It also shows cumulative payments for the 2015–16 year to demonstrate the payments do not exceed the statutory debit limit of $5,000,000,000 for that year. (see cl. 10, cl. 12–14 and Schedule 2)\n\n- The payments are \"general purpose\": the recipient States may use the money for any purpose. The legal and administrative terms for payments are set out in Schedule D (Payment Arrangements) of the Intergovernmental Agreement on Federal Financial Relations, and the COAG Reform Fund Act requires the Commonwealth and a State to record terms in a written agreement. (see cl. 5, cl. 8–9)\n\n- The instrument is a legislative instrument but is expressly exempted from parliamentary disallowance under the Legislative Instruments Act 2003, meaning Parliament cannot disallow it under section 42 of that Act. (see cl. 4)\n\nWho this affects\n\n- Primary recipients: the Australian States and the two Territories (ACT and NT). The determination specifies payments to each jurisdiction. (see cl. 3 for definition of \"State,\" cl. 10 and Schedule 2)\n\n- The Commonwealth Government: makes the transfers and credits the COAG Reform Fund as the delivery mechanism. The Treasurer is the decision-maker under the Act. (see opening recital and cl. 10)\n\nWhy it matters (purpose claims and mechanical implications)\n\n- Stated purpose: to provide financial support for States' service delivery efforts by transferring funds the States can use for any purpose (general purpose financial assistance). (see cl. 5)\n\n- Mechanically, the measure increases State cash balances and reduces Commonwealth cash or available appropriation to the same extent. Because the assistance is general purpose (no ring-fencing of use), it changes the States' resource constraint without imposing specific Commonwealth program rules.\n\n- The determination operates inside an existing framework: the Intergovernmental Agreement (Schedule D) governs payment mechanics and any written agreement between Commonwealth and a State sets the terms and conditions for payments processed through the COAG Reform Fund. (see cl. 7–9)\n\nCosts, incentives and implementation trade-offs (mechanisms, not judgments)\n\n- Who pays and who benefits: the Commonwealth (taxpayers broadly) funds the transfers; benefits are concentrated in the recipient States. (see cl. 10 and Schedule 2)\n\n- Conditionality and behavioural effect: because the assistance is expressly \"general purpose,\" the States face few (if any) Commonwealth-imposed constraints on how the money is spent. That increases State discretion over spending choices. (see cl. 5)\n\n- Opportunity cost and fiscal effect: funds used for these payments are not available for other Commonwealth priorities; the determination must respect the statutory debit limit for the financial year, which caps cumulative general purpose payments at $5 billion for 2015–16. (see cl. 12–14)\n\n- Administrative and compliance features: the COAG Reform Fund is a Special Account (PGPA Act framework) and the payments must be credited to that account before being paid. Terms are recorded in written agreements and the Intergovernmental Agreement. Implementation depends on account-crediting and agreement processes. (see cl. 6–9)\n\n- Parliamentary scrutiny: the exemption from the Legislative Instruments Act disallowance provision reduces one avenue of parliamentary oversight of this specific determination. (see cl. 4)\n\nConcrete examples of items covered under the payment arrangements (Schedule 1 summary)\n\n- The instrument re-states existing payment arrangements that are routinely delivered as general purpose assistance: e.g. compensation to Western Australia for certain lost royalty revenue (excise-related), special municipal services funding to the ACT linked to national capital responsibilities, and royalty sharing arrangements for offshore petroleum and specific arrangements for the Ranger (uranium) project area in the NT. Those arrangements are implemented through the same Schedule D framework.
