The dollar amounts and the split between States are set out in the tables and Schedule 2 (tables shown as images in the instrument).\n\n- \"General purpose financial assistance\" means the States may use the money for any purpose (Part 2, para 5). The payments are ordinary, untied grants rather than funding for a designated program.\n\n- The amounts must be credited to the COAG Reform Fund (a Special Account) before payment (paras 6–7). That Fund and the account rules are established under the COAG Reform Fund Act 2008 and the Public Governance, Performance and Accountability framework (paras 6–8).\n\n- The Determination relies on the Intergovernmental Agreement on Federal Financial Relations (the IGA). The IGA's Schedule D (Payment Arrangements) provides the terms and conditions that apply to these general purpose payments; Schedule 1 of this Determination summarises those relevant provisions (paras 8–9 and Schedule 1).\n\n- The Determination notes and respects a statutory cap on the total general purpose assistance that may be credited to the COAG Reform Fund in the 2016–17 financial year: $5,000,000,000 (paras 12–14). Table 2 records the cumulative total for 2016–17 including this determination and states that the cap has not been exceeded.\n\n- The instrument is made under section 9 of the Federal Financial Relations Act 2009. It is a legislative instrument but is exempt from the ordinary parliamentary disallowance procedure (Legislative Instruments Act 2003 s 42) because subsection 9(5) of the Act disapplies that disallowance (para 4).\n\n\nWho it affects and why it matters\n\n- Who receives the money: the States (including the ACT and NT). The particular payment amounts to each State are set out in the Determination's tables and Schedule 2.\n\n- Who controls the money once paid: the States. Because these are general purpose payments, States are not legally constrained by the Determination to spend funds on particular services; they have discretion to allocate the money as they wish (para 5; see also reference to Schedule D of the IGA for payment arrangements).\n\n- Who sets the rules for the payments: the Commonwealth (through this Determination) decides the amounts and timing, but the legal terms and conditions are those in the IGA Schedule D and any written agreements required under the COAG Reform Fund Act (paras 8–9).\n\n- Financial constraints and oversight: the Determination must observe the statutory debit limit for the year (paras 12–14). Separately, because the instrument is not subject to parliamentary disallowance, the normal disallowance mechanism does not apply (para 4).\n\n\nMechanics, incentives and practical trade-offs (brief analysis)\n\n- Mechanic: Commonwealth credits specified amounts to the COAG Reform Fund (a Special Account) then pays them to States on the stated date. The IGA Schedule D and written agreements provide binding payment arrangements and any detailed terms.\n\n- Incentives and behaviours: States gain flexible revenue they can allocate as they prefer, which reduces the need for Commonwealth direction over how services are delivered. The Commonwealth retains control over timing and aggregate amounts of these transfers but not over specific State spending choices once funds are paid.\n\n- Concentration of benefits and costs: benefits are concentrated to the specific States receiving the payments (listed in the tables). The cost is borne by the Commonwealth budget (and ultimately taxpayers), subject to the statutory debit cap. The Determination itself does not change taxation or revenue collection—it authorises transfer of budgeted amounts.\n\n- Administrative and implementation points: the Determination depends on other instruments (Federal Financial Relations Act s 9, the COAG Reform Fund Act, the IGA Schedule D and written agreements). That cross‑referencing concentrates legal authority in external instruments. Practically, this reduces duplication but means the final legal obligations and detailed conditions sit in multiple documents.\n\n- Oversight and risk: the exemption from disallowance (para 4) means the instrument is not subject to the Parliamentary disallowance process under the Legislative Instruments Act 2003. The debit limit provides a statutory spending constraint for the year (paras 12–14). Compliance and interpretation risk chiefly arise from reading this Determination alongside the IGA Schedule D and the COAG Reform Fund Act (para 9).\n\n(Primary source paragraphs cited: Part 1 paras 1–4; Part 2 paras 5–9; Part 3 paras 10–14; Schedules 1 and 2.)"},"flash_summary_failed":{"failed":true,"reason":"Unauthenticated. It approves specific payments including compensation to Western Australia for royalty changes, extra ACT municipal‑services funding, and offshore petroleum‑royalty sharing, while keeping total 2016–17 general purpose payments within a $5 billion cap.  \n\nIt matters because these flexible, untied funds support state budgets and address resource‑revenue and national‑capital cost issues."}},"importantCases":[],"_links":{"self":"/api/acts/federal-financial-relations-general-purpose-financial-assistance-determination-no-96-march-2017","history":"/api/acts/federal-financial-relations-general-purpose-financial-assistance-determination-no-96-march-2017/history","analysis":"/api/acts/federal-financial-relations-general-purpose-financial-assistance-determination-no-96-march-2017/analysis","conflicts":"/api/acts/federal-financial-relations-general-purpose-financial-assistance-determination-no-96-march-2017/conflicts","importantCases":"/api/acts/federal-financial-relations-general-purpose-financial-assistance-determination-no-96-march-2017/important-cases","documents":"/api/acts/federal-financial-relations-general-purpose-financial-assistance-determination-no-96-march-2017/documents"}}
