Schedule 1 lists specific conduct (commercial and recreational fishing, licence/processor obligations, device and VMS rules) and the points for expiated, first, and repeat offences; clause 4 links those entries to s.104(1) of the Act and to s.120.\n\nThe rules affect commercial and recreational fishers, licence holders, registered masters, fish processors and vessel owners. Many offences turn on Ministerial determinations (recording, reporting, conditions), so compliance and reporting duties fall on operators."},"issue_detection":{"absurdities":[],"contradictions":[]},"summary":{"complexity_score":2,"scope_assessment":{"changed":false,"description":"Scope cannot be assessed as the legislative text was not retrievable. If you break fishing rules, you accumulate points. Rack up too many, and the Minister can suspend or cancel your fishing licence (a \"fishery authority\") or disqualify you from holding one.\n\n**Who It Affects**\n\n*   **Commercial fishers**: Those operating in specific fisheries (abalone, rock lobster, prawns, etc.).\n*   **Recreational fishers**: Weekend anglers and charter boat clients.\n*   **Fish processors**: Businesses handling, storing, or selling seafood.\n*   **Boat masters and agents**: Anyone in charge of a registered fishing vessel.\n\n**How It Works**\n\nThe regulations don't create new crimes; they assign **penalty points** to existing offences found in the *Fisheries Management Act 2007* and over a dozen other regulations (covering everything from abalone to sardines).\n\n**Schedule 1** is the heart of the document. It lists hundreds of specific offences and assigns a point value (from 5 to 100). The number of points depends on:\n\n*   **Severity**: Serious environmental crimes (like taking protected species, using explosives, or fishing without a licence) attract **100 points**. Minor paperwork slips attract **5 points**.\n*   **Your History**: Many offences have a sliding scale—**first offence** (fewer points), **second offence** (more points), **third or subsequent** (maximum points).\n*   **How You Dealt With It**: If you pay an on-the-spot fine (called **expiation**), you usually get fewer points than if you are prosecuted in court.\n*   **How Much You Took**: Bag limit breaches are often calculated by the fish. For example, exceeding your Snapper limit by 1 fish might be 10 points, but by 20 fish is 25 points.\n\n**Why It Matters**\n\nThis is essentially the **sentencing table** for fisheries offences. It tells fishers exactly how much \"trouble\" they are in for specific actions—whether it's using the wrong net in the Coorong, failing to tag a rock lobster pot, or possessing undersize fish. It provides transparency and ensures consistent penalties across the industry."}},"importantCases":[],"_links":{"self":"/api/acts/fisheries-management-demerit-points-regulations-2017","history":"/api/acts/fisheries-management-demerit-points-regulations-2017/history","analysis":"/api/acts/fisheries-management-demerit-points-regulations-2017/analysis","conflicts":"/api/acts/fisheries-management-demerit-points-regulations-2017/conflicts","importantCases":"/api/acts/fisheries-management-demerit-points-regulations-2017/important-cases","documents":"/api/acts/fisheries-management-demerit-points-regulations-2017/documents"}}
