It's a one-off property deal wrapped in legislation.\n\n**Who gets what:**\n\n- **Free Church Negotiators Incorporated** — receives 4 parcels of land (sections 4(a)-(d)), likely representing one faction of a church split\n- **The Presbyterian Trusts Corporation** — receives 1 parcel of land (section 5)\n- **Northern Areas Council** — receives 1 parcel of land (section 6), automatically classified as **community land** (public land managed by local councils for community use)\n- **City of Onkaparinga** — receives 1 parcel of land (section 7), also automatically classified as community land\n\n**Key protections built in:**\n\n- **Easements stay put** — rights of way, drainage rights, and similar access rights running across these properties aren't wiped out (sections 4(2), 5(2), 6(2)(a), 7(2)(a))\n- **Burial rights protected** — for the two council transfers, any existing burial rights (graves, cemeteries) remain intact (sections 6(2)(b), 7(2)(b))\n- **Clean title** — the new owners get \"fee simple\" ownership (the highest form of property ownership), free from old trusts, claims, or restrictions\n\n**The practical stuff:**\n\n- **No stamp duty** — the transfers are tax-free (section 9)\n- **No fees** — the Registrar-General (the government officer who records land ownership) must update the land titles for free (section 8)\n- **Streamlined process** — no need for the usual investigations, advertisements, or formal transfer documents (section 8(3))\n\n**Why it matters:**\n\nThis appears to resolve a property dispute following a church schism (split). Rather than leaving competing factions to fight over assets in court, Parliament stepped in to divide specific properties definitively. The involvement of councils suggests some land became surplus or was repurposed for public use (possibly former cemeteries or church halls). It's a classic example of **private legislation** — Parliament acting like an arbitrator for a specific dispute rather than making general rules."}},"importantCases":[],"_links":{"self":"/api/acts/free-presbyterian-church-vesting-of-property-act-2001","history":"/api/acts/free-presbyterian-church-vesting-of-property-act-2001/history","analysis":"/api/acts/free-presbyterian-church-vesting-of-property-act-2001/analysis","conflicts":"/api/acts/free-presbyterian-church-vesting-of-property-act-2001/conflicts","importantCases":"/api/acts/free-presbyterian-church-vesting-of-property-act-2001/important-cases","documents":"/api/acts/free-presbyterian-church-vesting-of-property-act-2001/documents"}}
