dispose of, or agree to deal with or\ndispose of, all or a part of any estate or interest in the prescribed\nland except as provided by this section and in accordance with an\nNLC direction.\n(2) In relation to any such estate or interest, the Trust may:\n(a) grant an estate, interest or licence to any person for any\npurpose; or\n(b) surrender an estate to the Territory.\n(3) The principles underlying the giving of an NLC direction as\nmentioned in subsection (1) are as follows:\n(a) the traditional Aboriginal owners of the prescribed land must\nunderstand the nature and purpose of the proposed dealing or\ndisposal and, as a group, consent to it;\n(b) any Aboriginal community or group that may be affected by\nthe proposed dealing or disposal must be consulted and have\nhad adequate opportunity to express its view to the NLC;\n(c) for a grant of an estate or interest – the terms and conditions\non which the grant is to be made must be reasonable.\n(4) A failure relating to the underlying principles mentioned in\nsubsection (3) does not invalidate the grant or surrender under the\nNLC direction unless the person to whom the grant or surrender\nwas made procured the direction by fraud.\n(5) If a grant of an estate or interest is invalidated under subsection (4),\nthat invalidity does not affect the rights of a person who has, for\nvalue and without notice of the fraud, been granted an estate or\ninterest dependent upon that estate or interest.\n\nPart 5 Other matters\nKenbi Land Trust Act 2011 6\n(6) The Trust may not grant fee simple or mortgage fee simple for all or\npart of the prescribed land.\n(7) If the Trust has granted a lease of any part of the fee simple, this\nsection does not limit the lessee's right to deal with his or her\ninterest under that lease, including by mortgaging the lease.\n(8) If Kenbi freehold title to prescribed land is surrendered to the\nTerritory, the land so surrendered is no longer prescribed land for\nthis Act and no longer vested in the Trust.\n14 Traditional rights to use or occupation of prescribed land\n(1) An Aboriginal or group of Aboriginals is entitled to enter prescribed\nland and use or occupy it to the extent the entry, occupation or use\nis in accordance with Aboriginal tradition governing the rights of the\nAboriginal or group with respect to the prescribed land, whether or\nnot those rights are qualified as to place, time, circumstances,\npurpose, permission or any other factor.\n(2) However, subsection (1) does not authorise an entry, use or\noccupation that would interfere with the use or enjoyment of an\nestate or interest in the land held by a person other than the Trust.\nPart 5 Other matters\n15 Non-extinguishment principle under NTA\n(1) The non-extinguishment principle applies to any act involved in the\ngrant, under section 10, of Kenbi freehold title to the prescribed\nland.\n(2) In this section:\nnon-extinguishment principle, see section 238 of the NTA.\n16 Involvement of NLC\nThe NLC may do all things necessary or convenient for performing\nits functions under this Act.\n17 Regulations\n(1) The Administrator may make regulations under this Act.\n\nPart 5 Other matters\nKenbi Land Trust Act 2011 7\n(2) The Regulations may provide for the following:\n(a) a matter relating to the Trust's membership, including, for\nexample, termination of appointment or resignation of a Trust\nmember;\n(b) a matter relating to the Trust's administration and procedures.\n\nENDNOTES\nKenbi Land Trust Act 2011 8\nENDNOTES\n1 KEY\nKey to abbreviations\namd = amended od = order\napp = appendix om = omitted\nbl = by-law pt = Part\nch = Chapter r = regulation/rule\ncl = clause rem = remainder\ndiv = Division renum = renumbered\nexp = expires/expired rep = repealed\nf = forms s = section\nGaz = Gazette sch = Schedule\nhdg = heading sdiv = Subdivision\nins = inserted SL = Subordinate Legislation\nlt = long title sub = substituted\nnc = not commenced\n2 LIST OF LEGISLATION\nKenbi Land Trust Act 2011 (Act No. 42, 2011)\nAssent date 21 December 2011\nCommenced 30 November 2023 (Gaz S80, 30 November 2023)","sortOrder":0}],"analysis":{"issue_detection":{"absurdities":[],"contradictions":[]},"flash_summary":{"complexity_score":6,"scope_assessment":{"changed":false,"description":"The Act implements a narrowly framed transfer mechanism: it establishes a Trust to hold Kenbi freehold title for traditional Aboriginal owners and limits actions by the Trust to those directed by the NLC. The land is held for the benefit of Aboriginal people who have traditional rights to use or occupy it under their customs and traditions.\n\n**Who it affects:**\n\n*   **Traditional Aboriginal owners** of the Cox Peninsula (Kenbi) area — they are the ultimate beneficiaries\n*   The **Northern Land Council (NLC)** — a Commonwealth body that appoints Trust members, holds the Trust's seal, gives directions to the Trust, and handles money on its behalf\n*   The **Northern Territory Government** — specifically the Minister responsible for Crown Lands, who has the power to grant the land to the Trust\n\n**Key features:**\n\n*   **Special land title:** Creates \"Kenbi freehold title\" — a unique form of ownership that sits somewhere between standard freehold and Aboriginal land rights title\n*   **Controlled dealings:** The Trust cannot sell, lease, or otherwise deal with the land without direction from the NLC, and must follow principles ensuring traditional owners understand and consent to any deals\n*   **Protection of native title:** The law ensures that granting this title doesn't extinguish (wipe out) any native title rights that might exist — this is called the \"non-extinguishment principle\"\n*   **Conditions for grant:** Before the land can be granted, any pending land rights claims must be withdrawn and an Indigenous Land Use Agreement (a contract about how the land will be used) must be signed\n*   **Traditional use rights:** Aboriginal people can continue to enter and use the land according to their traditions, provided this doesn't interfere with other people's legal rights to the land (like leaseholders)\n\n**Why it matters:**\n\nThis Act resolves a long-running land claim (the Kenbi or Cox Peninsula claim) by creating a bespoke legal structure. It balances Aboriginal ownership and control with practical arrangements for land management, while ensuring the Northern Land Council maintains oversight to protect the interests of traditional owners. It's a specific solution to a specific historical claim, rather than a general law applying across the Territory."}},"importantCases":[],"_links":{"self":"/api/acts/kenbi-land-trust-act-2011","history":"/api/acts/kenbi-land-trust-act-2011/history","analysis":"/api/acts/kenbi-land-trust-act-2011/analysis","conflicts":"/api/acts/kenbi-land-trust-act-2011/conflicts","importantCases":"/api/acts/kenbi-land-trust-act-2011/important-cases","documents":"/api/acts/kenbi-land-trust-act-2011/documents"}}
