This changes the income threshold used in calculating family tax benefit payments.\n\n- Broadens the “large family supplement” eligibility so families with 3 or more children (previously 4 or more) can qualify, and adjusts the counting formula accordingly (Schedule 2).\n\n- Extends eligibility rules for the utilities allowance to include pension‑age people receiving certain allowances (Schedule 3).\n\n- Establishes a new, explicit Australian Government Disaster Recovery Payment (AGDRP) framework:\n - The Minister may declare events to be a “major disaster” and make written determinations (s.36 as substituted). The Minister also determines who is “adversely affected” for each disaster (Schedule 4, ss.36, 1061K–1061L).\n - Eligibility rules specify age, residency/citizenship/visa status, and that the person be adversely affected (1061K).\n - The statute sets default adult and child rates ($1,000 and $400) if the Minister has not fixed rates; the Minister may determine different rates and those determinations are legislative instruments (1061M–1061P).\n - Payment timing, instalments and claim time limits are set out; the Secretary may approve lodgment places outside Australia for overseas disasters (Schedule 4, various items).\n - The Income Tax Assessment Acts and social security means‑tests are amended to treat AGDRP appropriately (Schedule 4, Part 2 items 6–18).\n\n- Introduces a detailed maintenance income credit balance regime for family tax benefit reconciliation. It defines accruals and depletions to a notional credit balance tied to registered child support entitlements, with daily accrual math and annual depletion rules (Schedule 5, clauses 24A–24E). It also contains transitional rules applying back to earlier income years.\n\n- Extends carer payment entitlement for carers of certain severely disabled children by adding a new definition of “profoundly disabled child” for ages 6–15 and clarifying the care and employment restriction test (Schedule 6).\n\n- Creates a new, cross‑Act regime for “special disability trusts” to enable private trust provision for people with severe disabilities while limiting that trust’s effects on social security, veterans’ entitlements and tax tests:\n - Defines what makes a trust a special disability trust (beneficiary, purpose, deed, trustee, reporting, audit and property rules) and allows the Secretary/Commission to make guidelines or determinations (Social Security Act: Part 3.18A, ss.1209L–1209U; Veterans’ Entitlements Act: Division 11B, ss.52ZZZW–52ZZZWH).\n - Provides that income and assets held in a qualifying trust are, with limits, not attributed to the beneficiary for means‑test purposes (asset value limit $500,000, indexed) (1209V, 1209Y / 52ZZZV I, 52ZZZWK).\n - Permits transfers into the trust by immediate family members without being treated as disposals for capital gains/means‑test purposes up to the $500,000 limit, and sets rules and formulas if the limit is exceeded or if the trust ceases to be special (1209Z–1209ZD; 52ZZZWL–52ZZZWP).\n - Imposes reporting and audit obligations on trustees and prohibits some commercial dealings between trusts and immediate family members (1209S–1209T; 52ZZZWF–52ZZZWG).\n\n- Reorganises the Australian Institute of Family Studies governance: replaces the Board with a single statutory Director (Family Law Act amendments, Schedule 8). The Director is appointed by the Minister, must be full‑time, is subject to ministerial directions of a general nature (legislative instrument), must report annually, and may be delegated some powers.\n\n- Makes a set of technical and administrative amendments to family assistance and child care estimation rules, family law terminology (shared parental responsibility), child support references, and minor corrections across Social Security and Administration Acts (Schedules 9–13).\n\n**Who is affected — the principal groups**\n\n- Families receiving or claiming family tax benefits and child care benefits: threshold and benefit‑calculation changes, quarantining rules, and new maintenance credit mechanics (Schedules 1, 5, 9, 10, 11).\n\n- People directly impacted by declared disasters: individuals (16+ or social‑security recipients) who are Australian residents/citizens or certain visa holders and are “adversely affected” as determined by the Minister; carers of dependants get extra child‑component amounts (Schedule 4).\n\n- Carers of severely disabled children (age 6–15): eligibility extended where care is continuous and employment is severely restricted (Schedule 6).\n\n- Families or individuals planning private financial provision for a severely disabled person: the special disability trust rules change how trusts interact with social security, veterans’ entitlements and income tax (Schedule 7 across Social Security, Veterans’ Entitlements and Income Tax Acts).\n\n- Trustees and advisers: new compliance obligations (annual financial statements, audits on request), deed requirements, trustee residency/character tests, and limits on dealing with family members (Schedule 7).\n\n- The Australian Institute of Family Studies, and through it users of its research: governance and accountability change from a Board to a Minister‑appointed Director (Schedule 8).\n\n**Why it matters (official purpose claims and practical tests)**\n\n- Official claims: the Act packages a set of budget and administrative measures to adjust family payments, provide disaster relief, extend carer and disability support, enable private financial provision for people with disabilities, and streamline administrative arrangements (Schedules referenced above). The AGDRP creates a statutory disaster payment with clear eligibility and rates; special disability trusts are intended to allow families to hold assets for a disabled person without unduly affecting means tests.\n\n- Costs and who pays: payments (FTB increases, AGDRP, carer payment extension) are funded by the Commonwealth. The special disability trust regime shifts some means‑test relief to trusts, which reduces social security offsets for beneficiaries but imposes reporting/audit costs on trustees and compliance costs on the Department and tax authorities (see Schedule 7: trust reporting/audit provisions). If a trust ceases to qualify within 5 years, prior transfers can be treated as disposals and taxed or assessed (1209ZD / 52ZZZWP).\n\n- Decision makers and discretion: multiple provisions give administrative discretion to Ministers, the Secretary or the Commission:\n - Minister can declare a major disaster, determine who is “adversely affected” and set AGDRP rates (Schedule 4, ss.36, 1061L, 1061P). Some of those determinations are legislative instruments but certain procedural safeguards (section 42 of the Legislative Instruments Act) do not apply to some of them.\n - Secretary/Commission may make guidelines, waive requirements, approve auditors and delegate powers (Schedules 4, 7, 8).\n This architecture centralises consequential policy and operational choices in executive agencies and the responsible Minister.\n\n- Incentives and behaviour effects:\n - Families may create qualifying special disability trusts or restructure assets to preserve eligibility for pensions and allowances (Schedule 7). The $500,000 trust asset cap and the restriction on transfers from the beneficiary or recent bequests limit the scope but encourage use of trusts up to that cap. Trustees face reporting/audit requirements, creating compliance costs and use for professional trustees/advisers.\n - The AGDRP’s simple statutory amounts (default $1,000 adult / $400 per child when no ministerial rates set) create a predictable one‑off relief payment and an incentive for affected individuals to claim promptly (time limits and Secretary discretion for late claims are provided) (Schedule 4, 1061M, Subdivision FA).\n - Maintenance income credit balances change family tax benefit reconciling: registered child support entitlements can generate credit accruals or depletions, which may alter incentives around timely child support payments, registration, and reporting to the Secretary (Schedule 5, clauses 24A–24E).\n\n- Trade‑offs and opportunity costs:\n - The special disability trust carve‑outs reduce the immediacy of means‑test impacts for some beneficiaries but require administrative oversight (audits, financial statements) and carve out some asset classes (e.g., compensation is excluded). There is scope for concentrated benefits (families with resources and access to legal/advisory services) and increased administrative burden on trustees and agencies (Schedule 7).\n - Granting Ministers and agencies power to make determinations and legislative‑instrument rules without full application of ordinary procedural safeguards accelerates operational implementation but reduces parliamentary and judicial visibility of some details (notably where subsection 42 of the Legislative Instruments Act is excluded for certain determinations — see 1061K(3), 1061L(3), 1061P(6)).\n\n**Practical implementation and compliance risks**\n\n- Special disability trusts introduce new, layered compliance (deed form, trustee checks, annual statements, audits on request) that will require trustee education and departmental processing capacity (Schedule 7, ss.1209P–1209T).\n\n- AGDRP relies on the Minister’s timely disaster declarations and written determinations of who is “adversely affected”; the Minister’s operational choices will materially affect who receives payments and how quickly (Schedule 4, s.36 and Division 1–2 of Part 2.24).\n\n**Who pays, who decides, what behaviour changes (summary)**\n\n- Who pays: the Commonwealth funds increased family assistance, AGDRP and affected social security payments.\n- Who decides: Minister (major disaster declarations, rates), Secretary/Commission (eligibility guidelines, waivers, audit approvals), trustees (in relation to trust operation) and courts/registries for certain procedural matters.\n- Behaviour changes: use of special disability trusts for means‑test planning; claims for AGDRP after disaster declarations; trustees complying with reporting/audit obligations; possible changes in timing of returning to work for Part B FTB quarantining calculations; changes in family assistance reconciliation due to maintenance income credit balances.\n\n(References: Schedule 1 — FTB Part A; Schedule 2 — Large family supplement; Schedule 4 — AGDRP (ss.36, 1061K–1061P, Subdivision FA); Schedule 5 — maintenance income credit balances (clauses 24A–24E); Schedule 6 — carer payment extension (s.197(2AA)); Schedule 7 — special disability trusts (Social Security Act ss.1209L–1209ZD; Veterans’ Entitlements Act Division 11B ss.52ZZZW–52ZZZWP); Schedule 8 — Institute governance (Family Law Act, new ss.114C–114LC); Schedules 9–13 — technical, administrative and definitional amendments.)"},"kimi_summary":{"_metrics":{"completionTokens":974},"content_quality":"ok","complexity_score":8,"scope_assessment":{"changed":true,"description":"The legislation began as a 2006 Budget measures bill but expanded significantly beyond typical budget implementation.
