(See section 12 and Table 1.)\n- Before the payments are made, the amounts are credited into the COAG Reform Fund (a special Commonwealth account). (See sections 6 and 13.)\n- The Determination records how and when payments are to be made on 7 June 2016 and lists the amounts and recipient States in Schedule 1 (Table 1 and Schedule 1).\n- If payments depend on pre-set milestones or performance benchmarks, the relevant Commonwealth Minister (or a delegate) decides whether the payment is payable after receiving either an independent assessment (for incentive/reward payments) or expenditure/performance reports (for facilitation/project payments). If no benchmark is required, payments follow the scheduled profile in the relevant National Partnership agreement. (See sections 10–11.)\n- The Determination checks that total National Partnership payments for the 2015–16 financial year do not exceed the statutory debit limit of $25,000,000,000. (See sections 15–17 and Table 2.)\n- The instrument is made under section 16 of the Federal Financial Relations Act 2009 and is a legislative instrument that is exempt from parliamentary disallowance under section 42 of the Legislative Instruments Act 2003 (by virtue of subsection 16(5) of the Act). (See front matter and section 4.)\n\n\n**Who is affected\n\n- The Commonwealth (Treasury/Finance) — it credits and then pays money from the COAG Reform Fund and must respect the debit limit (sections 6, 13, 15).\n- The relevant Commonwealth Minister or delegate — they have decision-making power over whether conditional payments are made after assessment or reporting (section 10).\n- States and Territories — recipients of the grant payments; they must meet any contractual reporting or milestone conditions in their National Partnership agreements (sections 5, 7, 9–11).\n- Agencies and auditors — responsible for administering, reporting and verifying performance and expenditure under the National Partnerships.\n\n\n**Why it matters (practical effect and incentives)\n\n- It moves federal money to States to fund specific outputs, projects or to support reforms (section 5). That channels Commonwealth funding into state-level programs that have been negotiated as National Partnerships.\n- Where payments are tied to milestones or benchmarks, the instrument creates an incentive structure: States must meet agreed conditions to receive some payments (section 10). The Commonwealth controls the trigger for those payments through ministerial determinations.\n- The Determination preserves a central fiscal control (the $25 billion debit limit) on total National Partnership transfers for the year, constraining total Commonwealth commitments (sections 15–17).\n\n\n**Testing the stated purposes against costs, trade-offs and implementation risk\n\n- Purpose claim: support delivery, facilitate reforms, or reward nationally significant reform (section 5). Mechanically, that is implemented by: (a) specifying amounts and recipients (Table 1/Schedule 1); (b) routing funds through the COAG Reform Fund (section 6); and (c) attaching payment conditions and ministerial decision points where required (sections 7, 10).\n\n- Who pays: Commonwealth budget (credited to COAG Reform Fund) — this is an identifiable fiscal cost to the Commonwealth rather than to individual States (sections 6, 13).\n\n- Who decides: the Commonwealth Minister or a delegate has discretion to determine whether conditional payments are made after receiving assessments or reports (section 10). That concentrates decision authority at the Commonwealth level.\n\n- Compliance and administrative burden: States must enter a written agreement with the Commonwealth specifying terms (section 7). Where payments are conditional, States will face reporting and verification requirements tied to independent assessments or expenditure/performance reporting (section 10(b)).\n\n- Incentives and behaviour: the payment structure gives States a financial reason to meet agreed outputs or reforms to unlock funds. The Determination does not itself set policy detail — that is left to the National Partnership agreements — but it operationalises payments tied to those agreements (sections 8–11).\n\n- Trade-offs and risks: ministerial discretion to accept assessments/reports creates operational risk (delay or disagreement on whether benchmarks are met). There is potential for concentrated benefits (States that receive large payments) and diffuse costs (Commonwealth taxpayers funding those payments). The instrument leaves negotiation of the exact deliverables, benchmarks and reporting arrangements to the National Partnership agreements, so implementation detail and monitoring capacity matter in practice (sections 7–11, Schedule 1).\n\n\n**Bottom line (simple summary)\n\n- This is a routine, legally authorised list of Commonwealth payments to States via the COAG Reform Fund, with rules about how conditional payments are decided, a check against a statutory yearly debit cap, and requirements that each payment be governed by a written National Partnership agreement setting the detailed terms and reporting.
