to that Act.\n\nReferences to ILA s. 39B\n\nSidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided section or clause of a Schedule is amended by the insertion of one or more subsections or subclauses, the original section or clause becomes subsection or subclause (1) and is amended by the insertion of the expression \"(1)\" at the beginning of the original section or clause.\n\nInterpretation\n\nAs from 1 January 2001, amendments to section 36 of the ILA have the following effects:\n\n• Headings\n\nAll headings included in an Act which is passed on or after 1 January 2001 form part of that Act. Any heading inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. This includes headings to Parts, Divisions or Subdivisions in a Schedule; sections; clauses; items; tables; columns; examples; diagrams; notes or forms. See section 36(1A)(2A).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in an Act which is passed on or after 1 January 2001 form part of that Act. Any examples, diagrams or notes inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, form part of that Act. See section 36(3A).\n\n• Punctuation\n\nAll punctuation included in an Act which is passed on or after 1 January 2001 forms part of that Act. Any punctuation inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. See section 36(3B).\n\n• Provision numbers\n\nAll provision numbers included in an Act form part of that Act, whether inserted in the Act before, on or after 1 January 2001. Provision numbers include section numbers, subsection numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of an Act is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. It applies to anyone issued a fine by an enforcement agency (such as police, local councils, or transport authorities).\n\n**Key things the Act does:**\n\n*   **Issuing fines and warnings:** It allows authorised officers to serve an *infringement notice* (a fine) or an *official warning* (no fine) if they believe someone has committed a minor offence.\n*   **Internal review:** If you receive a fine, you can ask the agency that issued it to review the decision. You can request a review on several grounds: the fine was issued contrary to law, it was a case of mistaken identity, you have *special circumstances* (such as mental illness, serious addiction, homelessness, or being a victim of family violence that affected your ability to understand or control your conduct), or there were exceptional circumstances that excuse the behaviour.\n*   **Payment options:** If you cannot pay the full amount immediately, you can apply for a *payment plan* to pay in instalments or seek an extension of time.\n*   **Going to court:** You can choose to have the matter heard by the Magistrates' Court (or the Children's Court if you are under 18) instead of paying the fine. If you do this, any money already paid is refunded.\n*   **Expiation:** Paying the fine (or completing a *work and development permit* under the *Fines Reform Act 2014*) resolves the matter—you are not convicted of a criminal offence, and no further action can be taken.\n*   **Children:** The Act includes special protections for children. Notably, children aged 10 or 11 cannot be held responsible for infringement offences, and matters involving children are generally handled through the Children's Court system.\n\n**Why it matters:** The Act provides a streamlined, administrative way to deal with minor offences without clogging up the courts. However, it also builds in safeguards—such as internal reviews and payment plans—to ensure that vulnerable people are not unfairly punished for minor violations. It works alongside the *Fines Reform Act 2014*, which handles the enforcement of unpaid fines."}},"importantCases":[],"_links":{"self":"/api/acts/infringements-act-2006","history":"/api/acts/infringements-act-2006/history","analysis":"/api/acts/infringements-act-2006/analysis","conflicts":"/api/acts/infringements-act-2006/conflicts","importantCases":"/api/acts/infringements-act-2006/important-cases","documents":"/api/acts/infringements-act-2006/documents"}}
