some numeric parameters are fixed in the Order and others (F77–F79) are set by the Governor on the WorkCover Authority’s recommendation (Schedule 5).\n - Excess surcharge X is typically 0.03 for category B employers who do not agree to repay prescribed excess amounts (Schedule 6).\n - Minimum premiums for some category B policies are set in Schedule 7.\n - Premium reductions and wage exclusions for employers hiring certain previously injured or long‑term unemployed workers are handled in Schedule 8 (subject to application and guidelines by the WorkCover Authority).\n - The input tax credit adjustment I adjusts premium where employers have less than 100% GST input tax credit entitlement; Schedule 9 contains a table mapping input tax credit bands to percentage adjustments.\n- Provides interpretation rules, definitions and administrative points: how wages are to be estimated/determined (Schedule 1 cl.1 and cl.2); how previous employers (predecessors) and related corporations are treated (Schedule 1 cl.1(2)–(4)); insurer/Authority roles where parties disagree (Schedule 1, Schedule 3 notes).\n\n**Who is affected**\n\n- Employers who take out or renew workers’ compensation insurance policies that fall in the Order’s application period (Schedule 2 (1)).\n- Licensed insurers (the insurer calculates the tariff and experience elements and may request returns and apply the formulas) (Schedule 1 definitions, Schedule 3, Schedule 5).\n- The WorkCover Authority and the Governor (both have specified roles: determinations, guidelines, and specified numeric coefficients) (Schedule 5; Table A notes 11, 15).\n\n**Why it matters**\n\n- It determines the money employers must pay for workers’ compensation cover for the specified year by prescribing formulas, business classification rates and adjustments tied to both industry risk (tariff) and each employer’s claim history (experience adjustments).\n- It creates financial incentives for employers to manage claims and workplace safety (because S and E depend on claim costs) and for insurers and employers to keep accurate returns and records (because many calculations rely on reported wages and claims) (Schedule 4, Schedule 5, Schedule 3).\n\n**Official purpose-claim and mechanical check**\n\n- The instrument’s stated (mechanical) purpose is to prescribe the components and method for calculating premiums for the 2000–2001 policy year (cl.2; Schedule 2). That purpose is achieved by: defining tariff rates (Table A), tying part of the premium to an employer’s own claims experience (Schedules 4–5), and applying adjustments for GST input tax credits and other statutory contributions (Schedule 9, cl.3).\n\n**Costs, incentives and trade-offs (tested against the instrument’s mechanics)**\n\n- Compliance and administrative cost: the Order requires returns, claim particulars and wage data. Employers and insurers must estimate or determine wages, submit returns and sometimes apply to the WorkCover Authority for determinations (Schedule 1 cl.2; Schedule 3 cl.1(2); Schedule 5 cl.1(2)). That imposes recordkeeping and procedural costs on employers and administrative work for insurers and the Authority.\n- Risk‑reflective pricing vs complexity: linking premiums to individual experience (Schedules 4–5) aligns price with risk and can reduce cross‑subsidies, but it increases calculation complexity and disputes over data (e.g. classification of wages, predecessor adjustments, and per‑capita replacements) (Schedule 3 notes; Schedule 5 cl.3).\n- Distribution of effects: several provisions protect or favour certain groups:\n - A cap on the experience‑adjusted premium where T ≤ $112,000 prevents the experience adjustment producing more than twice the basic tariff premium for that range (cl.3(a)); that caps large year‑to‑year increases for many employers.\n - Minimum premiums for some category B policies (Schedule 7) create a floor that raises very small premiums to administrative‑cost levels; the benefit of predictability from a floor accrues unevenly.\n - The input tax credit adjustment (Schedule 9) reduces premium for employers with less than 100% ITC entitlement; the mapping (Schedule 9 table) means GST‑treatment differences affect premium levels.\n- Incentives for employer behaviour: experience adjustments and minimum/cap rules shape behaviour: employers have stronger incentives to reduce claim costs (affecting S and E), to agree to repay excesses (to avoid X = 0.03 for some category B employers — Schedule 6), and to ensure correct classification of their business (Table A notes and Schedule 3).\n- Potential for strategic responses: the Order contains allocation and classification rules (Table A notes 3–11 and note 15 on related corporations) that give rise to legitimate classification disputes or incentives to arrange business activities so as to attract a lower tariff rate; the Authority issues guidelines to insurers for classification (Table A note 11), and related‑entity rules determine which tariff applies if an employer predominantly supplies clerical/administrative services to a related corporation (Table A note 15).\n- Bureaucratic discretion and parameter setting: certain numeric parameters (F77–F79) used in the experience premium are set by the Governor on the WorkCover Authority’s recommendation and published in the Gazette, which introduces an administrative choice external to the Order itself (Schedule 5).\n- Implementation risks and dispute points: common dispute triggers are wage estimation methods (insurer estimate vs Authority determination — Schedule 1 cl.2), treatment of predecessors on acquisition (Schedule 1 cl.1(2), Schedule 5 cl.1(3)), and ITC notifications (Schedule 9 cl.2(2) deems ITC entitlement to be 100% if the employer fails to notify).\n\n**Who pays, who decides, and likely behaviour changes (summary)**\n\n- Who pays: employers pay the premium; insurers collect and compute it (cl.3 and Schedules 3–9). Specific contributions (dust diseases, premiums adjustment) are passed into the premium (cl.3).\n- Who decides: insurers calculate premiums using the Order’s formulas; the WorkCover Authority resolves disputes, issues guidelines and may determine wage/claims values; the Governor and Authority set certain numeric factors (Schedule 5).\n- Behaviour changes: employers will be incentivised to (a) improve safety and manage claims to lower experience components, (b) keep accurate wage/claim records and notify ITC entitlements, and (c) consider agreeing to excess repayment terms to avoid the surcharge (Schedules 4–6; Schedule 9).\n\n**Concrete trade-offs and opportunity cost**\n\n- Trade-off between fairness/risk‑sensitivity and administrative simplicity: the Order makes premiums more risk‑reflective (experience rating) at the cost of heavier administration and more complex calculations.\n- Opportunity cost: resources spent by insurers, employers and the Authority on classification disputes, record keeping and calculations could be spent on other compliance, safety or productive activities.\n\n**Selected notable rules (with section references)**\n\n- Application window: policies effective from 4 pm 30 June 2000 to 4 pm 30 June 2001 (Schedule 2 (1)).\n- Tariff base: Table A sets the basic tariff rates used in T (Schedule 3; Table A).\n- Experience link: S (Schedule 4) and E (Schedule 5) are calculated from a 2‑year insured history and claim costs (Schedules 4–5).\n- Caps and floors: cap on experience adjustment where T ≤ $112,000 (cl.3(a)); minimum premiums for category B (Schedule 7).\n- Input tax credit adjustment: Schedule 9 maps ITC entitlement bands to percent adjustments (Schedule 9 cl.1 and Table).\n\n**Bottom line**\n\nThis is a technical, year‑specific order that prescribes the formulas, tariff rates and administrative rules that insurers and employers must use to calculate workers’ compensation insurance premiums for the 2000–2001 policy year (cl.2; Schedule 2). It balances industry tariffing and employer‑specific experience rating to align premiums with risk, but does so with a sizeable compliance and classification apparatus and several administratively determined parameters (Schedules 3–5, Schedule 9)."},"summary":{"complexity_score":2,"scope_assessment":{"changed":false,"description":"Based on the available metadata, there is no evidence that the scope of this order changed from its original intent.
