Amendments inserted since enactment (notably in 2021–2023) expanded definitions (Homes Tasmania, Homes Tasmania Act land), created an express mechanism for vesting Crown land in Homes Tasmania (s 16), imposed a statutory duty on Homes Tasmania to pursue development (s 17), and introduced a 10‑year reversion if land is not used (s 18). The Act also strengthened executive control over planning-scheme amendments (directions to the Commission, short implementation timeframes, protections from procedural invalidity in s 24, and limits on later scheme amendments without Ministerial approval in s 25). These changes shift the instrument from a narrow rezoning tool to a more comprehensive delivery mechanism that combines ownership change, rezoning override powers, and delivery timelines — materially enlarging the Act's practical scope compared with a pure rezoning/declaration power."},"complexity_factors":["Large interpretation section with many defined terms and cross-references (section 3 references multiple Acts and defined entities).","Extensive cross-references to other statutes: LUPAA, State Policies and Projects Act, Crown Lands Act, Homes Tasmania Act, Forestry Acts, and several more (throughout, e.g. ss 3, 5, 6, 7, 24–25).","Multiple conditional pathways for orders (eligibility rules in s 5; zoning inclusion conditions in s 6; planning‑requirement modifications in s 7).","Two parallel amendment tracks: Ministerial orders (ss 4, 8) and Commission implementation with tight timelines (14 days) (ss 19–20), producing operational complexity.","Detailed consultation and parliamentary scrutiny regime with staged requirements, exhibition rules, submissions, ministerial reports, and a short parliamentary disallowance window (ss 9–13).","Special procedural protections and overrides of LUPAA procedural requirements (ss 22–24) and restrictions on subsequent scheme amendments absent Ministerial approval (s 25).","Temporal limits and reversion mechanics: orders can only be made before 1 Jan 2033 (s 4(1A)) and 10‑year reversion for non‑developed vested Crown land (s 18).","Multiple decision‑makers and consent requirements causing branching logic (Minister, Commission, Homes Tasmania, Ministers for Crown Lands, and Tasmanian Development Board) (ss 5(3)–(5), 19–21).","Statutory rule status for orders and amendments (s 4(5), s 8(6), s 14(5)) adds a separate publication/legislative‑instruments dimension."],"plain_english_summary":"**What this law does (mechanics)\n\n- Empowers the Minister to make a \"housing land supply order\" declaring specified areas of government land to be \"housing supply land\" (s 4). Orders must be made before 1 January 2033 (s 4(1A)).\n\n- Only government land may be declared; certain land is excluded (e.g. reserved national parks, Wellington Park, permanent timber production and some future production forest land) and some declarations require consent (Crown land, Homes Tasmania land, or land owned by the Tasmanian Development body) (s 5(1), (3)–(5)).\n\n- A housing land supply order can also: (a) specify an \"intended zone\" (i.e. intended planning zone) for all or part of the land (s 4(2)); and (b) modify or disapply particular planning provisions, replace them with State Planning Provisions (SPPs), or otherwise alter code and standards that would apply to the land (s 4(3), s 7).\n\n- Before making a proposed order the Minister must publicly exhibit the proposal for at least 28 days, notify identified \"interested persons\" (local planning authority, utilities, adjoining owners, heritage and fire agencies, etc.), receive and consider submissions, and lay the proposed order and a report before both Houses of Parliament (ss 10–13). The Minister must include reasons and the submissions in the report (s 9(3); s 12).\n\n- Parliament has a short window (5 sitting days after a proposed order is laid) in which a House may disallow the proposed order (s 9(4)). If the Minister decides not to proceed after exhibition, the Minister must notify interested persons and publish submissions and reasons for at least 6 months (s 13A).\n\n- Once a housing land supply order specifies an intended zone or planning modifications, the Minister directs the Tasmanian Planning Commission to amend the applicable planning scheme or zoning map; the Commission must make the amendment within 14 days (or a longer period allowed by the Minister) (ss 19–20). The Minister may later amend or revoke housing land supply orders (s 8) and must notify Parliament when land ceases to be housing supply land (s 14–15).\n\n- Where Crown land becomes housing supply land it vests in Homes Tasmania (s 16). Homes Tasmania must take reasonable steps to ensure the land is used or developed for the purposes of the Homes Tasmania Act (s 17). If Homes Tasmania does not transfer or develop the land within 10 years, the Minister may transfer the land back to the Crown (s 18).\n\n- Amendments to planning schemes made under this Act are insulated from being invalidated merely because they did not follow the normal procedures in the Land Use Planning and Approvals Act (LUPAA); similarly, the Act limits further amendment of those planning-scheme changes without the Minister's permission (ss 24–25). Orders and amendments are statutory rules (ss 4(5), 8(6), 14(5)).\n\n- Regulations may be made and the Act assigns administration to the Minister for Planning and (initially) the Department of Justice until administrative arrangements change (ss 27–28).\n\n**Who it affects\n\n- The State executive: the Minister (decision‑maker) and the Tasmanian Planning Commission (implementer) (ss 4, 19–20).\n- Homes Tasmania: receives Crown land declared housing supply land and must develop or transfer it (ss 16–18).\n- Planning authorities and local councils: notified and treated as \"interested persons\" with consultation rights; their zoning maps and schemes will be amended on direction (ss 11, 19–23).\n- Owners and occupiers of adjoining or affected private land: they are \"interested persons\" for consultation and may make submissions (ss 11, 12–13).\n- Utility and infrastructure providers (water, sewer, electricity, telecommunications): may be consulted and affected by increased residential development (ss 11, 12).\n\n**Why it matters (purpose claims and practical tests)\n\n- Official purpose claim: to make government land available and ready for residential development by enabling expedited rezoning and temporary modification of planning requirements (s 4; s 9(3)(a)–(b)).\n\n- Practical trade-offs and implementation issues:\n - Speed vs scrutiny: the Commission must amend zoning/maps within 14 days of a Ministerial direction (s 19(2), s 20(2)), which speeds delivery but compresses technical review time.\n - Centralised discretion: the Minister controls declarations, intended zones, planning modifications, and permission to alter those scheme amendments later (ss 4, 6, 7, 25). That concentrates decision authority in the executive.\n - Consultation mechanics: there is mandatory public exhibition for 28 days and defined \"interested persons\" must be notified (s 12). However, Parliament's disallowance window for laid proposals is limited to 5 sitting days (s 9(4)), a tight legislative check compared with the longer public exhibition.\n - Effects on private enterprise and markets: vesting Crown land in Homes Tasmania (s 16) places initial ownership, development decisions and risk with a government entity; private developers may access new supply via sales/transfers from Homes Tasmania (s 18(1)(a) refers to transfer under the Homes Tasmania Act). The Act can alter development standards (lot sizes, parking, codes) for housing supply land (s 7), which can lower regulatory barriers to higher-density or economically different housing products — this can increase supply but also changes relative costs and competition among developers.\n - Fiscal and opportunity costs: government resources (Homes Tasmania and other agencies) will carry costs of preparing and servicing land, and using government land for housing removes that land from other potential public uses (s 5 exclusions indicate some categories are protected). If land is not developed within 10 years, the land may revert to the Crown (s 18), limiting permanent alienation without delivery.\n - Legal stability and administrative risk: amendments made under this Act are protected from invalidity for failure to follow normal LUPAA procedures (s 24), which reduces litigation risk about procedural defects but also reduces ordinary procedural safeguards.\n\n**Who pays, who decides, and what changes\n\n- Who decides: the Minister makes orders and decides amendments/revocations (ss 4, 8, 14). The Commission implements directions to amend planning documents (ss 19–23). Homes Tasmania governs development and transfers for vested Crown land (ss 16–18).\n- Who pays: government agencies (Homes Tasmania, portfolio departments) initially bear costs of land management, rezoning processes, and servicing; private developers pay to acquire transferred land or to develop it under whatever standards the order prescribes (s 18(1)(a)). Local infrastructure costs (water, sewer, transport) may be borne by government or developer depending on subsequent arrangements (s 11(c) identifies infrastructure authorities as \"interested\").\n- Behaviour change: centralising the rezoning and planning‑modification power encourages faster conversion of government land to residential uses, reduces the role of usual planning amendment processes for those parcels, and channels development through Homes Tasmania where Crown land is involved (ss 4, 16, 20, 25)."},"kimi_summary":{"content_quality":"ok","complexity_score":6,"scope_assessment":{"changed":true,"description":"The original 2018 Act focused on facilitating housing development on government land through planning scheme modifications. The scope expanded significantly through amendments: (1) 2021 amendments broadened 'government land' to include Tasmanian Development Act land and added detailed consultation requirements; (2) 2022 amendments fundamentally restructured Part 3, replacing the original provisions about 'Housing Land Supply Agreements' with a new regime vesting land directly in Homes Tasmania (established by the 2022 Act) and imposing mandatory development obligations; (3) 2023 amendments added a sunset clause (1 January 2033) and clarified validity of pre-amendment orders. It essentially allows the Minister to override normal planning rules to get homes built faster.\n\n**Who it affects:**\n\n- **Homes Tasmania** (the state's public housing agency) — gains ownership of Crown land declared as \"housing supply land\" and must develop it for housing\n- **Local councils and planning authorities** — lose some control over planning decisions; the Tasmanian Planning Commission must follow Ministerial directions to change zoning maps\n- **Neighbours and local communities** — can make submissions during a 28-day consultation period, but Parliament only has 5 sitting days to disallow an order\n- **Government agencies** — must consent if the Minister wants to use their land\n\n**How it works:**\n\n1. The Minister identifies **government land** (Crown land, Homes Tasmania land, or land owned by the Tasmanian Development body) that is suitable for housing\n2. The Minister makes a **housing land supply order** declaring the land as \"housing supply land\" — this can include:\n - A new **intended zone** (rezoning the land for residential use)\n - **Modifications to planning rules** (like changing lot sizes, parking requirements, or permit requirements)\n3. The order goes through a **28-day public exhibition** and consultation with \"interested persons\" (councils, utilities, neighbours, heritage bodies, etc.)\n4. The Minister lays the order before Parliament, which can **disallow it within 5 sitting days**\n5. Once made, the order triggers automatic changes to the planning scheme — the Planning Commission **must** amend zoning maps within 14 days\n6. **Crown land automatically vests in Homes Tasmania**, which has 10 years to develop it or it may revert to the Crown\n\n**Key safeguards and limits:**\n\n- Land must be near services, transport and employment (except on Flinders Island)\n- Cannot be national parks, nature reserves, or timber production forests\n- Must be consistent with State Policies and regional planning strategies\n- Cannot create significant land use conflicts\n- Special rules apply for Flinders Island (different zones allowed, no public transport requirement)\n\n**Why it matters:**\n\nThis law prioritises housing supply over local planning control. It streamlines development by letting the Minister effectively rewrite planning schemes for specific parcels of government land, bypassing the usual lengthy planning approval processes. The 2033 sunset clause (inserted in 2023) means no new orders can be made after that date."},"issue_detection":{"absurdities":[],"contradictions":[]},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
