39B\n\nSidenotes which cite ILA s. 39B refer to section 39B of the ILA which provides that where an undivided section or clause of a Schedule is amended by the insertion of one or more subsections or subclauses, the original section or clause becomes subsection or subclause (1) and is amended by the insertion of the expression \"(1)\" at the beginning of the original section or clause.\n\nInterpretation\n\nAs from 1 January 2001, amendments to section 36 of the ILA have the following effects:\n\n• Headings\n\nAll headings included in an Act which is passed on or after 1 January 2001 form part of that Act. Any heading inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. This includes headings to Parts, Divisions or Subdivisions in a Schedule; sections; clauses; items; tables; columns; examples; diagrams; notes or forms. See section 36(1A)(2A).\n\n• Examples, diagrams or notes\n\nAll examples, diagrams or notes included in an Act which is passed on or after 1 January 2001 form part of that Act. Any examples, diagrams or notes inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, form part of that Act. See section 36(3A).\n\n• Punctuation\n\nAll punctuation included in an Act which is passed on or after 1 January 2001 forms part of that Act. Any punctuation inserted in an Act which was passed before 1 January 2001, by an Act passed on or after 1 January 2001, forms part of that Act. See section 36(3B).\n\n• Provision numbers\n\nAll provision numbers included in an Act form part of that Act, whether inserted in the Act before, on or after 1 January 2001. Provision numbers include section numbers, subsection numbers, paragraphs and subparagraphs. See section 36(3C).\n\n• Location of \"legislative items\"\n\nA \"legislative item\" is a penalty, an example or a note. As from 13 October 2004, a legislative item relating to a provision of an Act is taken to be at the foot of that provision even if it is preceded or followed by another legislative item that relates to that provision. For example, if a penalty at the foot of a provision is followed by a note, both of these legislative items will be regarded as being at the foot of that provision. See section 36B.\n\n• Other material\n\nAny explanatory memorandum, table of provisions, endnotes, index and other material printed after the Endnotes does not form part of an Act.  \nSee section 36(3)(3D)(3E).\n\n2 Table of Amendments\n\nThis publication incorporates amendments made to the **Geothermal Energy Resources Act 2005** by Acts and subordinate The 2012 amendments (No. 64/2012) introduced entirely new Parts 5A and 5B creating 'special access authorisations' and 'special drilling authorisations' — flexible, short-term permissions that can overlap with existing permit areas and operate without exclusive rights. This represents a shift from a rigid sequential licensing system to a more layered, collaborative approach allowing multiple parties to explore the same area. Additional amendments have progressively inserted statutory conditions for Traditional Owner agreements (2014), modified planning scheme interactions (2012, 2018), and updated departmental responsibilities (2013, 2025). Companies cannot simply drill and extract; they need government permission.\n\n- **Creates a licensing system** with four main types of approvals:\n  - **Exploration permits** (up to 15 years, renewable) — for surveying, drilling test holes, and assessing whether commercial extraction is viable\n  - **Retention leases** (up to 15 years, not renewable) — lets explorers \"hold\" a discovery if it's not yet commercially viable to extract\n  - **Extraction licences** (ongoing until surrendered or cancelled) — for commercial production of geothermal energy\n  - **Special access and drilling authorisations** (introduced 2012) — shorter-term permissions for specific exploration activities, sometimes overlapping with existing permit areas\n\n- **Sets environmental and safety rules**: Operators must submit detailed operation plans, carry insurance, post rehabilitation bonds, and restore land after use. The Minister can issue improvement or prohibition notices to stop unsafe practices.\n\n- **Requires compensation** to landowners and native title holders for damage, loss of use, or reduced property values from geothermal operations — but not for the value of the geothermal energy itself (Section 90).\n\n- **Overrides normal planning controls**: Geothermal exploration and extraction approved under this Act generally don't need separate planning permits (Sections 62, 78E, 78F), though operators must still comply with environment protection and Aboriginal heritage laws.\n\n- **Establishes a public register** of all authorities and dealings, with enforcement through inspectors who can enter premises, seize evidence, and issue notices.\n\n**Who it affects:**\n- Energy companies seeking to develop geothermal projects\n- Landowners (private and Crown) whose property may be accessed\n- Traditional Owners with native title interests\n- Local communities near proposed geothermal operations\n- Government agencies administering energy and environmental regulation\n\n**Why it matters:**\nGeothermal energy is a low-emission, renewable baseload power source. This Act attempts to balance encouraging its development against protecting landholders, the environment, and community interests. The 2012 amendments added flexibility for overlapping exploration activities, while 2010 amendments strengthened Traditional Owner protections and public health considerations."},"issue_detection":{"absurdities":[],"contradictions":[]}},"importantCases":[],"_links":{"self":"/api/acts/geothermal-energy-resources-act-2005","history":"/api/acts/geothermal-energy-resources-act-2005/history","analysis":"/api/acts/geothermal-energy-resources-act-2005/analysis","conflicts":"/api/acts/geothermal-energy-resources-act-2005/conflicts","importantCases":"/api/acts/geothermal-energy-resources-act-2005/important-cases","documents":"/api/acts/geothermal-energy-resources-act-2005/documents"}}
