The Commonwealth gets its money back later, plus a share of any increase in the property's value.\n\n### How it works\nThe State refers three bundles of power to the Commonwealth under **section 51(xxxvii)** of the Constitution (the \"referral of powers\" provision):\n- **Primary matters**: Creating the main scheme rules\n- **Residual matters**: Administering the scheme after a State leaves\n- **Amendment matters**: Allowing the Commonwealth to update the law in the future\n\n### Who it affects\n- **Home buyers**: Can apply for government equity contributions to buy homes\n- **States**: Can choose their level of participation:\n - **Participating State**: Full scheme operates (new buyers can enter)\n - **Cooperating State**: No new entrants, but existing deals continue to be managed\n - **Withdrawn State**: State has fully exited; only existing contracts are wound down\n- **Housing Australia**: The agency that runs the scheme, enters contracts, and manages investments\n\n### Why it matters\nWithout this referral, the Commonwealth might lack constitutional power to run housing assistance schemes in some States.
