(1) In this Act—\n> > \n> > Advisory Board means the Government Telecommunications Authority Advisory Board established by section 10.\n> > \n> > alternative telecommunications network means a telecommunications network authorised under section 17.\n> > \n> > authorised officer means an authorised officer appointed under section 43A.\n> > \n> > Authority means the New South Wales Government Telecommunications Authority constituted by section 4.\n> > \n> > corporate plan means the corporate plan for the Authority prepared under section 7.\n> > \n> > emergency telecommunications network operator, or ETNO, means an emergency services organisation within the meaning of the [State Emergency and Rescue Management Act 1989](/view/html/inforce/current/act-1989-165) that—\n> > \n> > > (a) establishes or uses an alternative telecommunications network for operational communications, or\n> > \n> > > (b) establishes a telecommunications network under section 42.\n> > \n> > function includes a power, authority or duty, and exercise a function includes perform a duty.\n> > \n> > government sector agency has the same meaning as in the [Government Sector Employment Act 2013](/view/html/inforce/current/act-2013-040) and includes any public or local authority prescribed by the regulations.\n> > \n> > Government telecommunications network means the telecommunications network owned or operated by the Authority to facilitate operational communications of government sector agencies, and includes the lines, equipment and other infrastructure used, or intended for use, in that network.\n> > \n> > Managing Director means the person employed in the Public Service as the Managing Director of the Authority.\n> > \n> > operational communications means communications to facilitate the exercise of functions by a government sector agency—\n> > \n> > > (a) in connection with preventing, preparing for, responding to or recovering from, an emergency, public safety incident or other incident posing a risk of harm to any person or property (including training activities in relation to the exercise of those functions), and\n> > \n> > > (b) in relation to the NSW Police Force—in connection with law enforcement and compliance,\n> > \n> > but does not include communications of a kind prescribed by the regulations.\n> > \n> > premises, for Part 5A—see section 34B.\n> > \n> > property includes land.\n> > \n> > Property and Infrastructure Management Strategy means the strategy approved by the Minister under section 8.\n> > \n> > telecommunications network Authority","content":"# Part 2 New South Wales Government Telecommunications Authority\n\nPart 2 New South Wales Government Telecommunications Authority","sortOrder":4},{"sectionNumber":"4","sectionType":"section","heading":"Constitution of New South Wales Government Telecommunications Authority","content":"#### 4 Constitution of New South Wales Government Telecommunications Authority\n\n4 Constitution of New South Wales Government Telecommunications Authority\n\n> > (1) There is constituted by this Act a body corporate with the corporate name of the New South Wales Government Telecommunications Authority.\n> \n> > (2) The Authority may also be called the NSW Telco Authority and the use of that name has the same effect for all purposes as the use of its corporate name.\n> \n> > (3) The Authority is a NSW Government agency.\n> \n> > (4) The Authority is, in the exercise of its functions, subject to the control and direction of the Minister.","sortOrder":5},{"sectionNumber":"5","sectionType":"section","heading":"Functions of Authority","content":"#### 5 Functions of Authority\n\n5 Functions of Authority\n\n> The Authority has the following functions—\n> \n> > (a) to identify, develop and deliver upgrades and enhancements to the Government telecommunications network to improve operational communications for government sector agencies,\n> \n> > (b) to develop policies, standards and guidelines for operational communications using telecommunications networks,\n> \n> > (c) to facilitate, manage and administer applications on behalf of government sector agencies to the Australian Communications and Media Authority for, or in relation to, spectrum licences under the [Radiocommunications Act 1992](http://www.legislation.gov.au/) of the Commonwealth and, at the request of an agency, to manage and hold spectrum licences on behalf of the agency,\n> \n> > (d) to co-ordinate the provision of telecommunications services, being a functional area within the meaning of the [State Emergency and Rescue Management Act 1989](/view/html/inforce/current/act-1989-165), as required in accordance with that Act,\n> > \n> > Note—\n> > \n> > A functional area, within the meaning of the [State Emergency and Rescue Management Act 1989](/view/html/inforce/current/act-1989-165), means a category of services involved in the prevention of, preparation for, responses to or recovery from an emergency.\n> \n> > (e) to acquire or dispose of infrastructure and other facilities for or in connection with the exercise of its functions,\n> \n> > (f) to ensure the Government telecommunications network is utilised to the best commercial advantage,\n> \n> > (g) to do anything supplementary or incidental to the exercise of its functions and, in particular, to the control, management and operation of the Government telecommunications network,\n> \n> > (h) any other functions conferred or imposed on it by or under this Act or another Act.\n> > \n> > Note—\n> > \n> > The Authority has functions conferred or imposed under other provisions of this Act, including sections 15 (Authority to establish, maintain and operate Government telecommunications network) and 22 (Authority may enter into agreements for use of Government telecommunications network (other than government sector agencies)).","sortOrder":6},{"sectionNumber":"6","sectionType":"section","heading":"Managing Director","content":"#### 6 Managing Director\n\n6 Managing Director\n\n> > (1) The Managing Director is responsible for managing and controlling the activities of the Authority, subject to its corporate plan and any directions of the Minister under this Act.\n> \n> > (2) Any act, matter or thing done in the name of, or on behalf of, the Authority by the Managing Director is taken to have been done by the Authority.","sortOrder":7},{"sectionNumber":"7","sectionType":"section","heading":"Corporate plan","content":"#### 7 Corporate plan\n\n7 Corporate plan\n\n> > (1) The Authority is required to prepare and deliver to the Minister, at least 3 months before the beginning of each financial year, a draft corporate plan for the financial year.\n> \n> > (2) The Authority must—\n> > \n> > > (a) consider any comments on the draft corporate plan made by the Minister within 2 months after delivery of the plan to the Minister, and\n> > \n> > > (b) deliver the completed corporate plan to the Minister before the beginning of the financial year concerned.\n> \n> > (3) The corporate plan must specify—\n> > \n> > > (a) the objectives of the activities of the Authority for the financial year concerned and for future financial years, and\n> > \n> > > (b) the strategies, policies and budgets for achieving those objectives, and\n> > \n> > > (c) targets and criteria for assessing the Authority’s performance.\n> \n> > (4) The Authority is, as far as practicable, to exercise its functions in accordance with its corporate plan.\n> \n> > (5) This section is subject to the requirements of any directions of the Minister.","sortOrder":8},{"sectionNumber":"8","sectionType":"section","heading":"Property and Infrastructure Management Strategy","content":"#### 8 Property and Infrastructure Management Strategy\n\n8 Property and Infrastructure Management Strategy\n\n> > (1) The Authority is, at the request of the Minister, to prepare and submit for the Minister’s approval a strategy outlining the way in which the Authority is to manage infrastructure and property matters in connection with the exercise of its functions.\n> \n> > (2) The Property and Infrastructure Management Strategy must, without limiting any other matter that may be required to be included by the Minister, make provision for or with respect to—\n> > \n> > > (a) the way in which the Authority is to negotiate with government sector agencies and other persons in relation to the acquisition or use of, or access to, infrastructure and property by the Authority, and\n> > \n> > > (b) the making of transfer orders under section 28.\n> \n> > (3) The Authority must comply with the Property and Infrastructure Management Strategy as approved by the Minister.\n> \n> > (4) The Authority may, with the approval of the Minister, amend or replace the Property and Infrastructure Management Strategy.","sortOrder":9},{"sectionNumber":"9","sectionType":"section","heading":"Employment of staff","content":"#### 9 Employment of staff\n\n9 Employment of staff\n\n> Persons may be employed in the Public Service under the [Government Sector Employment Act 2013](/view/html/inforce/current/act-2013-040) to enable the Authority to exercise its functions.\n> \n> Note—\n> \n> Section 59 of the [Government Sector Employment Act 2013](/view/html/inforce/current/act-2013-040) provides that the persons so employed (or whose services the Authority makes use of) may be referred to as officers or employees, or members of staff, of the Authority. Section 47A of the [Constitution Act 1902](/view/html/inforce/current/act-1902-032) precludes the Authority from employing staff unless expressly authorised by Board\n\n> The New South Wales Government Telecommunications Authority Advisory Board is established.","sortOrder":12},{"sectionNumber":"11","sectionType":"section","heading":"Function of Advisory Board","content":"#### 11 Function of Advisory Board\n\n11 Function of Advisory Board\n\n> The function of the Advisory Board is to advise the Authority and the Minister on any matter relating to the telecommunications requirements of government sector agencies and on any other matter relating to the functions of the Authority.","sortOrder":13},{"sectionNumber":"12","sectionType":"section","heading":"Charter of Advisory Board","content":"#### 12 Charter of Advisory Board\n\n12 Charter of Advisory Board\n\n> > (1) The Advisory Board is, at its first meeting, to create a charter with respect to the procedure of the Advisory Board.\n> \n> > (2) The charter may, subject to this Act and the regulations, make provision for or with respect to the following—\n> > \n> > > (a) the deputies for appointed members,\n> > \n> > > (b) the procedure of the Advisory Board,\n> > \n> > > (c) quorum for meetings,\n> > \n> > > (d) the presiding member at meetings of the Advisory Board,\n> > \n> > > (e) any other matter relating to the conduct of the business of the Advisory Board.","sortOrder":14},{"sectionNumber":"13","sectionType":"section","heading":"Membership of Advisory Board","content":"#### 13 Membership of Advisory Board\n\n13 Membership of Advisory Board\n\n> > (1) The members of the Advisory Board are—\n> > \n> > > (a) the Managing Director, and\n> > \n> > > (b) the following members appointed by the Governor (appointed members)—\n> > > \n> > > > (i) a person nominated by the Minister administering the [Police Act 1990](/view/html/inforce/current/act-1990-047),\n> > > \n> > > > (ii) a person nominated by the Minister administering the [State Emergency and Rescue Management Act 1989](/view/html/inforce/current/act-1989-165),\n> > > \n> > > > (iii) at least 6 (but not more than 8) persons nominated by the Minister who, in the opinion of the Minister, together have the skills, experience and expertise that are appropriate to enable the Advisory Board to exercise its function.\n> \n> > (2) Terms of office for appointed members An appointed member of the Advisory Board holds office for such period (not exceeding 5 years) as is specified in the member’s instrument of appointment, but is eligible (if otherwise qualified) for re-appointment.\n> \n> > (3) Remuneration An appointed member is entitled to be paid the remuneration (including travelling and subsistence allowances) the Minister determines from time to time in respect of the member.\n> \n> > (4) Vacancy in office of appointed member The office of an appointed member becomes vacant if the member—\n> > \n> > > (a) dies, or\n> > \n> > > (b) completes a term of office and is not re-appointed, or\n> > \n> > > (c) resigns the office by instrument in writing addressed to the Governor, or\n> > \n> > > (d) is removed from office by the Governor under this section, or\n> > \n> > > (e) is absent from 4 consecutive meetings of the Advisory Board of which reasonable notice has been given to the member, except on leave granted by the Advisory Board or unless, before the expiration of 4 weeks after the last of those meetings, the member is excused by the Advisory Board for having been absent from those meetings, or\n> > \n> > > (f) becomes bankrupt, applies to take the benefit of any law for the relief of bankrupt or insolvent debtors, compounds with his or her creditors or makes an assignment of his or her remuneration for their benefit, or\n> > \n> > > (g) becomes a mentally incapacitated person, or\n> > \n> > > (h) is convicted in New South Wales of an offence that is punishable by imprisonment for 12 months or more or is convicted elsewhere than in New South Wales of an offence that, if committed in New South Wales, would be an offence so punishable.\n> \n> > (5) The Governor may remove an appointed member from office at any time.\n> \n> > (6) Filling of vacancy in office of appointed member If the office of any appointed member becomes vacant a person is, subject to this Act, to be appointed to fill the vacancy.\n> \n> > (7) Effect of certain other Acts The provisions of the [Government Sector Employment Act 2013](/view/html/inforce/current/act-2013-040) relating to the employment of Public Service employees do not apply to an appointed member.\n> \n> > (8) If by or under any Act provision is made—\n> > \n> > > (a) requiring a person who is the holder of a specified office to devote the whole of the person’s time to the duties of that office, or\n> > \n> > > (b) prohibiting the person from engaging in employment outside the duties of that office,\n> > \n> > the provision does not operate to disqualify the person from holding that office and also the office of an appointed member or from accepting and retaining any remuneration payable to the person under this Act as an appointed member.\n> \n> **s 13:** Am 2024 No 53, Sch 1.7.","sortOrder":15},{"sectionNumber":"14","sectionType":"section","heading":"Disclosure of pecuniary interests by members","content":"#### 14 Disclosure of pecuniary interests by members\n\n14 Disclosure of pecuniary interests by members\n\n> > (1) If—\n> > \n> > > (a) a member of the Advisory Board has a direct or indirect pecuniary interest in a matter being considered or about to be considered at a meeting of the Advisory Board, and\n> > \n> > > (b) the interest appears to raise a conflict with the proper performance of the member’s duties in relation to the consideration of the matter,\n> > \n> > the member must, as soon as possible after the relevant facts have come to the member’s knowledge, disclose the nature of the interest at a meeting of the Advisory Board.\n> \n> > (2) A disclosure by a member at a meeting of the Advisory Board that the member—\n> > \n> > > (a) is a member, or is in the employment, of a specified company or other body, or\n> > \n> > > (b) is a partner, or is in the employment, of a specified person, or\n> > \n> > > (c) has some other specified interest relating to a specified company or other body or to a specified person,\n> > \n> > is a sufficient disclosure of the nature of the interest in any matter relating to that company or other body or to that person that may arise after the date of the disclosure and that is required to be disclosed under subsection (1).\n> \n> > (3) Particulars of any disclosure made under this section must be recorded by the Advisory Board in a book kept for the purpose and that book must be open at all reasonable hours to inspection by any person on payment of the fee determined by the Advisory Board.\n> \n> > (4) After a member has disclosed the nature of an interest in any matter, the member must not, unless the Minister or the Advisory Board otherwise determines—\n> > \n> > > (a) be present during any deliberation of the Advisory Board with respect to the matter, or\n> > \n> > > (b) take part in any decision of the Advisory Board with respect to the matter.\n> \n> > (5) For the purposes of the making of a determination by the Advisory Board under subsection (4), a member who has a direct or indirect pecuniary interest in a matter to which the disclosure relates must not—\n> > \n> > > (a) be present during any deliberation of the Advisory Board for the purpose of making the determination, or\n> > \n> > > (b) take part in the making by the Advisory Board of the determination.\n> \n> > (6) A contravention of this section does not invalidate any decision of network\n\n> > (1) The Authority is responsible for the establishment, control, management, maintenance and operation of the Government telecommunications network.\n> \n> > (2) The Authority may, in accordance with the Property and Infrastructure Management Strategy, enter into an agreement with any person or body for or with respect to the establishment, control, management, maintenance and operation of the Government telecommunications network.","sortOrder":18},{"sectionNumber":"16","sectionType":"section","heading":"Government sector agencies to use Government telecommunications network","content":"#### 16 Government sector agencies to use Government telecommunications network\n\n16 Government sector agencies to use Government telecommunications network\n\n> > (1) Government sector agencies are required to use the Government telecommunications network for operational communications requiring the use of a telecommunications network.\n> \n> > (2) Despite subsection (1), a government sector agency is not required to use the Government telecommunications network for operational communications if—\n> > \n> > > (a) the Minister has authorised the use of an alternative telecommunications network for operational communications and the network is used for that purpose in accordance with any conditions specified in that authorisation, or\n> > \n> > > (b) the agency is authorised under this Act or another Act or law to establish or operate a telecommunications network, however described, and has advised the Authority of the establishment or operation of that network, or\n> > \n> > > (c) the agency has established a telecommunications network for purposes other than operational communications, and the use of the network for operational communications is ancillary to the primary purpose of that network.","sortOrder":19},{"sectionNumber":"17","sectionType":"section","heading":"Minister may authorise alternative telecommunications networks","content":"#### 17 Minister may authorise alternative telecommunications networks\n\n17 Minister may authorise alternative telecommunications networks\n\n> > (1) The Minister may authorise a government sector agency to establish or use an alternative telecommunications network for operational communications if the Minister is satisfied that—\n> > \n> > > (a) the Government telecommunications network is not available to the agency due to geographical or technological limitations, or\n> > \n> > > (b) the government sector agency has a need to establish local telecommunications networks for short periods for events or recurring circumstances or situations, or\n> > \n> > > (c) the total cost of the alternative telecommunications network will not exceed $500,000, or\n> > \n> > > (d) the alternative telecommunications network is for an event or circumstance, or class of events or circumstances, prescribed by the regulations.\n> \n> > (2) In authorising the establishment or use of an alternative telecommunications network, the Minister may impose the conditions the Minister considers appropriate.\n> \n> > (3) A government sector agency must, before asking the Minister to authorise the establishment or use of an alternative telecommunications network, consult with the Authority to ensure the proposed alternative telecommunications network will not interfere with, or otherwise affect the operation of, the Government telecommunications network.\n> \n> > (4) A request by a government sector agency that the Minister authorise the establishment or use of an alternative telecommunications network must be in the form approved by the Minister and must contain the information the Minister requires.\n> \n> > (5) Before authorising the establishment or use of an alternative telecommunications network, the Minister is to consult with the Authority and any other person the Minister thinks fit in relation to the proposed alternative telecommunications network, the purposes for which it may be used and conditions to which the authorisation should be subject.\n> \n> > (6) It is a condition of an authorisation granted to a government sector agency under this section that the government sector agency must not cause or permit an upgrade, expansion or other enhancement to an alternative telecommunications network unless—\n> > \n> > > (a) the upgrade, expansion or other enhancement is permitted in accordance with the terms of the authorisation, or\n> > \n> > > (b) a request is made to the Minister to authorise the upgrade, expansion or other enhancement and the request is approved by the Minister.\n> \n> > (7) If a request is made to upgrade, expand or otherwise enhance an alternative telecommunications network, the Minister is to consider the request, and this section applies in relation to the request, as if it were a request to approve an alternative telecommunications network comprising the existing alternative telecommunications network together with the proposed upgrade, expansion or other enhancement.","sortOrder":20},{"sectionNumber":"18","sectionType":"section","heading":"Authority may enter into agreements with third parties for use of infrastructure","content":"#### 18 Authority may enter into agreements with third parties for use of infrastructure\n\n18 Authority may enter into agreements with third parties for use of infrastructure\n\n> The Authority may, for or in connection with the operation of the Government telecommunications network, enter into an agreement with any person (including a government sector agency) for the use of infrastructure or other facilities owned or operated by that Authority may remove or relocate any part of Government telecommunications network infrastructure\n\n19 Authority may remove or relocate any part of Government telecommunications network infrastructure\n\n> The Authority may relocate, remove, disconnect, transfer or reconnect any part of the infrastructure of the Government telecommunications network if the Authority is satisfied—\n> \n> > (a) the relocation, removal, disconnection, transfer or reconnection is required for the efficient and economical operation of that network, and\n> \n> > (b) the infrastructure is not required to be maintained under a contract or arrangement with a government sector agency.","sortOrder":22},{"sectionNumber":"20","sectionType":"section","heading":"Government sector agencies not to alter Government telecommunications network","content":"#### 20 Government sector agencies not to alter Government telecommunications network\n\n20 Government sector agencies not to alter Government telecommunications network\n\n> A government sector agency must not alter, move, replace, add to or otherwise interfere with infrastructure comprising part of the Government telecommunications network without the written consent of the Authority.","sortOrder":23},{"sectionNumber":"21","sectionType":"section","heading":"Authority may charge for use of Government telecommunications network","content":"#### 21 Authority may charge for use of Government telecommunications network\n\n21 Authority may charge for use of Government telecommunications network\n\n> > (1) Government sector agencies that use the Government telecommunications network are required to pay to the Authority the charges determined by the Authority.\n> \n> > (2) The Authority must prepare and publish, in a manner approved by the Minister, a document outlining the basis on which the Authority will determine charges payable under this section.\n> \n> > (3) The charges must not exceed the maximum charges fixed by the Minister with the approval of the Treasurer.","sortOrder":24},{"sectionNumber":"22","sectionType":"section","heading":"Authority may enter into agreements for use of Government telecommunications network","content":"#### 22 Authority may enter into agreements for use of Government telecommunications network\n\n22 Authority may enter into agreements for use of Government telecommunications network\n\n> > (1) The Authority may enter into an agreement with any person or body (other than a government sector agency) for or with respect to the use by that person or body of any part of the Government telecommunications network.\n> \n> > (2) The Authority must not enter into an agreement under this section unless the Authority is satisfied the use of the Government telecommunications network under the agreement (having regard to any other agreements that may also have been entered into) will not prevent or interfere with the use of the network by a government sector agency.\n> \n> > (3) The power of the Authority under this section is subject to the requirements of the [Telecommunications Act 1997](http://www.legislation.gov.au/) of the Commonwealth relating to the rights of carriers licensed under that Act.","sortOrder":25},{"sectionNumber":"23","sectionType":"section","heading":"Offences relating to damage to Government telecommunications network","content":"#### 23 Offences relating to damage to Government telecommunications network\n\n23 Offences relating to damage to Government telecommunications network\n\n> > (1) A person is guilty of an offence if—\n> > \n> > > (a) the person intentionally or recklessly damages or interferes with the whole or part of the Government telecommunications network, and\n> > \n> > > (b) the damage or interference is not trivial or negligible.\n> > \n> > Maximum penalty—\n> > \n> > > (a) in the case of an individual—200 penalty units, and\n> > \n> > > (b) in the case of a corporation—400 penalty units.\n> \n> > (2) A person is guilty of an offence if the person damages or interferes with the whole or part of the Government telecommunications network.\n> > \n> > Maximum penalty—\n> > \n> > > (a) in the case of an individual—20 penalty units, and\n> > \n> > > (b) in the case of a corporation—40 penalty units.\n> \n> > (3) If, in proceedings for an offence under subsection (1), the the person served with the notice.\n> \n> > (4) The Authority or the ETNO may, in an emergency, modify or remove the structure or thing itself, instead of serving a written notice.\n> \n> > (5) The written notice—\n> > \n> > > (a) must specify the work to be carried out, and\n> > \n> > > (b) must specify a reasonable time within which the work must be carried out, and\n> > \n> > > (c) may risk to public safety.\n> \n> > (3) The notice must specify the excavation work to be modified or not carried out.\n> \n> > (4) The Authority or the ETNO may recover the following costs in a court of competent jurisdiction as a debt owed to the Authority or the ETNO by the person who carried out excavation work the subject of the notice other than in accordance with the notice—\n> > \n> > > (a)
