or\n(B) if that day falls on a Sunday—the following\nTuesday;\n(xiii) 26 December (Boxing Day) and—\n(A) if that day falls on a Saturday—the following\nMonday; or\n(B) if that day falls on a Sunday—the following\nTuesday; and\n(b) any other day, or a part of any other day, that the Minister\ndeclares to be a public holiday in the ACT, or in a part of the\nACT stated in the declaration, is a public holiday in the ACT\nor that part of the ACT.\n(2) If the Minister considers it is appropriate that a day mentioned in\nsubsection (1) (a) should not, in a particular year, be a public\nholiday in the ACT, the Minister may declare that the day is not, in\nthat year, a public holiday.\n(3) A declaration under subsection (1) (b) or (2) is a notifiable\ninstrument.\nNote A notifiable instrument must be notified under the Legislation Act.\n(4) A declaration under subsection (2) in relation to a day must be\nnotified under the Legislation Act not later than 1 week before the\nday.\n(5) If a person who is entitled under a modern award to a holiday on a\nweekday following a substituted public holiday and the weekday is\nnot a public holiday under this Act, the substituted public holiday is\nnot a public holiday for the person under this Act.\n\nSection 4\npage 4 Holidays Act 1958\nEffective: 01/01/18\nR11\n01/01/18\nAuthorised by the ACT Parliamentary Counsel—also accessible at www.legislation.act.gov.au\n(6) In this section:\nmodern award—see the Fair Work Act 2009 (Cwlth), part 2-3.\nsubstituted public holiday means a day that is a public holiday\nbecause another day mentioned in subsection (1) (a) is a Saturday or\nSunday.\n4 Bank holidays\n(1) Subject to subsection (2)—\n(a) any day, or part of a day, that in any year is a public holiday in\nthe ACT or a part of the ACT under section 3 is a bank holiday\nin the ACT or that part of the ACT;
