It operates under the Environmental Management and Pollution Control Act 1994.\n\n**Who it affects:**\n- **Businesses conducting environmentally relevant activities** – particularly industrial operations like chemical works, mining, waste treatment, food processing, and manufacturing\n- **Property developers** seeking planning permits that require environmental assessment\n- **Companies operating waste depots, quarries, or wastewater treatment facilities**\n\n**What it does:**\n- **Establishes annual fees** for environmental permits (called \"LUPAA permits\"), government orders, and environment protection notices. These fees vary based on the type and scale of activity – for example, a small chemical works pays less than a large oil refinery.\n- **Sets assessment fees** for when the Environmental Protection Board reviews proposed activities to determine their environmental impact.\n- **Creates a \"low-risk activity\" category** that allows qualifying businesses to pay reduced fees (250 fee units instead of potentially thousands).\n- **Provides exemption mechanisms** where the Board can waive or reduce fees for businesses that demonstrate good environmental performance or compliance history.\n- **Prescribes infringement notice penalties** for specific environmental offences, distinguishing between penalties for individuals and corporations.\n- **Exempts all fees from GST** (Goods and Services Tax).\n\n**Why it matters:**\nThis is essentially Tasmania's \"price list\" for environmental regulation. It creates financial incentives for businesses to reduce their environmental impact (through the low-risk activity provisions and exemption criteria) while ensuring that polluters and high-impact industries contribute more to the cost of monitoring and regulating their activities. The fee structure scales with operational size – larger, potentially more polluting operations pay significantly more than small ones."},"flash_summary":{"complexity_score":8,"scope_assessment":{"changed":true,"description":"The regulations rescind the 2007 fees instrument and replace it with a consolidated fees and penalties framework: updated tiered annual, variable and assessment fees linked to activity capacity; explicit timelines for payment; Board powers to grant/vary/revoke exemptions and to determine low‑risk status; powers to issue guidelines; recovery of consultation/advertising costs; and prescribed infringement penalties (Schedules 2–3).
