They act as a 'plug-in' to the Heavy Vehicle National Law (HVNL), which is a scheme where all Australian states and territories (except WA and NT) use the same base rules for trucks and buses, but each state passes its own local regulations to fill in gaps and make specific adjustments.\n\n**Key things this legislation does:**\n\n*   **Modifies national vehicle standards for Tasmania:** It exempts Tasmanian buses from a specific national rule about vehicle standards (Division 16 of Part 6 of Schedule 2). It also gives a grandfathering exemption for older heavy vehicles (registered before these rules started) with unusual exhaust systems—specifically those with front-mounted exhausts that extend to the edge of the bodywork, or tractors with vertical front exhausts higher than the driver.\n\n*   **Sets rules for weighing trucks:** It tells authorised officers exactly how they can weigh heavy vehicles to check if they're overloaded—using weighbridges or portable scales, and measuring individual wheels, axles, or the whole vehicle. It also clarifies that minor unevenness in wheel alignment (less than 150mm) doesn't invalidate the weighing.\n\n*   **Lists infringement notice offences:** It provides a detailed table of which offences under the Heavy Vehicle National Law and related national regulations can be dealt with by an infringement notice (a fine on the spot, like a speeding ticket) rather than going to court. This covers everything from vehicle safety breaches, overloading, and fatigue management violations to accreditation breaches.\n\n*   **Cleans up old laws:** It rescinds (repeals) five previous sets of regulations from 2014, 2016, and 2018, consolidating them into this single instrument.\n\n**Who it affects:**\n\n*   Truck drivers and operators in Tasmania\n*   Bus operators in Tasmania\n*   Heavy vehicle inspectors and authorised officers\n*   Anyone involved in the 'chain of responsibility' for heavy vehicle safety (schedulers, consignors, etc.)\n\n**Why it matters:**\n\nThis legislation ensures Tasmania's heavy vehicle rules align with national standards while preserving specific local exemptions. The grandfathering clause for exhaust systems protects owners of older vehicles from having to make expensive retrofits. The infringement notice schedule is crucial because it determines which violations result in immediate fines versus court proceedings, affecting enforcement practices and compliance costs for the transport industry."}},"importantCases":[],"_links":{"self":"/api/acts/heavy-vehicle-national-law-tasmania-regulations-2023","history":"/api/acts/heavy-vehicle-national-law-tasmania-regulations-2023/history","analysis":"/api/acts/heavy-vehicle-national-law-tasmania-regulations-2023/analysis","conflicts":"/api/acts/heavy-vehicle-national-law-tasmania-regulations-2023/conflicts","importantCases":"/api/acts/heavy-vehicle-national-law-tasmania-regulations-2023/important-cases","documents":"/api/acts/heavy-vehicle-national-law-tasmania-regulations-2023/documents"}}
