These Regulations may be cited as the Exports (Canned and. Frozen Fruits) Regulations.\n\nRepeal and saving.\n\n2.—(1.) The Statutory Rules specified in the First Schedule are repealed.\n\n(2.) Every number and word allotted, certificate and permit issued, approval and notice given, appointment and declaration made, and brand and export establishment registered under the Regulations repealed by the last preceding sub-regulation and in force or subsisting immediately before the commencement of these Regulations shall be deemed to have been allotted, issued, given, made or registered, as the case may be, under these Regulations.\n\nParts.\n\n3. These Regulations are divided into Parts, as follows:—\n\nPart I.—Preliminary (Regulations 1-6).\n\nPart II.—General Provisions as to Exportation (Regulations 7-8).\n\nPart III.—Trade Descriptions (Regulations 9-12).\n\nPart IV.—Inspection and Examination (Regulations 13-17).\n\nPart V.—Registration of Brands (Regulations 18-23).\n\nPart VI.—Miscellaneous (Regulations 24-27).\n\nInterpretation.\n\n4.—(1.) In these Regulations, unless the contrary intention appears—\n\n\"analyst\" means a person appointed as an analyst under regulation 24 of these Regulations;\n\n![](image.003.png)\"brine\" means a clear solution of sodium chloride in potable water;\n\n\\* Notified in the Commonwealth Gazette on , 1954.\n\n845.—Price 1s. 9d. 9/23.6.1954.\n\n \n\n\"can\" includes an immediate container made of tin, glass or other material approved by the Secretary;\n\n\"canned\" means preserved by heat sterilization, with or without syrup, fruit juice or water, and enclosed in a hermetically sealed can;\n\n\"export establishment\" means premises registered under regulation 7 of these Regulations as an export establishment\n\n\"frozen\" means preserved by freezing, with or without the addition of sugar, syrup or brine;\n\n\"fruit\" includes mixed fruits, fruit salads and vegetables;\n\n\"Maraschino cherries\" means white pitted cherries, coloured red with harmless and reasonably fast dye approved by the Secretary;\n\n\"officer\" has the same meaning as in the Commerce (Trade Descriptions) Act 1905-1950;\n\n\"registered brand\" means a brand registered under these Regulations;\n\n\"season\" means the period commencing on the first day of November in any year and ending on the thirty-first day of October in the succeeding year;\n\n\"State\" includes a Territory of the Commonwealth to which the Customs Act 1901-1953 and the Commerce (Trade Descriptions) Act 1905-1950 apply;\n\n\"syrup\" means a clear solution of pure cane sugar in potable water;\n\n\"the Department\" means the Department of Commerce and Agriculture;\n\n\"the Minister\" means the Minister of State for Commerce and Agriculture;\n\n\"the repealed Regulations\" means the Regulations repealed by regulation 2 of these Regulations;\n\n\"the Secretary\" means the person for the time being holding, or performing the duties of, the office of Secretary to the Department.\n\n(2.) In these Regulations, a reference to a Schedule by number shall be read as a reference to the Schedule to these Regulations so numbered, and a reference to a Form by number shall be read as a reference to the Form so numbered in the Fourth Schedule to these Regulations.\n\n(3.) Strict compliance with the forms contained in the Fourth Schedule is not necessary, and substantial compliance with those forms is sufficient.\n\nApplication of Regulations.\n\n5.—(1.) These Regulations do not apply to ships' stores brought to or shipped in Australia.\n\n(2.) The Secretary may certify, in respect of canned or frozen fruit specified in the certificate, that, for the purposes of experiment or on account of exceptional circumstances, it is desirable that such provisions of these Regulations as are specified in the certificate should not apply to or in relation to that fruit, and, upon the issue of that certificate, those provisions do not apply.\n\n \nDelegation.\n\n6.—(1.) The Secretary may, in relation to a particular matter or class of matters, by writing under his hand, delegate to an officer all or any of his powers and functions under these Regulations, except this power of delegation, so that the delegated powers or functions may be exercised or performed by the delegate with respect to the matter or class of matters specified in the instrument of delegation as fully and effectually as by the Secretary.\n\n(2.) A delegation under this regulation is revocable at will and does not prevent the exercise of a power or the performance of a function by the Secretary.\n\nPart II.—General Provisions as to Exportation.\n\nRegistration of export establishments.\n\n7.—(1.) A person who is the owner or occupier of premises used for the processing, packing and storage of canned or frozen fruit intended for export may apply to the Secretary, in accordance with Form 1, for the registration of the premises as an export establishment.\n\n(2.) If the Secretary is satisfied that the premises referred to in the last preceding sub-regulation are constructed, equipped and operated in an efficient and hygienic manner, he may register the premises as an export establishment.\n\n(3.) The Secretary shall allot to each premises registered under this regulation a number and issue a certificate of registration in accordance with Form 2.\n\n(4.) The registration of an export establishment shall remain in force until it is cancelled by the Secretary or the premises cease to be used for the processing, packing and storage of canned or frozen fruit.\n\n(5.) Whenever the Secretary is satisfied that an export establishment is not constructed, equipped or operated in an efficient or hygienic manner, he may cancel its registration.\n\n(6.) A certificate in accordance with Form 2 signed by the Secretary is evidence of the facts stated in the certificate.\n\nExport of canned and frozen fruit prohibited except subject to conditions.\n\n8.—(1.) The exportation of canned or frozen fruit is prohibited unless—\n\n(a) the Secretary is satisfied that the fruit has been prepared in an export establishment;\n\n(b) the conditions and restrictions specified in the Second and Third Schedules are complied with; and\n\n(c) the exporter has obtained an export permit in accordance with these Regulations in respect of the fruit and the export permit is in force when the fruit is exported.\n\n(2.) For the purposes of the Third Schedule, the weight or the number of halves, quarters or whole pieces of fruit, as the case may be, required to be contained in a can shall relate to a thirty ounce (No. 2½) can.\n\n(3.) When a can smaller or larger than a thirty ounce can is used, the weight or number referred to in the last preceding sub-regulation shall be proportionately less or greater.\n\n \nPart III.—Trade Descriptions.\n\nExport of canned or frozen fruit prohibited unless trade description applied.\n\n9.—(1.) The exportation of canned or frozen fruit is prohibited unless there is applied to the fruit a trade description of such character, relating to such matters, and applied in such manner as is prescribed, either generally or in relation to the particular fruit, by the succeeding provisions of this Part, Part II. of the Second Schedule and the third column of the Third Schedule.\n\n(2.) This regulation applies to canned or frozen fruit, including fruit imported into Australia and not held in bond, unless the Secretary is satisfied that the fruit is not the produce of, or processed in, Australia.\n\nRequirements as to trade descriptions.\n\n10.—(1.) Subject to these Regulations, the trade description of canned or frozen fruit intended for export—\n\n(a) shall be in the form of a principal label or brand affixed to the body of the can and to the outside containers in a conspicuous, and reasonably permanent manner;\n\n(b) shall contain, in prominent and legible characters, a true description of the canned or frozen fruit together with the word \"Australia\" and may include, in addition, the name of the State in which the fruit was processed;\n\n(c) where the processor of the fruit is the exporter, shall include his name or registered brand or his name and registered brand;\n\n(d) where the processor of the fruit is not the exporter, shall include—\n\n(i) the name or registered brand, or the name and registered brand, of the exporter and, unless the exporter has set out the name and address of the processor of the fruit in the notice of intention to export, the name or registered brand, or the name and registered brand, of the processor of the fruit; or\n\n(ii) the name or registered brand, or the name and registered brand, of the processor of the fruit; and\n\n(e) shall specify the net weight of the canned or frozen fruit.\n\n(2.) Notwithstanding the last preceding sub-regulation, the Secretary may, subject to such conditions as he thinks fit, permit the name or brand of the consignee of the fruit to be included in the trade description in lieu of the name or registered brand of the exporter or processor.\n\n(3.) In the case of canned fruit, the trade description shall include the words \"in syrup\" when canned fruit is packed in syrup and the words \"in water\" or \"unsweetened\" when canned fruit is packed in water.\n\n(4.) In the case of frozen fruit, the trade description shall—\n\n(a) include the word \"frozen\" in conjunction with the name of the fruit; and\n\n(b) except in the case of vegetables, include a statement of the percentage of sugar, if any, added to the fruit or contained in the syrup.\n\n \n\n(5.) The description \"quick frozen\" shall not be applied to frozen fruit unless the temperature of the fruit has been reduced to below twenty-five degrees Fahrenheit within six hours after the packing of the fruit in the can.\n\n(6.) If canned or frozen fruit is packed in thirty ounce cans, the name of the fruit shall be set out in the trade description in bold and legible characters not less than three-eighths of an inch high.\n\n(7.) If canned or frozen fruit is packed in cans larger or smaller than thirty ounce cans, the name of the fruit shall be set out in the trade description in bold and legible characters the height of which shall bear the same proportion to three-eighths of an inch as the number of ounces in the can bears to thirty.\n\n(8.) If a pictorial representation of fruit is included in the trade description, it shall be a representation of the kind of fruit contained in the cans to which the pictorial representation is applied.\n\n(9.) Except as provided by the next succeeding sub-regulation, the portion of the trade description indicating the grade of the canned or frozen fruit shall be in bold and legible letters at least one-quarter of an inch high.\n\n(10.) The Secretary may permit a label approved by him and distinctive of a particular kind and grade of canned or frozen fruit to be applied to fruit of that kind and grade and, in that case, it is not necessary for the trade description to include a description of the grade of the fruits on the label affixed to the body of the can, but the grade of the fruit shall be marked on the outside containers in letters at least one inch high, if stencilled, and in letters at least three-quarters of an inch high, if printed on the outside containers or applied by means of printed paper labels.\n\nTrade description applies as at time of shipment.\n\n11. The trade description applied to canned or frozen fruit in accordance with these Regulations shall relate to the condition of the fruit at the time of shipment.\n\nTrade descriptions and official marks not to be interfered with.\n\n12. A person shall not, except by the authority of an officer, remove, alter or interfere with a trade description, official stamp or mark marked on or applied to any canned or frozen fruit that is intended for export and has been inspected by an officer.\n\nPenalty: Fifty pounds.\n\nPart IV.—Inspection and Examination.\n\nNotice of intention to export, and declaration.\n\n13. A person who intends to export canned or frozen fruit is not eligible to receive an export permit under regulation 16 of these Regulations unless, at least three clear working days before the proposed date of shipment, he furnishes to the Department a notice and declaration in writing in accordance with Form 3.\n\nFalse declarations.\n\n14.—(1.) A person shall not make a false or misleading statement in a declaration furnished in pursuance of the last preceding regulation.\n\nPenalty: Fifty pounds.\n\n \n\n(2.) In proceedings for an offence against the last preceding sub-regulation, a certificate signed by the Secretary certifying that the declaration was furnished in pursuance of the last preceding regulation, and was made by the person by whom it purports to have been made, is prima facie evidence of the matters certified.\n\n(3.) Judicial notice shall be taken of the signature of the Secretary appearing on a certificate under the last preceding sub-regulation and of the fact that the person by whom the certificate purports to have been signed is, or was at the time at which he signed the certificate, the Secretary.\n\nInspection of canned or frozen fruit in course of preparation for export.\n\n15. Canned fruit and frozen fruit are prescribed goods for the purposes of section 5 of the Commerce (Trade Descriptions) Act 1905-1950.\n\nExport permit and certificate as to examination of canned or frozen fruits.\n\n16.—(1.) Where an officer has inspected and examined canned or frozen fruit intended for export and—\n\n(a) the fruit is marked with a trade description in accordance with these Regulations; and\n\n(b) the officer is satisfied that the conditions and restrictions applicable under these Regulations in respect of the fruit have been complied with, the officer shall—\n\n(c) sign the certificate at the foot of the notice of intention to export furnished in respect of the fruit; and\n\n(d) shall issue to the exporter an export permit in accordance with Form 4.\n\n(2.) When the fruit is brought to a wharf for shipment, the exporter shall deliver the export permit issued under the last preceding sub-regulation in respect of that fruit to the officer of Customs on duty at the ship by which the fruit is to be exported.\n\n(3.) When an officer is satisfied that the fruit has been loaded into the vessel by which it is to be exported, the exporter is entitled to receive and the officer may issue to the exporter a certificate in accordance with Form 5 as to the condition of the fruit.\n\nCanned or frozen fruit, may be re-examined and permit cancelled.\n\n17.—(1.) If an officer has reasonable cause to think that, since the examination by an officer of any canned or frozen fruit intended for export, the condition, grade or class of the fruit has changed, he may re-examine the fruit and if, having regard to the condition, grade or class of the fruit as disclosed by the re-examination, the officer is satisfied that—\n\n(a) the fruit is not marked in the prescribed manner with the prescribed trade description; or\n\n(b) any condition or restriction applicable under these Regulations in respect of the fruit has not been complied with, he may cancel the export permit and any certificate in respect of the fruit issued under the last preceding regulation.\n\n(2.) Where an export permit or certificate as to the condition of any canned or frozen fruit has been cancelled under the last preceding sub-regulation, the exporter shall, if so required by an officer, forthwith surrender the permit or certificate, as the case may be, to the officer.\n\nPenalty: Fifty pounds.\n\n \nPart V.—Registration of Brands.\n\nRegister of brands.\n\n18.—(1.) Subject to the next two succeeding regulations, the Secretary may register a brand as a brand that may be included in the trade description of canned or frozen fruit intended for export.\n\n(2.) The Secretary shall keep a register of brands registered by him under this regulation.\n\n(3.) The register of brands kept by the Secretary under the repealed Regulations shall be incorporated with and form part of the register kept under these Regulations.\n\nApplication to be accompanied by copies of brand.\n\n19. A brand shall not be registered under these Regulations unless it is accompanied by seven copies of the brand.\n\nRegistration as trade mark necessary.\n\n20. A brand shall not be registered under these Regulations unless it is registered as a trade mark under the Trade Marks Act 1905-1948 and the applicant is the registered proprietor of the trade mark.\n\nRegistration number.\n\n21. The Secretary shall allot a number to each registered brand and that number may be applied to canned or frozen fruit in conjunction with the brand.\n\nAssignments and transmissions of trade marks to be notified.\n\n22. Where a trade mark that is registered as a brand under these Regulations is assigned or transmitted, the person to whom it is assigned or transmitted shall give notice of the assignment or transmission to the Secretary.\n\nPenalty: Twenty-five pounds.\n\nCancellation of brand where no longer registered as a trade mark.\n\n23. Where a trade mark that is registered as a brand under these Regulations ceases to be registered as a trade mark, the Secretary shall cancel the registration of the brand.\n\nPart VI.—Miscellaneous.\n\nAnalysts.\n\n24.—(1.) The Minister may appoint persons who he is satisfied have the necessary qualifications to be analysts for the purposes of these Regulations.\n\n(2.) An analyst may analyse samples of canned or frozen fruit to which these Regulations apply that are taken by an officer under the Commerce (Trade Descriptions) Act 1905-1950.\n\nCertificates of analysis.\n\n25.—(1.) In proceedings arising under the Customs Act 1901-1953, the Commerce (Trade Descriptions) Act 1905-1950 or these Regulations in relation to canned or frozen fruit to which these Regulations apply, a certificate given by an analyst as to the result of an analysis of a sample of that fruit is prima facie evidence of the matters stated in the certificate.\n\n(2.) Judicial notice shall be taken of the signature of an analyst appearing on a certificate referred to in the last preceding sub-regulation and of the fact that the person by whom the certificate purports to have been signed is an analyst.\n\n \nFees for certificates.\n\n26. A copy of a certificate of analysis of canned or frozen fruit to which these Regulations apply may be supplied by the Secretary to the exporter of the fruit in respect of which the analysis was made—\n\n(a) where the analysis was made at the instance of an officer for a purpose of the Department—upon payment of the sum of One shilling;\n\n(b) where the analysis was made at the request of the exporter— upon payment of the sum of Ten shillings and sixpence.\n\nInspection fees.\n\n27.—(1.) When, at the request of a person, the services of an officer are made available to the person for a purpose of these Regulations before or after official hours or on a Sunday or holiday, that person shall, except as provided by the next succeeding sub-regulation, be charged for those services a fee at the rate of Thirteen shillings for each hour or part of an hour during which the services of the officer are supplied and the officer is reasonably occupied in proceeding to and returning from the place where his attendance is required.\n\n(2.) Where an officer is required to proceed on duty away from his ordinary station, the fee to be paid in respect of his services is such fee as is fixed by the Minister.\n\n(3.) For this regulation, \"holiday\" means a day observed as a holiday in the Public Service of the Commonwealth by virtue of section 76 of the Public Service Act 1922-1953.\n\n![](image.004.png)THE SCHEDULES.\n\n![](image.004.png)First Schedule.\n\nRegulation 2.\n\nSTATUTORY RULES REPEALED.\n\nStatutory Rules 1938, No. 109.\n\nStatutory Rules 1944, No. 140.\n\nStatutory Rules 1948, No. 26.\n\nStatutory Rules 1948, No. 78.\n\nStatutory Rules 1950, No. 40.\n\nStatutory Rules 1951, No. 129.\n\nStatutory Rules 1952, No. 104.\n\nStatutory Rules 1954, No. 45.\n\n![](image.004.png)Second Schedule.\n\nRegulation 9.\n\nPART I.—GENERAL CONDITIONS AND RESTRICTIONS TO BE COMPLIED WITH IN RESPECT OF CANNED OR FROZEN FRUIT INTENDED FOR EXPORT.\n\n1\\. Canned or frozen fruit shall consist of sound fruit and shall not contain any added substance except brine, sugar, syrup or such harmless colouring matter as is permitted by these Regulations and, in the case of frozen fruit, such preservatives as are approved by the Secretary.\n\n2\\. Canned fruit shall be packed in an immediate container that is—\n\n(a) a can made of tinplate, a jar made of glass or of another material approved by the Secretary;\n\n(b) strongly and efficiently constructed; and\n\n(c) clean.\n\n \nSecond Schedule—continued.\n\n3\\. Immediate containers referred to in the last preceding paragraph shall be enclosed in outside containers that—\n\n(a) are clean new cases constructed of well seasoned soft-wood or hardwood that has been smoothly sawn or dressed in a manner approved by the Secretary, strapped with metal strapping' or wire and, in the opinion of the Secretary, is sufficiently strong to withstand the handling ordinarily incidental to transport to destinations beyond the Commonwealth; or\n\n(b) are fibre board cases—\n\n(i) that consist of one piece of solid fibre board of not less than 0.100 inches thickness constructed with outer face of 0.016 inches thickness, the bursting strength of the outer facing of which shall be not less than 100 pounds per square inch Mullen value and the bursting strength of the combined board of which shall be not less than 275 pounds per square inch Mullen value;\n\n(ii) that are coloured and made waterproof;\n\n(iii) the side flaps of which are securely riveted and fastened;\n\n(iv) that, whenever considered necessary by the Secretary, are strapped with metal strapping or wire; and\n\n(v) that, when packed, do not exceed 75 pounds gross weight.\n\n4\\. Frozen fruit shall be packed in an immediate container that—\n\n(a) if made of tinplate, may be made in a size that has a net weight of ten pounds, 20 pounds, 30 pounds or 40 pounds, or in such other size as the Secretary approves, and has one dimension that does not exceed six and three-quarter inches; or\n\n(b) if a carton, is waxed both internally and externally, has an inner sealed liner of moisture-vapour proof cellulose film or of other material approved by the Secretary and made in a size that, when packed, has a weight of eight ounces, twelve ounces, one pound, one pound eight ounces or two pounds.\n\n5\\. Immediate containers referred to in the last preceding paragraph shall be enclosed in cases that comply with the same requirements as those specified in paragraph 3 of this Schedule but the net content of which does not—\n\n(a) where the immediate containers are of tinplate, exceed 60 pounds;\n\n(b) in any other case, exceed 48 pounds.\n\n6\\. The tinplate of which cans are made shall be of a substance and quality approved by the Secretary.\n\n7\\. Cans containing canned or frozen fruit shall, if the Secretary considers it necessary, be lacquered on the whole of the outside surface in a manner approved by the Secretary.\n\n8\\. Immediate containers shall not have been packed in outside containers unless there has elapsed after the canning process has been completed—\n\n(a) in the case of canned fruit (including tomatoes), a period of seven days; and\n\n(b) in the case of canned vegetables, a period of fourteen days.\n\n9\\. The tops and bottoms of cans shall not be soldered except in the case of frozen fruit and vegetables packed in cans larger than a No. 10 can.\n\n10\\. The immediate containers shall be packed so that there is no free movement of the immediate containers within a case that is likely to cause breakages or other damage to the containers or to their labels during transit.\n\n11\\. The maximum number of cans of canned fruit that may be packed in a case shall not exceed seventy-two and the net weight of the contents of the case shall not exceed fifty-six pounds.\n\n12\\. A can shall be filled with the maximum quantity of fruit that can be sealed in it and preserved to prevent spoilage but without crushing or breaking the contents.\n\n \nSecond Schedule—continued.\n\n13\\. Subject to the last preceding paragraph, a thirty ounce (No 2½) can shall contain—\n\n(a) in the case of apricots, pears, peaches, fruit salad (other than tropical fruit salad) and quinces—not less than 18 ounces of fruit;\n\n(b) in the case of cherries, gooseberries, plums, loganberries, raspberries, strawberries and blackberries—not less than 17 ounces of fruit; and\n\n(c) in the case of sliced pineapple—not less than 20 ounces of fruit.\n\n14\\. Where a can smaller or larger than a thirty ounce can is used, the maximum weight of fruit in the can shall be proportionately less or greater.\n\n15\\. Where syrup is added to frozen fruit, it shall be poured over the fruit in the can at a temperature not exceeding the atmospheric temperature in the processing room at the time and be sufficient to reach the top layer of fruit in the can.\n\n16\\. When dry sugar is added to frozen fruit, it shall be distributed evenly through the fruit in the can.\n\n![](image.005.png)Regulation 9.\n\nPART II.—REQUIREMENTS IN RELATION TO TRADE DESCRIPTION TO BE COMPLIED WITH IN RESPECT OF CANNED OR FROZEN FRUIT INTENDED FOR EXPORT.\n\n17\\. A label, lithographing, embossing' or printing shall not appear on an immediate container unless the label, lithographing, embossing or printing has been approved by the Secretary.\n\n18\\. Where canned or frozen fruit is labelled, one label only shall be applied to the can and, unless the Secretary otherwise approves, the label shall completely cover the body of the can.\n\n19\\. An immediate container of canned or frozen fruit shall have embossed on it—\n\n(a) the number allotted to the export establishment in which the fruit has been packed for export;\n\n(b) a code mark indicating the quality of the contents; and (c) except in the case of canned fruit of second or pie quality and frozen fruit of manufacturing quality, the letters \"EX\" conjoined.\n\n20\\. An immediate container of canned fruit of pie quality or of frozen fruit of manufacturing quality shall have the word \"Pie\" or the letters \"MF\" conjoined, as the case requires, embossed on the top of the can.\n\n21\\. An immediate container of canned or frozen fruit shall have embossed on it a cypher, approved by the Secretary, indicating the season of packing.\n\n22\\. An immediate container of canned or frozen vegetables shall have embossed on it a cypher, approved by the Secretary, indicating the date of packing.\n\n23\\. 3. Each can and each case shall contain only one variety of cherry.

4. Each can shall contain not more than 140 cherries, except in the case of Kentish cherries, a can of which shall contain not more than 200 cherries.

5. The fruit shall be of good quality, firm, ripe and free from blemishes.

6. The syrup used shall contain 30 per centum by weight of cane sugar.

24. Fruit Cocktail — Standard Quality

1. Fruit cocktail shall consist of a combination of yellow cling peaches, Bartlett pears, seedless grapes, pineapples and Maraschino cherries, in the following\" proportions:—.

1. The trade description shall include the words \"Standard Quality\" on the label and on the outside container. The words \"Artificially Coloured\" shall appear in legible characters on the label.

(a) the weight of the peaches shall be not less than 30 per centum nor more than 50 per centum of the total drained contents of the can;

(b) the weight of the pears shall be not less than 25 per centum nor more than 45 per centum of the total drained contents of the can;

(c) the weight of the grapes shall be not less than 6 per centum nor more than 20 per centum of the total drained contents of the can;

(d) the weight of the pineapple shall be not less than 6 per centum nor more than 16 per centum of the total drained contents of the can;

(e) the weight of the cherries shall be not less than 2 per centum nor more than 6 per centum of the total drained contents of the can.

2. The fruit included in fruit cocktail shall comply with the provisions of these Regulations (if any) with respect to standard quality fruit of that particular kind.

5. The pineapple shall be in the form of segments prepared from slices of a thickness not greater than one-half inch and the outside are of any segment shall not exceed one inch in length.

25. Fruit Salad, Fruits for Salad or Mixed Fruits — Choice Quality

1. The fruits shall be a mixture of two or more kinds of fruit other than the combination specified in Item 27 in respect of \"Tropical Fruit Salad\", with or without the addition of Maraschino cherries or passion fruit.

1. The trade description shall include the words \"Choice Quality\" on the label and on the outside container.

2. The fruits shall have been prepared as follows:—

(a) the pineapples, paw-paws and bananas shall consist of small portions or sectors; and

(b) the passion fruit shall consist of passion fruit or passion fruit pulp.

3. The pineapples shall comply with the provisions of these Regulations with respect to Choice Quality pineapples. The paw-paws, bananas and passion fruit shall be sound and free from blemishes.

4. The pieces of pineapple, paw-paw and banana shall be uniform in size and, where Maraschino cherries are included, they shall be of such size that not more than 12 cherries comprise one ounce avoirdupois drained weight.

5. Where cane sugar is added to the fruit, there shall be sufficient to give a cut out of not less than 20 per centum and not more than 23 per centum Brix at 60 degrees Fahrenheit.
