This means if both provisions commence simultaneously, item 140 commences (because the MRRT item did not commence 'before') but Division 2 also does not commence (because FHS Act s3 commenced 'at or before'). Both items 140 and Division 2 are designed as alternatives — one for if this Act commences before the MRRT Act, one for after — but the simultaneous commencement scenario is handled inconsistently, with item 140 applying but Division 2 not, potentially leaving a gap where neither alternative amendment fully operates."},{"severity":"medium","section_a":"Schedule 2, item 93(c) — section 1227A continues to apply","section_b":"Schedule 2, item 86 — section 1230B amended to omit '1227A'","confidence":0.72,"description":"Item 93(c) preserves section 1227A of the Social Security Act 1991 for payments under the Farm Household Support Act 1992, treating it as if it still exists. Item 93(d) also preserves section 1230B. However, item 86 amends section 1230B to remove the reference to '1227A'. If section 1230B is preserved in its amended form (without the 1227A reference) under item 93(d), the cross-reference between 1230B and 1227A is severed — yet both are meant to be preserved as a functional unit for legacy payments. The amendment strips 1230B of its reference to 1227A precisely at the moment both are meant to continue operating together for legacy purposes."},{"severity":"medium","section_a":"Schedule 2, item 56 — application of amendments to Income Tax Assessment Acts","section_b":"Section 2, Commencement Table, Row 8 — Schedule 2, Part 2, Division 4 commences 26 February 2014","confidence":0.68,"description":"Item 56 provides that the Income Tax Assessment Act amendments 'apply in relation to payments made after this item commences, other than any such payment that relates to a day before this item commences.' This suggests a forward-looking application from commencement. However, Division 4 (items 143-146) amends the Income Tax Assessment Act 1997 and is deemed to have commenced on 26 February 2014 — before Royal Assent. If the application rule in item 56 governs Division 4, it would apply from 26 February 2014, but this pre-dates the Act's existence. Item 2 of Schedule 2 preserves the application of the (now repealed) definition of 'income support payment' from clause 1 of Schedule 1 to the Aged Care Act 1997 as if the amendment substituting a new definition had not been made — effectively requiring reliance on a definition sourced from a repealed Act. Similarly, items 6, 9, 24, 26, 58, and 93 all preserve the operation of provisions that depend on or reference the Farm Household Support Act 1992, which has been repealed. While savings provisions routinely preserve the effect of repealed provisions, the Act nowhere re-enacts or definitively preserves the substantive content of the 1992 Act's relevant definitions and provisions — it merely says they 'continue to apply as if' the repeal had not occurred, relying on a statutory ghost."}]},"flash_summary_failed":{"failed":true,"reason":"Unauthenticated. It does three main things:\n\n**1. Repeals the old law**\n- It scraps the *Farm Household Support Act 1992* (the old system that provided 'exceptional circumstances relief' and 'farm help income support').\n\n**2. Updates dozens of other laws**\n- It goes through many other Acts (tax law, social security law, aged care law, etc.) and replaces references to the old 1992 Act with references to the new *Farm Household Support Act 2014*.\n- It removes references to old payments that no longer exist (like 'dairy exit payments', 'farmers hardship bonus', and 'training and learning bonus').\n- It adds references to new payments like 'farm household allowance', 'activity supplement', and 'farm financial assessment supplement'.\n\n**3. Handles the transition**\n- It ensures people already receiving old payments (like transitional farm family payments or exceptional circumstances relief) don't get cut off abruptly.\n- It allows the Minister to make rules for how people move from old payments to the new 'farm household allowance'.\n\n**Who it affects:**\n- Farmers and their families who need income support during tough times (drought, financial hardship).\n- Government departments that administer these payments (Centrelink, Department of Agriculture).\n- Anyone dealing with tax or social security law where these payments are mentioned.\n\n**Why it matters:**\nThis Act is the 'plumbing' that makes the new farm household allowance system work. Without it, the new 2014 Act would sit in isolation, unable to interact properly with the tax system, social security system, or other government programs. It ensures continuity for farmers receiving support while switching from the old complex system to the new one."}},"importantCases":[],"_links":{"self":"/api/acts/farm-household-support-consequential-and-transitional-provisions-act-2014","history":"/api/acts/farm-household-support-consequential-and-transitional-provisions-act-2014/history","analysis":"/api/acts/farm-household-support-consequential-and-transitional-provisions-act-2014/analysis","conflicts":"/api/acts/farm-household-support-consequential-and-transitional-provisions-act-2014/conflicts","importantCases":"/api/acts/farm-household-support-consequential-and-transitional-provisions-act-2014/important-cases","documents":"/api/acts/farm-household-support-consequential-and-transitional-provisions-act-2014/documents"}}
