There is no evidence of scope creep into substantive industrial relations policy areas beyond what is necessary to implement the parent Act."},"complexity_factors":["Straightforward structure with only 4 Parts and 18 regulations","Minimal defined terms — only 3 in the interpretation section (Act, appeal, award with sub-definitions for half day and witness)","Simple conditional logic — mostly direct mandates ('is to be', 'must') rather than nested exceptions","Cross-references are explicit and point to specific sections of the parent Act without complex chains","Forms are prescribed but contained in a separate Schedule rather than embedded in the text","Only 2 penalty provisions, both with simple fine structures (not exceeding 5 penalty units)","No delegated legislation or regulation-making powers within the regulations themselves"],"plain_english_summary":"These regulations set out the practical rules for how Tasmania's industrial relations system operates day-to-day. They cover:\n\n**Who it affects:**\n- Employers and employees in Tasmania\n- Unions and employer organisations\n- The Tasmanian Industrial Commission (the body that resolves workplace disputes and sets employment conditions)\n- Inspectors who check workplaces are following the rules\n\n**What it does:**\n\n**For the Commission's work:**\n- Requires the Registrar to stamp official documents, record hearings, and keep original copies of awards and decisions\n- Sets out how parties can withdraw cases\n- Pays witnesses $32.63 per half-day (or lost wages if higher), plus travel costs\n\n**For paperwork:**\n- Specifies exactly which forms to use for different applications — from creating awards to registering unions to retiring from industrial agreements\n- Requires union registration applications to include a sworn statement (affidavit) that the details are true\n\n**For workplace inspections:**\n- Inspectors must show ID before entering workplaces and can't unreasonably interfere with work\n- Employers must keep detailed records for each worker: personal details, pay rates, hours worked, leave balances, superannuation payments, and proof they're following the relevant award or agreement\n- These records must cover the past 12 months for current staff and be kept for at least a year after the last entry\n\n**For union officials:**\n- Union officers must show identification before entering workplace premises\n\n**Why it matters:**\nThese rules ensure transparency and fairness in Tasmania's workplace relations system. The record-keeping requirements help protect workers' rights and prove employers are paying correctly. The procedural rules keep the Commission running smoothly.
