LEGISLATION ACT 1984 (ILA)\n\nStyle changes\n\nSection 54A of the ILA authorises the making of the style changes set out in Schedule 1 to that Act.\n\nReferences to ILA s. 39B\n\nSidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided section or clause of a Schedule is amended by the insertion of one or more subsections or subclauses, the original section or clause becomes subsection or subclause (1) and is amended by the insertion of the expression \"(1)\" at the beginning of the original section or clause.\n\nInterpretation\n\nAs from 1 January 2001, amendments to section 36 of the ILA have the following effects:\n\n• Headings\n\nAll headings included in an Act which is passed on or after 1 January 2001 form part of that Act. Any heading inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. This includes headings to Parts, Divisions or Subdivisions in a Schedule; sections; clauses; items; tables; columns; examples; diagrams; notes or forms. See section 36(1A)(2A).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in an Act which is passed on or after 1 January 2001 form part of that Act. Any punctuation inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. See section 36(3B).\n\n• Provision numbers\n\nAll provision numbers included in an Act form part of that Act, whether inserted in the Act before, on or after 1 January 2001. Provision numbers include section numbers, subsection numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of an Act is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. Through amendments in 2021, 2025, and 2026, the Act has grown to include: a comprehensive land management planning hierarchy (statements of obligations, land management plans, and land management strategies); a dedicated Trust Account with specific funding and investment rules; detailed mechanisms for transferring land management from Parks Victoria and other committees; specific Reservation Order powers to change Crown land purposes; and complex staff transfer provisions. It establishes the **Great Ocean Road Coast and Parks Authority** (a new government body) to protect and manage the public land, coasts, and parks along the route, and sets up a 50-year planning framework to balance conservation, tourism, and local community needs.\n\n**Who it affects**\n\n* **Visitors and locals:** Anyone using the Great Ocean Road, coastal parks, or surrounding areas.\n* **Traditional Owners:** The Eastern Maar and Wadawurrung peoples, whose rights and cultural heritage are formally recognised and must be included in all planning.\n* **Local councils and agencies:** Surf Coast, Colac Otway, Corangamite, Moyne, and Warrnambool councils, plus water corporations, Parks Victoria, and other \"responsible entities\" must follow the strategic plan.\n* **Land managers:** The Authority gradually takes over management of specific national parks, marine sanctuaries, and Crown land (public land) listed in the Act.\n\n**What it does in practice**\n\n* **Creates three zones:**\n * The **Great Ocean Road region** (the broad area).\n * The **coast and parks** (public land managed by the Authority).\n * The **scenic landscapes area** (land visible from the road or coast, subject to strict planning controls).\n* **Sets protection principles:** Decision-makers must follow rules covering environmental protection, Aboriginal inclusion, social values (like public access), and economic sustainability.\n* **Requires a 50-year strategic plan:** The Minister must prepare a long-term **Great Ocean Road strategic framework plan** that guides development, protects settlement boundaries, and manages visitor numbers. This plan is binding on government agencies.\n* **Establishes the Authority:** The Authority manages the land, develops visitor facilities, handles fire and emergency agreements, and maintains a special bank account (the Great Ocean Road Coast and Parks Account) funded by fees, grants, and land sales.\n* **Protects Aboriginal rights:** The Act explicitly states it cannot reduce native title rights or Aboriginal heritage protections. Traditional Owners must be involved in policy development and land management.\n* **Transfers land:** Specific parks (like Port Campbell National Park and parts of Great Otway National Park) and Crown land parcels are scheduled to transfer to the Authority's control by November 2025.\n* **Creates detailed planning layers:** The Authority must prepare **land management plans** for specific sites, a broader **land management strategy**, and comply with **statements of obligations** issued by the Minister.\n\n**Why it matters**\n\nThe Act treats the Great Ocean Road as a single, integrated natural and cultural entity rather than a collection of separate parks and roads. It ensures that development, tourism growth, and infrastructure decisions are made with a 50-year view, protecting the area's environmental and scenic values while respecting the deep connection of Traditional Owners to Country."},"flash_summary_failed":{"failed":true,"reason":"A positive credit balance is required for all requests, including BYOK, so fallback providers remain available.
