The 2023 amendments added offences related to distribution system management plans and heating value determinations, but these are logically connected to the core gas safety enforcement function."},"complexity_factors":["Simple structure with only 4 main regulations plus schedules","Heavy reliance on external legislation (Criminal Procedure Act 2004, Gas Standards Act 1972, and two sets of regulations) requiring cross-referencing to understand the actual offences","Tabular format in Schedule 1 makes the prescribed offences readable but requires flipping between multiple documents to understand the full context of each offence","No nested conditional logic or complex exceptions within the regulations themselves","Straightforward appointment mechanism for authorised officers (single subsection)","Forms in Schedule 2 are standard templates with minimal legal drafting complexity"],"plain_english_summary":"These regulations set up a system for issuing on-the-spot fines (called 'infringement notices') for breaches of Western Australia's gas safety laws. Instead of dragging someone through court for minor offences, authorised officers can issue a ticket with a set fine amount.\n\n**Who it affects:**\n- **Gas companies and network operators** – for things like supplying gas that doesn't meet quality standards, failing to maintain safety management plans, or not reporting incidents\n- **Gas fitters and plumbers** – for improper installation work, failing to test installations, or not keeping proper records\n- **Retailers and hirers** – for selling unapproved gas appliances or falsely marking appliances as approved\n\n**What it does:**\n- Lists exactly which offences under the *Gas Standards Act 1972* and related regulations can be dealt with by infringement notice\n- Sets two tiers of fines: lower amounts for individuals, higher amounts for companies (body corporates)\n- Penalties range from $250 (individual record-keeping breaches) up to $10,000 (corporate safety breaches)\n- Allows the Director of Energy Safety to appoint authorised officers to issue these notices\n- Provides standard forms for infringement notices and withdrawals\n\n**Why it matters:**\nThis creates a faster, cheaper way to enforce gas safety rules. Rather than every minor paperwork slip-up or installation error requiring a court case, inspectors can issue immediate penalties. This encourages compliance while freeing up courts for serious safety breaches. The system also protects people by ensuring gas appliances and installations meet safety standards—faulty gas work can kill through explosions or carbon monoxide poisoning."},"flash_summary_failed":{"failed":true,"reason":"Unauthenticated.
