Boards may make by‑laws setting either a single‑term amount or a multiple‑term amount. The regulation limits those amounts:\n  - single‑term: between $50 and $500 (applies to one electoral cycle only);\n  - multiple‑term: between $500 and $5,000 (applies to all electoral cycles covered by the by‑law) and must be paid as a lump sum (sec.5).\n  - If a board has not made a by‑law, the default electoral eligibility amount is $50 per electoral cycle (sec.6).\n\n- Prescribes the procedure for board elections (timing, roll, nominations, voting and result procedures):\n  - Elections must be held at least 3 months before the end of the current elected members’ terms (sec.7).\n  - The secretary must prepare, sign and date a roll of electors containing only eligible persons (sec.8).\n  - The secretary must give eligible electors written notice of nomination details and the election (except where an eligible person’s address has been removed from the donor register under the Act); notice must be given at least 21 days before nominations close and at least 2 months before the election (sec.9).\n  - Candidates must be eligible under the Act and be nominated in writing by at least 2 eligible persons; nominations must be signed and received by the secretary by the nomination day and time (sec.10).\n  - If 3 or fewer candidates are nominated, no vote is needed and they are taken to be elected unopposed (sec.11).\n  - If more than 3 candidates are nominated, the secretary must run a vote. The secretary must send ballots at least 21 days before the election to eligible electors (except where their address has been removed) listing candidates in an order drawn by lot; ballots must include voting instructions (secs.12–13).\n  - The secretary must keep votes secure and organise counting in the presence of at least 2 witnesses; formal votes are accepted, informal votes rejected unless the secretary considers voter intention clear (secs.14–15).\n  - The three candidates with the highest number of votes are elected. Ties that affect which of the top three are elected are resolved by a draw, with a specified procedure for writing and drawing names in the presence of 2 witnesses (sec.16).\n  - The board must pay reasonable election expenses incurred by the secretary (sec.17).\n  - After the election, the secretary must notify the board in writing and must, as soon as practicable after appointment, notify eligible persons, publish the result, or announce it at a board meeting to which eligible persons have been invited (sec.18).\n\nWho this affects\n\n- Grammar school boards: must follow the procedures and pay reasonable election expenses (secs.7, 17).\n- School secretaries: run the elections, keep the roll, provide notices and ballots, secure and count votes, and report results (secs.8–16, 18).\n- Donors: must provide a current email or postal address to appear on the donor register (sec.4); donors who wish to gain electoral eligibility (to nominate or vote) may need to make a donation within the regulated minimal and maximal amounts (secs.5–6).\n- Eligible electors and prospective candidates: subject to the nomination and voting rules (secs.9–10, 12–16).\n\nWhy it matters (stated purpose and practical trade‑offs)\n\n- The regulation operationalises parts of the Grammar Schools Act by prescribing concrete administrative rules: what donor contact details are kept (for communication and roll-building), upper and lower bounds on donation amounts that confer electoral eligibility, and a step‑by‑step election process (secs.4–6 and 7–18).\n\n- Costs and incentives: the regulation shifts administrative and modest financial costs to boards (must pay election expenses (sec.17)) and to donors who choose to buy electoral eligibility (donation thresholds in secs.5–6). A donor who pays a multiple‑term amount pays a larger up‑front cost but obtains eligibility for repeated electoral cycles (sec.5). A donor who pays a single‑term amount faces a lower cost but eligibility only for the next election (sec.5).\n\n- Bureaucratic discretion and implementation risk: the secretary has a number of discretionary functions (deciding how to give notices, ordering candidate names by lot, accepting informal votes where intention is clear, and choosing the manner of publishing results) that affect how the rules operate in practice (secs.9, 13, 15, 18). That discretion affects transparency and uniformity unless the board constrains it by by‑laws or internal protocols.\n\n- Effects on participation and concentrated benefits: the structure creates a clear choice for donors between single‑term and multiple‑term eligibility. Multiple‑term donors concentrate benefit (voting/nomination rights across cycles) in return for an upfront payment (sec.5). The cap on eligibility amounts (sec.5) limits how expensive that access can be.\n\n- Compliance and operational burdens: secretaries must prepare and maintain the roll, verify nominations, run counts with witnesses, and store ballots securely. Boards must budget for election expenses (secs.8, 12–17). Donors and eligible electors must keep contact details current to receive notices and ballots (secs.4, 9, 13).\n\nSections cited: key operational provisions are in sections 4–6 (donor details and eligibility donations) and sections 7–18 (election timing, roll, notice, nominations, voting, counting, ties, costs and publication).\n\nOverall: the regulation translates the Act’s high‑level electoral and donor requirements into concrete procedures, sets monetary bounds on donation‑based eligibility, and allocates operational responsibilities to secretaries and boards. It therefore affects how easy it is to participate in board elections, the administrative cost of holding elections, and the financial terms by which donors can acquire electoral eligibility (secs.4–18)."},"issue_detection":{"absurdities":[],"contradictions":[]},"summary":{"complexity_score":4,"scope_assessment":{"changed":false,"description":"The regulation appears to stay within its intended scope — it is a subordinate instrument (a regulation made under a parent Act) that fills in the procedural and financial details for grammar school board elections and donor registers. It sets donation thresholds for single- or multiple-term eligibility, gives board secretaries control of the voting process, and prescribes nomination, notice, and ballot procedures. It matters because it ties democratic rights in school governance directly to giving money."}},"importantCases":[],"_links":{"self":"/api/acts/grammar-schools-regulation-2016","history":"/api/acts/grammar-schools-regulation-2016/history","analysis":"/api/acts/grammar-schools-regulation-2016/analysis","conflicts":"/api/acts/grammar-schools-regulation-2016/conflicts","importantCases":"/api/acts/grammar-schools-regulation-2016/important-cases","documents":"/api/acts/grammar-schools-regulation-2016/documents"}}
