It creates a 'share management' system where fishers must hold specific shares to get a licence (endorsement) to fish.\n\n**Key things it does:**\n\n* **Divides the fishery into 7 regions** (Upper North Coast to Lower South Coast) and sets different rules for each.\n* **Creates 9 classes of shares** that fishers can own, including general hauling shares, specific net-type shares (garfish, pilchard/anchovy), and quota shares for specific species (eastern sea garfish, Australian sardine, blue mackerel, yellowtail scad).\n* **Sets minimum and maximum shareholdings** — you need a certain number of shares to fish (ranging from 1 to 160 shares depending on the type and region), and no one can own more than 40% of shares in most classes.\n* **Controls what can be caught** — at least 80% of each 'haul' must be target species (like salmon, mullet, garfish, sardines). Some species are completely off-limits (bag limits of zero for crabs, eels, deep-water fish like hapuku).\n* **Restricts where and when fishing can occur** — many popular beaches are closed to commercial hauling permanently or seasonally (especially during summer holidays). Weekend and public holiday bans apply during peak summer months.\n* **Sets equipment rules** — detailed specifications for net sizes, mesh sizes, and boat lengths (generally max 6m for general hauling nets, 20m for other nets, with some exemptions).\n* **Introduces quota management** for four species, requiring fishers to hold quota shares to catch them, with total catch limits set annually.\n* **Requires real-time reporting** — fishers must report catches of garfish and purse seine catches immediately via electronic systems.\n* **Establishes 'turns' and priority rules** — fishers must queue for access to beaches, with detailed rules about who gets to fish first based on arrival time and crew size.\n\n**Who it affects:**\nCommercial fishers in the NSW ocean hauling fishery, fishing businesses that own shares, and recreational fishers (through beach closures and priority rules).\n\n**Why it matters:**\nIt attempts to balance commercial fishing livelihoods with environmental sustainability, recreational beach use, and safety. The share system limits the number of fishers, while quota and reporting systems try to prevent overfishing of specific stocks."},"flash_summary":{"complexity_score":8,"scope_assessment":{"changed":true,"description":"The Plan as presented includes mechanisms that expand and modify the fishery’s management scope after commencement: new quota share classes and an allocation process were added (Part 3A, clauses 6A–6C; Schedule 5), and a defined transition period temporarily shifts TAC decision‑making from the TAF Committee to the Secretary with Ministerial direction permitted (Part 11, clauses 28–30). Mechanically, it: adopts the Plan (clause 3); defines who may hold and use different kinds of fishing endorsements and shares; sets spatial and temporal limits on where and when particular hauling methods may be used (Parts 6 and Schedules 1–3); prescribes what gear and vessel sizes are lawful and the technical requirements for that gear (Part 6A; clauses 13A–13D; clauses 18–18C); creates and allocates quota shares for certain species and sets rules about using quota (Part 3A, clauses 6A–6F; Schedule 5); sets minimum and maximum shareholdings (clauses 7, 7A, 8); requires routine reporting of catches (Part 9, clauses 24, 24A, 25); and establishes priority, crew and operational rules (Parts 7A, 8, clauses 15–23). It also adopts a Supporting Plan and authorises future amendments (clauses 26–27) and contains temporary arrangements for who must make certain total allowable catch (TAC) determinations during a defined transition period (Part 11, clauses 28–30).\n\nWho is directly affected\n\n- Endorsement holders (people who hold commercial fishing licences with specific endorsements) — subject to gear, area, time, crew, vessel size, bag limit and reporting rules (see clause 9; Parts 6, 6A, 7, 8, 9; clauses 17A, 18).\n- Shareholders in the fishery (owners of different classes of shares) — subject to minimum and maximum shareholding rules and to quota share allocation and transfer rules (clauses 5–8; Part 3A, clauses 6A–6D; Schedule 5).\n- Fishing business owners — must receive and pass on crew limits and comply with reporting and display requirements (clauses 16, 23).\n- The Minister, the Secretary and the Share Appeal Panel — given powers to allocate quota shares, issue directions about TACs during transition, determine crew limits and administer appeals (clauses 6B–6C, 6D, 23, 29–30).\n\nWhy it matters (official purpose and how that aligns with trade-offs)\n\n- Officially stated objectives are to manage environmental impacts and support ecologically sustainable development, and to promote viable commercial fishing (clause 3, Table, Column 1). These objectives are accompanied by measurable performance indicators and triggers for review (clause 3, Table, Columns 2–3).\n\n- How the Plan channels incentives and imposes costs:\n - Access and entry are shaped by share-based entitlements and endorsement rules. Minimum and maximum shareholding rules determine who can obtain endorsements and limit the scale of a single owner (clauses 7, 7A, 8). Mechanism: ownership of specified minimum shares is a precondition for endorsements (clause 7(1); 7A(1)).\n - Quota shares for specific species are allocated mainly to existing eligible shareholders by formula and Ministerial/Secretary determinations (clauses 6B, 6BA, 6C; Schedule 5). Mechanism: allocation relies on pre-existing shareholdings and historical catch records (Schedule 5, clauses 1–3). This concentrates initial entitlement with identifiable existing holders (clause 6B(2); 6BA(2)).\n - Operational constraints (area/time closures, gear specifications, crew rules, vessel size limits) restrict how and when fishing occurs and therefore how businesses organise labour and boats (clauses 10–13, Part 6A, clauses 18–18C, clauses 19–23). Mechanism: legal conditions on endorsements and gear descriptions (e.g. clause 13A(1)(a)–(i); clause 18(1)–(2)).\n - Real‑time and near‑real-time reporting obligations create an administrative compliance cost and require endorsement holders to remain with catch or retain possession until reporting is finalised (clauses 24(1)–(4); 24A(1)–(6); 25).\n\nCosts, incentives and trade-offs (mechanisms, not judgments)\n\n- Who pays: endorsement holders and fishing businesses bear the direct compliance and operational costs — reporting (clauses 24, 24A), crew limits notification (clause 23(5)), display of identification (clause 16), gear and vessel compliance (Part 6A; clauses 18–18C), and adherence to closures and bag limits (clauses 10–12; clause 17A; Schedule 4).\n\n- Concentrated benefits vs diffuse costs: quota shares and new classes of shares are issued to eligible existing shareholders (clause 6B(2); 6BA(2); 6C), which is a mechanism that distributes new tradable entitlements primarily to a defined group (Schedule 5 sets the allocation formula). The mechanism creates concentrated initial gains for those eligible and limits immediate redistribution.\n\n- Effect on market structure and private enterprise: minimum shareholding thresholds (clauses 7, 7A) restrict small‑scale entry and determine who can hold endorsements; the 40% cap (clause 8) limits maximum concentration (applies to non‑quota shares). The net effect is a legally structured distribution of access rights tied to share ownership.\n\n- Effects on operational choices and productivity: gear descriptions and restrictions, area/time closures, and vessel length caps directly constrain the set of allowable technologies and vessel upgrades (Part 6A; clauses 10–13; clauses 18–18C). These constraints change what equipment and labour arrangements businesses can legally adopt.\n\n- Compliance burden and enforcement risk: the Plan makes many endorsement conditions enforceable as offences (for example, contravention of clause 9 is unlawful under section 24 of the Act; clause 6F(2) makes taking quota without quota an offence). Administrative discretion (see below) affects how rules are applied and changed.\n\nBureaucratic discretion and decision‑makers (mechanisms and limits)\n\n- The Minister directs allocation and may specify the relevant date and allocation formula publication for first‑issue quota shares (clause 6B(3)–(5)). The Minister may also give directions to the Secretary during the transition period on matters to be considered in TAC determinations (clause 30(1), (5)) and may exempt the Secretary from scientific assessment requirements in certain cases (clause 30(2)).\n\n- The Secretary makes determinations required by the Plan in many areas: notification and statements after issuing quota shares (clause 6C(2)); determining catches for allocation (Schedule 5, clause 2); setting crew limits (clause 23(1), (3)–(4)); and, during the defined transition period, the Secretary is required to make TAC determinations that otherwise would be made by the TAF Committee (clause 29(1)).\n\n- Appeals and limits on review: recipients of quota shares can appeal the Minister’s allocation to the Share Appeal Panel (clause 6D(1)), but an appellant who transfers any of those quota shares loses the right to appeal (clause 6D(1A)). Shares subject to appeal are frozen against registrable dealings until finalised (clause 6D(2)–(3), (6)).\n\nImplementation risk and review triggers\n\n- The Plan includes measurable performance indicators and specific triggers for review (clause 3, Table, Columns 2–3) — for example, increases in observed discard rates, changes in exploitation status to “overfished” or “recruitment overfished”, or sustained declines in economic returns.\n\n- Significant implementation discretion exists (Ministerial directions, Secretary determinations, and administrative steps required to secure exemptions), which creates a reliance on those offices’ choices to operate the rules as written (clauses 6B–6C; clause 23; clauses 29–30).\n\nBehavioural changes the Plan requires or encourages (by clause)\n\n- Restrict species composition in each haul to at least 80% target/conditional target species by weight (clause 9).\n- Comply with gear specification and use rules (clauses 13A–13D) and with area/time closures (clauses 10–11A; Schedules 1–3).\n- Maintain specified crew arrangements and not exceed crew limits set by the Secretary (clauses 19–23).\n- Hold prescribed minimum shares to be eligible for endorsements, and observe maximum holdings (clauses 7, 7A, 8).\n- Obtain and retain quota for certain species before taking them (clause 6F) and make catch reports in real time or by approved forms if systems fail (clauses 24, 24A, 25).\n\nKey practical points to watch (mechanisms with operational impact)\n\n- Quota issuance process: Minister/Secretary sets allocation formula and relevant date; Schedule 5 ties second‑issue quota allocation to historical catches and shareholding (clauses 6B, 6BA, Schedule 5).\n- Transition arrangements: during 6 Oct 2017–30 June 2024, the Secretary (not the TAF Committee) makes certain TAC determinations, and the Minister may direct the Secretary on matters to consider, including allowing departures from scientific assessments (clauses 28–30).\n- Administrative preconditions for exemptions and vessel replacements require documentation to the Secretary within specified timeframes (clauses 18A(2), 18C(4)).\n\nSource citations: clauses and Parts named above are the operative provisions in the Ocean Hauling Share Management Plan as set out in the Appendix to the Regulation (clause 3)."},"summary":{"complexity_score":6,"scope_assessment":{"changed":true,"description":"The regulation has been amended over 20 times since its original commencement in December 2006, strongly suggesting that its scope, share allocations, permitted fishing areas, or operational rules have evolved considerably beyond the original intent. Under this type of system:\n- The total allowable fishing effort is divided into **shares** (like slices of a pie)\n- Only licensed fishers who hold shares can legally fish using ocean hauling methods\n- Shares can be bought, sold, or leased between fishers\n- The government uses the system to control how much fishing occurs, protecting fish stocks from being over-exploited\n\n**Who does this affect?**\n- **Commercial fishers** who use ocean hauling (large net) methods off NSW\n- **Anyone wanting to enter** the ocean hauling industry — you'd need to buy shares\n- **Existing licence holders** whose rights and obligations are defined by this regulation\n- **Fish processors and seafood businesses** that rely on ocean hauling catch supply\n\n**Why does it matter?**\nThis regulation is the legal backbone for managing a significant commercial fishery. It determines who can fish, how much they can fish, and the rules around trading fishing rights. Get it wrong and you could face serious penalties or lose your fishing rights entirely.\n\n**Note:** This regulation has been amended **many times** since it was made in 2006 (over 20 versions), meaning the rules have changed significantly over the years.
