It affects small and medium businesses seeking solutions, university STEM students seeking practical experience, and only incorporated trading/financial corporations are eligible to receive and administer the grant. It creates a formal federal funding route and relies on the Constitution’s corporations power; non‑corporate entities are excluded."},"flash_summary":{"complexity_score":2,"scope_assessment":{"changed":false,"description":"This instrument does not alter the statutory scope of the Industry Research and Development Act; it exercises the Act’s s33 power to prescribe a specific program (s3, s5). It specifies the constitutional basis for that prescription (s6) and sets an applicant eligibility constraint to trading/financial corporations (s7). Those are program-level choices within the Act rather than changes to the Act’s scope or objects."},"complexity_factors":["Short, self-contained instrument (7 sections) with limited procedural detail (s1–s7).","Clear legal mechanism: prescribes a program under s33 of the Industry Research and Development Act 1986 (s3, s5).","Specifies constitutional head of power relied upon (Constitution, paragraph 51(xx)) — adds a jurisdictional/legal basis (s6).","Narrow eligibility rule limits applicants to trading or financial corporations, creating a straightforward eligibility filter (s7).","Operational details (selection, funding amounts, reporting, timelines) are absent, leaving administrative discretion and implementation mechanics to be decided elsewhere."],"plain_english_summary":"This instrument formally establishes the National Innovation Games Program under the Industry Research and Development Act 1986. Mechanically, it authorises funding to a successful applicant to manage and deliver the National Innovation Games (s5(1)–(2)) and specifies the constitutional power relied on (s6). It states the program’s aim is to generate solutions to SME challenges by linking SMEs with higher‑education STEM students and graduates, and it requires applicants to be trading or financial corporations (s5(3); s7). The Commonwealth therefore funds a corporate organiser; SMEs are intended participants, not applicants."}},"importantCases":[],"_links":{"self":"/api/acts/industry-research-and-development-national-innovation-games-program-instrument-2019","history":"/api/acts/industry-research-and-development-national-innovation-games-program-instrument-2019/history","analysis":"/api/acts/industry-research-and-development-national-innovation-games-program-instrument-2019/analysis","conflicts":"/api/acts/industry-research-and-development-national-innovation-games-program-instrument-2019/conflicts","importantCases":"/api/acts/industry-research-and-development-national-innovation-games-program-instrument-2019/important-cases","documents":"/api/acts/industry-research-and-development-national-innovation-games-program-instrument-2019/documents"}}
