Short title\nThis Act may be cited as the Help to Buy\n(Commonwealth Powers) Act 2026.\n\nHelp to Buy (Commonwealth Powers) Act 2026\nAct No. of 2026\ns. 2\n4\n2. Commencement\nThis Act commences on the day on which this\nAct receives the Royal Assent.\n3. Adoption of versions of Commonwealth Help to\nBuy Act\n(1) The following versions of the Commonwealth\nHelp to Buy Act are adopted within the meaning\nof section 51(xxxvii) of the Constitution of the\nCommonwealth:\n(a) the primary version;\n(b) the residual version.\n(2) The operation of each paragraph of\nsubsection (1) is not affected by the other\nparagraph.\n(3) The adoption of a version of the Commonwealth\nHelp to Buy Act has effect for a period –\n(a) beginning when subsection (1) comes\ninto operation; and\n(b) ending at the end of the day fixed under\nsection 7(1)(a) or (b) for that version.\n5. Commonwealth laws not otherwise affected\nTo avoid doubt, it is the intention of the\nParliament of the State that the Commonwealth\nHelp to Buy Act may be expressly amended, or\nhave its operation otherwise affected, at any time\nafter the commencement of section 4 –\n(a) by a provision of a Commonwealth Act\nthe operation of which is based on\nlegislative power that the Parliament of\n\nHelp to Buy (Commonwealth Powers) Act 2026\nAct No. of 2026\ns. 6\n8\nthe Commonwealth has apart from under\nthe amendment reference; and\n(b) by a provision of an instrument made\nunder the Commonwealth Help to Buy\nAct or under a provision referred to in\nparagraph (a).\n6. Amendment reference\n(1) The amendment matters are referred to the\nParliament of the Commonwealth, but only to\nthe extent of making laws with respect to those\nmatters by making express amendments to the\nCommonwealth Help to Buy Act.\n(2) The reference in subsection (1) to making laws\ndoes not include making a law that would have\nthe effect of –\n(a) giving Housing Australia, after a State\nstops being a participating State, the\nfunction of entering into, or the power to\nenter into, shared equity arrangements\nthat relate to residential property located\nin the State; or\n(b) substantively removing or overriding –\n(i) a provision of the\nCommonwealth Help to Buy Act\nthat requires approval of the State\nbefore certain things are done; or\n(ii) section 41, 41A or 42 of the\nCommonwealth Help to Buy Act.\n\nHelp to Buy (Commonwealth Powers) Act 2026\nAct No. of 2026\ns. 7\n9\n(3) The reference of a matter under subsection (1)\nhas effect only –\n(a) if and to the extent that the matter is not\nincluded in the legislative powers of the\nParliament of the Commonwealth,\notherwise than by a reference for the\npurposes of section 51(xxxvii) of the\nConstitution of the Commonwealth; and\n(b) if and to the extent that the matter is\nincluded in the legislative power of the\nParliament of the State.\n(4) The amendment reference has effect for a\nperiod –\n(a) beginning when subsection (1) comes\ninto operation; and\n(b) ending at the end of the day fixed under\nsection 7(1)(c).\n7. Termination of adoption and amendment reference\n(1) The Governor may, at any time, by proclamation\npublished in the Gazette, fix a day as the day on\nwhich –\n(a) the adoption of any or all of the primary\nversion is to terminate; or\n(b) the adoption of any or all of the residual\nversion is to terminate; or\n(c) the amendment reference is to terminate.\n\nHelp to Buy (Commonwealth Powers) Act 2026\nAct No. of 2026\ns. 8\n10\n(2) The Governor, by proclamation published in the\nGazette, may revoke a proclamation published\nunder subsection (1), in which case the revoked\nproclamation is taken, for the purposes of section\n4 or 6, never to have been made and published.\n(3) A revoking proclamation made under\nsubsection (2) has effect only if made and\npublished before the day fixed under\nsubsection (1) in the proclamation being so\nrevoked.\n(4) The revocation of a proclamation published\nunder subsection (1) does not prevent the\nmaking and publication of a further proclamation\nunder that subsection.\n8. Effect of termination of amendment reference\nbefore termination of adoption of primary version\nor residual version\n(1) If the amendment reference terminates before the\nadoption of the primary version is terminated,\nthe termination of the amendment reference does\nnot affect –\n(a) laws that were made under that reference\nbefore that termination, whether or not\nthey have come into operation before that\ntermination; or\n(b) the continued operation in the State of\nthe Commonwealth Help to Buy Act as\nin operation immediately before that\ntermination or as subsequently amended\nor affected by –\n\nHelp to Buy (Commonwealth Powers) Act 2026\nAct No. of 2026\ns. 8\n11\n(i) laws referred to in paragraph (a)\nthat come into operation after that\ntermination; or\n(ii) provisions referred to in\nsection 5.\n(2) Accordingly, if the amendment reference\nterminates, it continues to have effect for the\npurposes of subsection (1) unless the adoption of\nthe primary version is also terminated.\n(3) If the amendment reference terminates before the\nadoption of the residual version is terminated,\nthe termination of the amendment reference does\nnot affect –\n(a) laws that were made under that reference\nbefore that termination, whether or not\nthey have come into operation before that\ntermination; or\n(b) the continued operation in the State of\nthe Commonwealth Help to Buy Act as\nin operation immediately before that\ntermination or as subsequently amended\nor affected by –\n(i) laws referred to in paragraph (a)\nthat come into operation after that\ntermination; or\n(ii) provisions referred to in\nsection 5.\n(4) Accordingly, if the amendment reference\nterminates, it continues to have effect for the\n\nHelp to Buy (Commonwealth Powers) Act 2026\nAct No. of 2026\ns. 9\n12\npurposes of subsection (3) unless the adoption of\nthe residual version is also terminated.\n9. Declaring certain matters to be excluded matters\n(1) The following matters are declared to be\nexcluded matters for the purposes of section 41A\nof the Commonwealth Help to Buy Act in\nrelation to the Help to Buy program:\n(a) the pre-completion duty concession\nunder Division 2C of Part 5 of Chapter 2\nof the Duties Act 2001;\n(b) the first home buyer duty exemption\nunder Division 2 of Part 6 of Chapter 2\nof the Duties Act 2001;\n(c) the first home owner grant scheme under\nthe First Home Owner Grant Act 2000;\n(d) a scheme, program or arrangement,\nwhether temporary or otherwise, relating\nto the purchase of land that –\n(i) provides financial assistance to\nindividuals towards the purchase\nof residential property; and\n(ii) is operated by, or on behalf of,\nthe State or Homes Tasmania,\nwithin the meaning of the Homes\nTasmania Act 2022;\n(e) any other matter prescribed as an\nexcluded matter;\n\nHelp to Buy (Commonwealth Powers) Act 2026\nAct No. of 2026\ns. 10\n13\n(f) the administration and governance,\nincluding by the exercise of compliance\nfunctions, of the concessions,\nexemptions, schemes, programs,\narrangements or other matters referred to\nin this subsection.\n(2) The declaration of a matter to be an excluded\nmatter under subsection (1) for the purposes of\nsection 41A of the Commonwealth Help to Buy\nAct applies only to the extent to which the\nexcluded matter would, but for this section, be\ninconsistent with the Commonwealth Help to\nBuy Act in relation to the Help to Buy program.\n10. State’s objection to matters\n(1) In this section –\nCommonwealth Minister means the Minister\nreferred to in section 46 of the\nCommonwealth Help to Buy Act.\n(2) For the purposes of section 46(1) of the\nCommonwealth Help to Buy Act, the Minister\non behalf of the State, by notice given to the\nCommonwealth Minister during either the\nminimum consultation period or the extended\nconsultation period, may object to a matter for\nthe purposes of the Commonwealth Help to Buy\nAct.\n(3) After giving notice to the Commonwealth\nMinister under subsection (2), the Minister is to\nensure the notice is published in the Gazette as\nsoon as is practicable.\n\nHelp to Buy (Commonwealth Powers) Act 2026\nAct No. of 2026\ns. 10\n14\n(4) A notice under subsection (2) is to be taken as\nconstituting the State’s objection to a matter for\nthe purposes of the Commonwealth Help to Buy\nAct.\n(5) The Minister on behalf of the State, by notice\ngiven to the Commonwealth Minister, may\nwithdraw an objection to a matter under\nsubsection (2).\n(6) After giving notice to the Commonwealth\nMinister under subsection (5), the Minister is to\nensure the notice is published in the Gazette as\nsoon as is practicable.\n(7) A notice under subsection (5) is to be taken as\nconstituting the State’s withdrawal of an\nobjection to a matter for the purposes of the\nCommonwealth Help to Buy Act.\n(8) For the purposes of section 46(4) of the\nCommonwealth Help to Buy Act, the Minister\non behalf of the State, by notice given to the\nCommonwealth Minister during the minimum\nconsultation period, may require an additional\n15 business days to consider a matter for the\npurposes of the Commonwealth Help to Buy\nAct.\n(9) After giving notice to the Commonwealth\nMinister under subsection (8) –\n(a) the Minister is to ensure the notice is\npublished in the Gazette as soon as is\npracticable; and\n\nHelp to Buy (Commonwealth Powers) Act 2026\nAct No. of 2026\ns. 11\n15\n(b) the extended consultation period applies\nfor the purposes of giving notice to the\nCommonwealth Minister under\nsubsection (2).\n(10) The validity of a notice given to the\nCommonwealth Minister under this section is\nnot affected by a failure to publish the notice in\nthe Gazette.\n11. The inclusion of excluded matters, a formal objection/consultation route for the State, termination and saving provisions, and consequential State tax/grant amendments are mechanisms necessary to implement that core function in practice (ss 4, 6, 7–10, Schedule 1). In short, the Bill does not appear to grow materially beyond that original functional purpose; rather, it builds the procedural, protective and consequential architecture needed to make the adoption and amendment reference operable within Tasmania’s legal and fiscal systems."},"complexity_factors":["Multiple definitions and layered defined terms in s 3 (e.g. 'amendment matters' with four subparagraphs, 'express amendment', 'primary version', 'residual version', cross‑defined terms from the Commonwealth Act).","Adoption of two different versions of the Commonwealth Act (primary and residual) with different excluded Divisions and sections (s 4; s 3 definitions of primary/residual).","Reference of power limited to 'express amendments' only, and further qualified by negative exceptions (s 6(1)–(3)).","Cross‑references to multiple specific Commonwealth Help to Buy Act provisions (ss 41, 41A, 42, 46) and reliance on Commonwealth consultation mechanics (s 10).","Termination and revocation mechanics with interlocking effects between adoption and amendment reference and transitional saving rules (ss 7–8).","Declaration of 'excluded matters' that operate only to the extent of inconsistency, and list that includes tax concessions and grant schemes plus their administration (s 9).","Consequential amendments across several Tasmanian Acts and a Regulation (Duties Act, FHOG Act and Regs, Land Tax Act) changing tax/eligibility rules (Schedule 1).","Delegation and regulation power allowing details to be set by regulation or Ministerial determination (s 11), increasing administrative discretion.","Procedural requirements for objections/withdrawals and Gazette publication with a non‑fatality clause (s 10(10))."],"plain_english_summary":"**What this law does (mechanically)\n\n- Adopts the Commonwealth Help to Buy Act 2024 into Tasmanian law in two specified forms called the \"primary version\" and the \"residual version\" (so that those Commonwealth provisions operate in Tasmania by adoption under section 51(xxxvii) of the Constitution) (see s 4). \n\n- Refers to the Commonwealth Parliament the State's power to allow the Commonwealth to make express amendments (i.e. direct textual amendments) to the Commonwealth Help to Buy Act in relation to certain \"amendment matters\" — namely Commonwealth financial assistance schemes that help individuals buy a home for residential property in Tasmania, plus related entering-into, administration and compliance tasks (s 3 definition of \"amendment matters\" and s 6(1)). The reference is limited to express amendments of the Commonwealth Act (s 3: \"express amendment\") and operates only while the amendment reference is in force (s 6(4)).\n\n- Places express limits on what the Commonwealth may do under that amendment reference. The Commonwealth cannot, by using the reference, give Housing Australia new post‑participation powers to enter shared‑equity arrangements in Tasmania, nor can it remove or override State approval requirements or certain specified Commonwealth sections (s 6(2)).\n\n- Lets the Governor end (by proclamation) the adoption of the primary or residual versions, and/or end the amendment reference; provides rules for revoking proclamations and for what happens when the amendment reference ends before adoption ends (ss 7–8).\n\n- Declares a set of State programs and tax concessions (for example, certain duty concessions, the First Home Owner Grant, or other State programs operated by or for the State or Homes Tasmania) to be \"excluded matters\" so far as they would be inconsistent with the Commonwealth Help to Buy Act for the Help to Buy program; the exclusion also covers administration and compliance of those State schemes (s 9).\n\n- Gives the State a formal process to object to Commonwealth matters under the Commonwealth Act and to request an extra 15 business days of consultation; objections and requests are given by the Tasmanian Minister to the Commonwealth Minister and published in the Gazette (s 10).\n\n- Makes consequential changes to Tasmanian legislation so Help to Buy arrangements are accommodated: the Duties Act 2001, First Home Owner Grant Act 2000 (and Regulations), and Land Tax Act 2000 are amended so that where land is bought under a Help to Buy arrangement the Commonwealth or Housing Australia’s interest in the land is ignored for the purpose of assessing duty, certain grants, first home owner eligibility, and land tax (Schedule 1).\n\n- Provides for regulations and assigns administration to the Minister for Housing and Planning and the Department of State Growth until administrative arrangements are otherwise made (ss 11–12).\n\nWho this affects\n\n- Individuals who enter \"Help to Buy\" arrangements (home buyers) in Tasmania — they are affected because the Bill (together with the Commonwealth Act as adopted) governs the availability of Commonwealth financial assistance for buying residential property and how State taxes and grants apply to such purchases (Schedule 1; s 3 definitions). \n\n- The Commonwealth and Housing Australia — because the Bill authorises the Commonwealth’s Help to Buy Act to operate in Tasmania (s 4) and allows the Commonwealth to make express amendments in specified areas (s 6), subject to limits.\n\n- The Tasmanian Government and its agencies (Homes Tasmania, State Revenue authorities, Department of State Growth) — because the Bill changes which State programs are treated as excluded matters (s 9), creates obligations about consultation and objection (s 10), and amends State tax and grant laws (Schedule 1).\n\n- Property sellers, conveyancers, and tax officers — because duty and land tax assessments are altered where a Help to Buy arrangement applies (Schedule 1).\n\nWhy it matters (official purpose and practical effects)\n\n- The stated object is to make the Commonwealth Help to Buy Act apply in Tasmania and to allow the Commonwealth to make future express amendments in narrowly defined areas (longer‑run legislative coordination). That mechanically transfers some legislative control over the detailed operation of Help to Buy financial assistance to the Commonwealth for the matters referred (s 4, s 6).\n\n- Practically, the Bill changes who is treated as having an interest in land for State tax and grant purposes: the Commonwealth or Housing Australia’s financial interest under a Help to Buy arrangement is to be ignored when calculating duty, First Home Owner Grant eligibility, and land tax (Schedule 1). That alters tax bases and eligibility tests (Schedule 1, inserted sections 32, 53A, 11A; amendments to First Home Owner Grant Act s 5(2A)).\n\nTesting the official rationale against trade‑offs, incentives and risks (mechanisms, with citations)\n\n- Who pays: Financial assistance is provided by the Commonwealth under Help to Buy arrangements (s 3 definition of \"amendment matters\"). The Bill shifts some regulatory and legislative control over those arrangements to the Commonwealth (s 6) while the State retains operational levers such as the ability to object during consultation and to require extra consultation time (s 10). The State also changes how State taxes and grants treat Commonwealth/Housing Australia interests (Schedule 1). The immediate fiscal effect is that certain State tax assessments will ignore the Commonwealth/Housing Australia interest in land (Schedule 1), which can reduce State tax/revenue collected on affected transactions.\n\n- Who decides: The Commonwealth Parliament can make express amendments to the Commonwealth Act in respect of the referred matters while the amendment reference runs (s 6). The Tasmanian Minister can object to proposed Commonwealth changes during consultation and can ask for an extra 15 business days (s 10). The Governor can terminate the adoptions or reference by proclamation (s 7).\n\n- Behavioural incentives and private choice: Buyers who participate in Help to Buy arrangements will face different tax and grant treatments (Schedule 1). Ignoring Commonwealth/Housing Australia interests for duty and land tax assessment changes effective tax liabilities and may change the attractiveness of entering Help to Buy arrangements compared with conventional purchase/finance.\n\n- Compliance and administrative burden: The State must publish objection/withdrawal notices in the Gazette and coordinate with Commonwealth consultation processes (s 10). The Bill also requires consequential operational changes by State revenue and housing agencies (Schedule 1), and allows regulations to delegate or to specify administrative detail to the Minister or other persons (s 11).\n\n- Limits, safeguards and opportunity costs: The amendment reference is limited to express amendments of the Commonwealth Help to Buy Act (s 3 \"express amendment\"; s 6(1)) and excludes certain powers the Commonwealth cannot acquire under the reference (s 6(2)). The State retains the power to end the adoption or the amendment reference (ss 7–8). However, while the adoption remains in force the Commonwealth Act (as adopted and as amended under the reference or other Commonwealth power—see s 5) will continue to operate in Tasmania; that can change the substantive legal environment in Tasmania without separate State legislation (ss 4–6, 8). The State’s ability to object provides a procedural check but not an absolute veto (s 10).\n\n- Concentrated benefits and diffuse costs: Benefit flows primarily to participants in Help to Buy arrangements (home buyers) and to the Commonwealth for administering a nationally uniform scheme. The costs (reduced duties/land tax revenue and administration changes) fall to the State’s revenue base and to the agencies that must implement the changes (Schedule 1; ss 11–12). The Bill contains a specific mechanism to protect some State programs by declaring them excluded matters where they would conflict with the Commonwealth Act (s 9).\n\nKey operational points to watch (implementation risks)\n\n- Interaction between State‑declared excluded matters and the Commonwealth Act: the Bill declares a number of State concessions and grants to be \"excluded matters\" to resolve inconsistencies (s 9), but that relies on careful mapping between State schemes and the Commonwealth Help to Buy program.\n\n- Revenue accounting: Schedule 1 changes to duty and land tax assessment rules mean transactions under Help to Buy arrangements will be treated differently for State revenue purposes. Agencies will need clear guidance and system changes to apply those rules consistently.\n\n- Temporal complexity: The Bill allows adoption and amendment reference to be ended separately and provides transitional rules about what happens to laws made under the reference if it ends (ss 7–8). That creates sequencing issues if the State later wishes to resume control.\n\nRelevant sections cited above: sections 3–13, Schedule 1 (Duties Act 2001, First Home Owner Grant Act 2000 and Regulations, Land Tax Act 2000).\n"},"summary":{"status_summary":"The Help to Buy (Commonwealth Powers) Bill 2026 has been introduced in the Tasmanian House of Assembly and is awaiting further parliamentary consideration.","complexity_score":7,"likely_questions":["How does this bill affect my ability to get the First Home Owner Grant if I use the Help to Buy scheme?","Can Tasmania cancel its participation in the Help to Buy scheme after this bill becomes law?","What parts of the Commonwealth Help to Buy Act are not adopted in Tasmania?","Does this bill guarantee that the Help to Buy scheme will be available to all Tasmanian buyers?","Are there any additional costs to the state government from this referral of power?"],"complexity_factors":["Referral of state legislative power to the Commonwealth under section 51(xxxvii) of the Constitution","Adoption of two separate versions of a Commonwealth Act with specific exclusions","Mechanisms for termination of adoption and amendment reference via proclamation","Interaction between state declaration of excluded matters and Commonwealth Act","Consequential amendments to duty, first home owner grant, and land tax legislation requiring careful treatment of Crown interests"],"plain_english_summary":"This Bill is a procedural vehicle that lets the Commonwealth Help to Buy scheme operate in Tasmania by adopting specified versions of the Commonwealth Act and referring amendment power to the Commonwealth.
