It narrowly permits this single motor for that purpose despite normal Australian energy‑efficiency and labelling rules, allowing necessary equipment repair where a compliant substitute is impractical."},"flash_summary":{"complexity_score":2,"scope_assessment":{"changed":true,"description":"The instrument narrows the operational scope of the referenced Determination by removing its application to the named motor model for the specified replacement use (Schedule, Part 1 cls 1–3). Practically, those supplying or using that motor for the stated replacement at Simplot’s Ulverstone plant are not required to meet the GEMS energy‑use/testing and labelling/testing obligations (Schedule, Part 1 cl 2). The exemption was made by the GEMS Regulator under ss 37(1)–(2) of the Act (instrument preamble); the absence of conditions (Schedule, Part 1 cl 4) shifts compliance burdens away from the supplier/manufacturer and rests discretion and accountability with the Regulator’s instrument."},"complexity_factors":["Very narrow, single-model scope (Schedule, Part 1 cl 1).","Limited to a single, named supply/use at one plant (Schedule, Part 1 cl 3).","Exempts from two specific Determination requirements: GEMS level (s 6) and labelling (s 7) (Schedule, Part 1 cl 2).","Legal authority is a single provision of the Act: subsections 37(1) and (2) (instrument heading and signature block).","Cross-references to external definitions and the Three Phase Cage Induction Motors Determination create dependency but little interpretive complexity (see instrument cl 3 and note).","No conditions are attached, which reduces ongoing compliance and monitoring complexity (Schedule, Part 1 cl 4)."],"plain_english_summary":"This instrument exempts one specific electric motor model (JM Aerofoil, 90JM25/4/9/30, 13.2 kW) from the GEMS energy‑use/testing and labelling/testing requirements in the Three Phase Cage Induction Motors Determination, but only for replacement supplies in the spiral freezing tunnel at Simplot Australia Pty Ltd’s Ulverstone plant.
