It does not expand the legal purposes or create new kinds of payments beyond what the Act and the Intergovernmental Agreement already contemplate (supporting outputs/projects, facilitating reforms, rewarding nationally significant reforms). The instrument allocates specific amounts and applies existing rules on milestone-based payments and the statutory debit limit, so it remains within the original, narrowly financial scope of the Federal Financial Relations framework (see ss5–7, 15)."},"complexity_factors":["Short instrument (few substantive clauses) with a single, routine administrative purpose","4 defined terms in the interpretation section (Act, COAG Reform Fund, Intergovernmental Agreement, State) (s3)","Cross-references to other legislation and instruments (Federal Financial Relations Act 2009; COAG Reform Fund Act 2008; Intergovernmental Agreement; Public Governance, Performance and Accountability Act 2013) (ss6–8)","Conditional logic for payments when milestones/performance benchmarks are required (ministerial/delgate determinations, independent assessments) (s10)","Numeric debit limit and cumulative accounting requirement for the financial year (ss15–17)","Large Schedule 1 with multiple line-item payments (tables embedded as images) increases operational detail though not legal complexity"],"plain_english_summary":"**What this instrument does (plain English)**\n\n- This is a Treasurer's determination under the Federal Financial Relations Act 2009 that authorises a set of National Partnership payments to the States and Territories. (A \"determination\" is a written instrument the Treasurer can make under that Act.) (see s12)\n\n- The amounts are first credited to the COAG Reform Fund (a Commonwealth special account) and then paid to the States on 7 October 2016. (see ss6, 13)\n\n- The payments are for three possible purposes: supporting delivery of specified outputs or projects; facilitating reforms by States; or rewarding States for nationally significant reforms. (see s5)\n\n- The determination lists the recipients and amounts in Table 1 and provides detailed line items in Schedule 1. (see s12 and Schedule 1)\n\n- If payments depend on pre‑determined milestones or performance benchmarks, the relevant Commonwealth Minister (or the Minister's delegate) will decide whether the payment is payable after receipt of either an independent assessment (for incentive/reward payments) or the expenditure and performance reporting required by the National Partnership (for facilitation/project payments). If no benchmark is required, payments follow the payment profile in the National Partnership. (see s10–11)\n\n- The total amount credited to the COAG Reform Fund for National Partnership payments in the 2016–17 financial year must not exceed a statutory debit limit of $10,416,666,667; Table 2 shows cumulative totals and confirms the limit is not exceeded. (see ss15–17)\n\n- The instrument is a legislative instrument but is exempt from parliamentary disallowance under the Legislative Instruments Act 2003. (see s4)\n\n\nWho it affects\n\n- The Commonwealth (Treasurer and relevant Ministers or delegates) — they decide when performance conditions are met and direct payments. (see ss12, 10)\n- State and Territory governments — they are the recipients and must comply with the written National Partnership agreements, performance reporting and milestones. (see ss5–9)\n- The COAG Reform Fund (the special account that holds the money before payment). (see s6)\n\n\nWhy it matters (mechanically, not politically)\n\n- It authorises and budgets a set of intergovernmental payments to States on a specific date and sets the mechanics for conditional payments (who assesses performance, and what evidence is used). (see ss12–13, 10)\n- It channels money through a special account with a statutory annual cap, so those payments count against the Commonwealth's debit limit for National Partnerships in 2016–17. (see ss6, 15)\n- It reduces one form of parliamentary oversight of this particular instrument by making it exempt from disallowance, which changes the review route available to parliamentarians (though other oversight and accountability arrangements in the National Partnership and the Public Governance, Performance and Accountability framework continue to apply). (see s4, s6)\n\n\nHow the instrument achieves its stated aims and the trade-offs it creates\n\n- Mechanism: the Treasurer determines amounts -> amounts are credited to the COAG Reform Fund -> funds are paid to States per the National Partnership payment schedule or after performance milestones are certified. (see ss6, 10, 13)\n\n- Incentives and likely behavioural effects: by linking some payments to independent assessments or to reporting against milestones, the instrument creates incentives for States to meet specified milestones and to produce the required reporting. (see s10)\n\n- Compliance and administrative costs: States must meet reporting and milestone requirements set out in the National Partnerships; the Commonwealth must manage assessments and delegate determinations (administrative burden and implementation risk). (see ss7, 10)\n\n- Decision authority: Ministers or their delegates make the final calls on whether benchmarks have been met (introduces executive discretion in payment timing). (see s10)\n\n- Fiscal trade-offs: the payments use Commonwealth budget capacity and count against the annual debit limit; those funds are not available for other Commonwealth spending. (see s15)\n\n- Oversight trade-offs: exemption from disallowance narrows one parliamentary check on the instrument (see s4); routine audit, reporting or the terms of written agreements remain relevant oversight tools. (see s7)\n\n- Distribution of benefits and costs: benefits are concentrated on the named States/Projects that receive the payments (Schedule 1); costs are borne by the Commonwealth budget/taxpayers and by States that must meet milestones and associated compliance costs.
