These changes broaden who decides (Minister, Commission, CEO), who pays (Commonwealth backstops liabilities; levy‑payers fund the Special Account), and where enforcement can operate (including high seas and foreign waters subject to authorisations), so the Act goes beyond a narrow governance tweak to alter liability allocation, funding flows and enforcement jurisdiction."},"complexity_factors":["Large number of cross‑Act amendments (Fisheries Administration Act 1991, Fisheries Management Act 1991, Torres Strait Fisheries Act 1984, Migration Act 1958) increasing drafting and compliance complexity","Major governance redesign splitting functions between a Commission (domestic) and a CEO (foreign compliance) with different appointment, tenure and conflict rules (see new sections 10B, 11, 12)","Shift of financial risk and property (financial liabilities and assets) to the Commonwealth and creation of a dedicated Special Account with a formula for levies (sections 10A, 94B–94E, transitional items 138–141)","Extensive delegation and sub‑delegation paths (Commission→CEO→AFMA staff/committees/consultants) introducing layered chains of command and directions (sections 92–93)","New and reworked criminal offences and extra‑territorial reach for international fisheries measures, including strict liability and Attorney‑General consent requirements (Schedule 3: sections 87HA, 105E–105J)","Detailed transitional provisions vesting contracts, assets, liabilities and staff and preserving existing processes (Schedule 1, Part 2 items 135–156) that create implementation risk","Increased administrative burdens: mandatory disclosure registers, minutes, reporting and selection committee procedures (sections 20, 23, 87, Division on Selection Committees)","Regulatory discretion left to Minister and regulations for procedural limits (directions to CEO s.10C; regulations referenced in 87HA(5) and seizure forfeiture exemptions s.88A)","Interlocking references, repeals and renames across many provisions (numerous repeals/replacements), raising risk of interpretive friction"],"plain_english_summary":"This Act reorganises the Australian Fisheries Management Authority (AFMA). New governance structure for AFMA (Schedule 1)**\nThe Australian Fisheries Management Authority (AFMA) gets a complete governance overhaul. Instead of a board of directors, AFMA now has:\n- A **Commission** (up to 8 part-time commissioners plus a CEO) that handles domestic fisheries management\n- A **Chief Executive Officer (CEO)** who handles foreign compliance matters and assists the Commission\n\nThe CEO is also a commissioner but can't be directed by the Commission on foreign compliance or public service matters. Commissioners must have expertise in fields like fisheries management, science, economics, or law—but can't hold fishing concessions or executive positions in fishing industry bodies. The Minister can give written directions to the CEO about foreign compliance (which must be tabled in Parliament, unless against the national interest).\n\nAFMA's property and liabilities transfer to the Commonwealth, with a new \"AFMA Special Account\" established for funding. Staff become public servants under the Public Service Act.\n\n**2. Tighter rules on foreign boats \"equipped for fishing\" (Schedule 2)**\nForeign boats passing through Australian waters must now have **all** fishing equipment—not just nets and traps—**stowed** (disengaged, secured, and stored inside where practicable). This includes associated equipment like buoys and beacons. The old looser wording about \"stored and secured\" is replaced with a precise definition of \"stowed.\"\n\n**3. Extended powers over boats beyond Australian waters (Schedule 3)**\nAustralian officers gain new powers to pursue and board foreign boats on the **high seas** and even in **foreign waters** if they suspect violations of international fisheries agreements. This replaces narrower WCPFC-specific rules with a broader framework covering any \"international fisheries management organisation.\"\n\nNew offences are created for:\n- Using a foreign boat to breach international fisheries measures on the high seas (strict liability: 60 penalty units; or up to 500 penalty units for intentional breaches)\n- Australian nationals using foreign boats to breach measures in foreign waters\n- Foreign boats fishing on the high seas without proper authorisation from their home country\n\nThe Attorney-General must consent before prosecuting non-Australian nationals for these offences.\n\n**4. Powers over \"support boats\" (Schedule 4)**\nAustralian officers can now pursue and board boats **outside the AFZ** that are supporting illegal fishing inside Australian waters—whether Australian or foreign boats. Previously, powers stopped at the edge of Australian waters. Now, if a support boat is helping another boat commit offences inside the AFZ, officers can pursue it beyond the zone and exercise full inspection powers."},"flash_summary_failed":{"failed":true,"reason":"Unauthenticated.
