applicant for a first home owner grant is also ineligible if the applicant or the applicant's spouse or domestic partner—\n\t(a)\tcould have successfully applied for a first home owner grant under this Act or a corresponding law in respect of an earlier transaction to which he or she was a party but did not do so; or\n\t(b)\tcould, assuming that he or she had then been an Australian citizen or housing construction grant rather than the purchaser; and\n\t(e)\tthe Commissioner may, by written notice, require the first grant recipient to repay the amount of the housing construction grant that has been paid to him or her.\n\t(4)\tIf, in a case where subsection (2)(a) has applied, and the Commissioner issues a notice under subsection (3)(e), the first grant recipient must also pay to the Commissioner, at the time of repayment of the amount of the housing construction grant paid to the first grant recipient, an additional amount equal to the amount of the grant unless the Commissioner is satisfied that the first grant recipient genuinely changed his or her intention about not entering into a contract of a kind referred to in subsection (2)(a)(ii) due to extraordinary and unforeseen circumstances occurring after the housing construction grant was paid to the first grant recipient.\n\t(5)\tAn amount payable under subsection (3)(e) or (4) (or both) must be paid to the Commissioner with the condition prescribed by subsection (2) is guilty of an offence.\n21—Conditions generally\n\t(1)\tThe Commissioner may authorise the payment of a first home owner grant on conditions the offence.\n22—Death of applicant\n\t(1)\tAn application for a first home owner grant does not lapse because an applicant dies before the application is decided.\n\t(2)\tIf an applicant dies before the application is decided, the following provisions apply:\n\t(a)\tif the deceased was one of 2 or more applicants and one or more applicants survive, the application is to be dealt with as if the surviving applicants were the sole applicants;\n\t(b)\tin any other case, a first home owner grant, if payable on the application, is to be paid to the estate of the deceased.\n\t(3)\tIf a deceased applicant for a first home owner grant had not, by the date of death, complied with the residence requirement but the Commissioner is satisfied that he or she intended to do so, the residence requirement is satisfied.\n23—Power to correct decision\n\t(1)\tIf the Commissioner decides an application, and is later satisfied (independently of an objection under this Act) that the decision is decision\n\t(1)\tWhen the Commissioner decides an application (or decides to vary or reverse an earlier decision on an application) the Commissioner must give the applicant notice of the decision.\n\t(2)\tIf the decision is to authorise the payment of a first home owner grant without conditions, the payment of the grant is sufficient notice of the decision.\n\t(3)\tIf the decision is initiative, write off the whole or part of a liability to pay an amount to which this section applies if satisfied that action, or further action, to recover the amount outstanding is impracticable or engaged in work related to the administration of this Act.\nprotected information means information obtained in the course of work related to the administration of this Act about an applicant for a first home owner grant or such an applicant's spouse or domestic partner;\n\t(2)\tA person who is subject to a duty of confidentiality must not disclose protected information except as permitted by of the penalty.\n\t(3)\tA copy of a notice issued by the Commissioner requiring the payment or repayment of a specified amount is admissible in legal proceedings as evidence—\n\t(a)\tthat the requirement was made; and\n\t(b)\tthat the amount specified in the notice was outstanding at the date of the notice.\n43—Time for commencing prosecution\nProceedings for an offence against this Act the Crown.\n46—Regulations\n\t(1)\tThe Governor may make regulations for the purposes of this Act.\n\t(2)\tA regulation may prescribe a penalty (not more than $2 500) for contravention of the regulation.\n\t(3)\tA regulation made for the purposes of a provision of this Act that operates retrospectively may itself operate retrospectively provided that it does not do so to the prejudice of The amount varies ($7,000–$15,000) depending on when the transaction started and whether it's a new home.\n\n- **Housing Construction Grant**: Payments specifically for building or buying *new* homes (ran from October 2012 to December 2013).\n\n- **Seniors Housing Grant**: Payments for people aged 60+ buying or building new homes (ran from July 2014 to June 2016).\n\n- **HomeBuilder grants**: Extended the Act to cover federal COVID-era grants (from 2020).\n\n**Who qualifies:** You must be a natural person (not a company), at least 18, an Australian citizen or permanent resident, and neither you nor your spouse/domestic partner can have owned residential property before (with some exceptions). You must also live in the home as your main residence for at least 6 months.\n\n**Key features:** The Commissioner of State Taxation decides applications, can investigate claims, and can require repayment if people don't meet conditions. There are complex rules about market value caps (currently $650,000), timing of contracts, and preventing \"scheme\" arrangements to game the system. The Act also integrates with newer federal programs like Help to Buy (2024)."},"flash_summary_failed":{"failed":true,"reason":"Unauthenticated. Configure AI_GATEWAY_API_KEY or use a provider module.
