Creates different types of fishing rights (shares and endorsements)**\n- Six main types of endorsements: line fishing (western and eastern zones), demersal fish trap, school and gummy shark, and spanner crab (northern and southern zones)\n- You can only get an endorsement if you own enough shares in that specific class\n- Minimum shareholdings apply (for example, 60 shares for western zone line fishing, 40 for eastern zone)\n- No one can own more than 40% of all shares in the fishery\n\n**2. Introduces quota management for specific species**\n- Seven species are managed by individual transferable quota: spanner crab, bass grouper, blue-eye trevalla, gemfish, hapuku, pink ling, and bigeye ocean perch\n- Fishers must have quota shares to catch these species — you can't just catch as many as you want\n- The Minister sets a Total Allowable Catch (TAC) for each species each year\n\n**3. Sets detailed rules for fishing gear**\n- **Fish traps**: Must have specific mesh sizes, be marked with buoys, and can't be placed within 5 metres of each other\n- **Set lines**: Limits on number of hooks (generally 1,200 per endorsement or fishing business), must use circle hooks, and specific rules for shallow vs deep waters\n- **Spanner crab nets**: Size limits on frames, maximum numbers (30 in southern zone, 40 in northern zone), and buoy marking requirements\n- **Drift lines**: Maximum 30 lines, only one gang of hooks per line (max 5 hooks)\n- All gear must be marked with the fishing business number\n\n**4. Restricts where and when you can fish**\n- Specific areas are closed to certain methods (like fish traps near harbours)\n- Seasonal closures for spanner crabs: no female crabs from 21 October to 20 January, no male crabs from 15 November to 14 December\n- Western zone fishers can't catch deepwater species like blue-eye trevalla or gemfish\n- School and gummy shark can only be taken south of Moruya River with the right endorsement\n\n**5. Limits boat size and equipment**\n- Boats generally can't be longer than 20 metres\n- Some larger boats are \"grandfathered\" in (allowed to continue operating if they were already in the fishery)\n- Automated baiting machines are banned (except for eastern zone line fishers)\n- Maximum 3 assistants who don't hold the same endorsement\n\n**6. Requires real-time reporting**\n- Fishers must report catches of quota species (spanner crab, bass grouper, blue-eye trevalla, etc.) before landing or moving the catch\n- Two-stage reporting: an estimate first, then a final report within hours\n- Fishers must stay with their catch until the final report is made\n\n**7. Sets environmental objectives**\n- The Plan aims to reduce discarded catch, prevent overfishing, and protect threatened species\n- If certain triggers are hit (like too much bycatch or a species becoming overfished), the Plan must be reviewed\n\n**Why it matters:**\nThis Regulation tries to balance **economic viability** for fishers with **environmental sustainability**. It prevents the \"tragedy of the commons\" where everyone takes as much as possible until stocks collapse. By limiting entry (through shares), controlling catch volumes (through quotas), and restricting gear and areas, it aims to keep fish populations healthy while allowing a regulated commercial industry to continue operating."},"summary":{"complexity_score":6,"scope_assessment":{"changed":true,"description":"The regulation has been amended over 20 times since it was originally made in December 2006, strongly suggesting its scope and operational detail have evolved considerably from the original intent — likely reflecting changes in fish stock assessments, quota allocations, species inclusions/exclusions, and administrative processes over nearly two decades."},"complexity_factors":["Share management systems involve layered legal concepts (share allocation, transfer rules, endorsements) that are technical and unfamiliar to most people","The regulation has been amended more than 20 times since 2006, creating a long and evolving history that makes it difficult to track what rules apply when","It operates under the broader Fisheries Management Act 1994 (NSW), meaning you need to understand the parent Act to fully understand the regulation","Fishing share entitlements interact with commercial licensing, catch reporting, and species-specific rules — requiring cross-referencing of multiple provisions","Only the metadata and version history were provided — not the actual substantive text — limiting the ability to assess the full regulatory detail","Applies to a specialised commercial fishing industry, meaning technical knowledge of fishing methods and species is needed to fully interpret it"],"plain_english_summary":"The regulation sets out a Share Management Plan for NSW’s Ocean Trap and Line commercial fishery, governing how fishing rights (shares) are allocated, transferred and managed, plus reporting, licence conditions and catch controls to protect stocks. \n\nIt affects commercial fishers holding shares, businesses trading those shares, and regulators — determining legal rights, obligations and penalties.
